Higher Classification Work. A. Any employee who temporarily performs the duties of a position in a higher classification for 80 cumulative hours shall continue to receive the employee’s normal rate of pay. Any subsequent work performed by the employee in the higher classification shall entitle the employee to receive a higher rate of pay with two exceptions: 1. If substantial time, more than 12 months, has elapsed since the employee has last performed the work of the higher classification, the supervisor may require a performance test not to exceed a normal days work at the employee’s normal rate of pay. (This time shall not be compensated at the higher classification pay.) 2. In the instances where new equipment or new operational procedures are involved, the supervisor may require a training period not to exceed two normal days work at the employee's normal rate of pay. (This time shall not be compensated at the higher classification pay). B. The higher salary rate payable shall commence on the 81st working hour following the temporary assignment to the performance of duties of the higher classification. The higher rate of pay shall be defined as a one step increase in pay or “Step 1” of the classification, whichever is higher. C. In those instances where training is not involved, and if, in the supervisor's opinion, an employee is proficient in the higher classification, management has the authority to pay that employee at a higher classification pay rate without waiting 80 hours. D. If an employee assumes or is scheduled to assume the preponderance of duties of a higher classification in excess of 12 consecutive months, then the Department Head shall either initiate filling the position, stop the out of class assignment, or obtain written authorization from the City Manager to continue the assignment.

The Department Head or designee shall determine and specifically assign, in writing, an employee to perform all of the significant duties of the higher classification which is vacant due to sick leave, injury leave, vacation, separation or another circumstance as pre-approved by the Human Resources Agency. Any subsequent work (81 cumulative hours or greater) performed by the employee in the higher classification shall entitle the employee to be paid at the base rate of pay for that classification, consistent with Section C below, while performing such duties with two exceptions: 1. If more than 12 months has elapsed since the employee has last performed the work of the higher classification, the supervisor may require a performance test, not to exceed a normal working day at the employee's base rate of pay. 2. This assignment shall continue until the City no longer requires the employee to perform the duties of such assignment, to the extent legally permissible, pursuant to Government Code Section 20480. F. At the end of such assignment the employee performing the temporary assignment shall be returned to their original position and salary range. G. Higher Classification Work. An employee doing work in a classification which has a higher rate of pay than the employee’s regular classification shall receive the higher rate of pay beginning on the first day of such work.

Any bargaining unit employee who works in a higher classification shall receive an approximate 5% salary increase while the employee continues to work in the higher classification. Employees who work in a higher classification and are also required to perform paramedic duty shall receive the greater of an approximate 5% salary increase or the Paramedic Duty Assignment amount specified in Section 10.03(A) while the employee continues to work in the higher classification. B. Only hours worked in higher classifications that are required by the department shall be counted toward meeting this requirement. C. After an employee has qualified in accordance with this provision, the employee will not be required to re-establish eligibility in the qualified classification thereafter. D. The Fire Chief shall make the final determination of eligibility for each higher class assignment.
Higher Classification Work. Whenever an employee is assigned the responsibility of a different position in a classification above that in which the employee is normally classified, the employee shall be paid at 105% of the employee’s base rate of pay. In order to receive higher classification pay, the employee must work one (1) or more hours in that classification to be eligible for the pay. The County shall not unreasonably reduce hours working in a higher classification of pay to avoid paying the higher rate of pay. When working out of class for an entire month, the monthly rate of pay will be used as the base, not the hourly rate. Such assignments will be limited to a maximum of six (6) months provided other qualified employees are available to work out of class with qualifications and availability determined by the Sheriff. Employees assigned to a higher classification are not guaranteed continued assignment to such classification, and the termination of such assignment shall not constitute a demotion, nor shall it be within an arbitrator’s jurisdiction.

Higher Classification Work. Any employee designated by the Police Chief or his/her designee as acting-in-capacity in a higher position than his/her regular classification shall receive the pay for the position designated or a five percent (5%) increase above the employee’s normal salary, whichever is greater, in such assignment for the remainder of the assignment. This higher classification pay shall apply only to the actual duty days and hours specified in the written notice. Any employee who is designated a temporary supervisor as provided for above shall remain a member of the bargaining unit as defined except he shall assume all the duties and be subject to the working conditions of other supervisors of similar rank for the duration of his appointment.

Higher Classification Work. 12.1 Except for on-the-job training purposes, whenever an employee is required to perform any work for more than four (4) consecutive hours in a classification above that in which the employee is classified, the employee shall be paid for such work at the rate of five (5) percent above the employee’s current base rate. 12.2 It is understood and agreed that an employee may occasionally or intermittently, for short periods of time during his/her shift, perform duties which are normal to higher level classification. Occasional performance of such duties is not to be considered subject to this section.

In the instances where new equipment or new operational procedures are involved, the supervisor may require a training period not to exceed sixteen (16) hours at the employee’s normal rate of pay. 3. In those instances where training is not involved, and if, in the supervisor’s opinion, an employee is proficient in the higher classification, management shall pay that employee at a higher classification pay rate. The higher salary rate payable shall commence on the forty-first working hour following the temporary reassignment to the performance of duties of the higher classification. The higher rate of pay shall be defined as a 5% out of class compensation or “Step 1” of the higher classification, whichever is higher. This assignment will continue until the City no longer requires the incumbent to perform the duties of such assignment. At the end of such assignment the employee performing the temporary assignment shall be returned to the employee’s original position and salary range.
