MANAGEMENT RIGHTS 2. 01
a) Hire, promote, transfer, demote and layoff employees and to suspend, discharge, or otherwise discipline employees for just cause subject to the right of any employee to lodge a grievance in the manner and to the extent herein provided.
b) Operate and manage its plants in all respects in as efficient and economical manner as it sees fit, including the right to direct it’s workforce, and to determine the location of its plants, the products to be manufactured, the scheduling of its production and its methods, processes, and means of manufacturing and transportation.
c) Make and alter from time to time rules and regulations to be observed by employees, which rules and regulations shall not be inconsistent with the provisions of this Agreement. Any changes to these rules and regulations will be meaningfully discussed with the Plant Committee before publication. Employees will be given copies of new and/or revised policies prior to implementation.
d) The Company and Union agree that in the exercise of each of their rights and in the administration of this Agreement, they will do so in a fair and reasonable manner.
MANAGEMENT RIGHTS 2. 01 Except to the extent provided herein, this Agreement in no way restricts the authority of the Employer.

a) maintain order, discipline, and efficiency;
b) hire, promote, demote, classify, transfer, retire, rehire, lay off, recall, discipline, suspend or discharge any employee for just cause, provided that a claim by a seniority employee of discharge, suspension or discipline without just cause may be the subject of a grievance and dealt with as hereinafter provided;
c) deploy the working forces of the Employer or its equipment and properties;
d) programme and utilize technology in order to meet the Board’s operational needs.
MANAGEMENT RIGHTS 2. 01 - The Union recognizes that the Employer has the regular and customary rights of management, except insofar as such rights are modified or limited by this Agreement. The question of whether one of these rights is modified or limited by this Agreement may be decided through the grievance and arbitration procedure. The Union agrees that the regular and customary rights of Management generally include the right:
a) to maintain order, discipline and efficiency and to establish, revise from time to time and enforce reasonable rules and regulations to be observed by the employees (these rules and regulations must be consistent with the provisions of the Collective Agreement and such rules shall be posted by the Employer on the bulletin board of each department and a copy sent to the Union).
b) to hire, discharge, direct, transfer, classify, promote, demote: suspend or discipline its employees for just cause and to increase or decrease work force.
MANAGEMENT RIGHTS 2. 1 In order to insure that the Department is able to efficiently carry out its functions and responsibilities as imposed 1 by law, the Department has the exclusive right to manage and direct 2 the performance of Department services and the work force performing 3 such services; therefore, the following matters will not be subject 4 to the meet and confer process, but shall be within the exclusive 5 discretion of the Department.
