NO DISCRIMINATION AND HARASSMENT. 4.01 The Employer and the Association agree that there will be no discrimination, interference, intimidation, restriction or coercion exercised or practised by any of their representatives with respect to any nurse because of his/her membership or non-membership in the Association or activity or lack of activity on behalf of the Association or by reason of exercising his/her rights under the Collective Agreement, or any applicable legislation. However, it is also agreed that there will be no Association activity or solicitation for membership on the Employer's premises except with the Employer's written consent or as specifically provided in this Agreement.

NO DISCRIMINATION AND HARASSMENT. A4.01 The Employer agrees that there shall be no discrimination with respect to employment by reason of age, ancestry, colour and race, citizenship, ethnic origin, place of origin, creed, disability, family status, marital status, gender identity, gender expression, sex and sexual orientation in in accordance with the Ontario Human Rights Code, 1990 as amended nor by reason of his/her membership or lawful activity in the Union as protected by the Ontario Labour Relations Act, 1995 as amended. Furthermore, there will be no harassment tolerated in the workplace as precluded by the Ontario Human Rights Code and the Occupational Health and Safety Act (Bill 168) as well as any other applicable Acts and Legislation.

NO DISCRIMINATION AND HARASSMENT. The Employer and the Union agree that there will be no discrimination or harassment against any Employee or prospective Employee by reason outlined below. The Code prohibits actions that discriminate against people based on a protected ground in a protected social area. Protected grounds are: age; ancestry, colour, race; citizenship; ethnic origin; place of origin; creed (including; religion); disability; family status; marital status (including single status); gender identity, gender expression; political affiliation; receipt of public assistance (in housing only); record of offences (in employment only); sex (including pregnancy and breastfeeding); sexual orientation membership in the Union. The Parties agree that Employees will neither engage in nor be subject to threats of physical abuse or physical harm. Any form of violence and discriminatory behaviour, including sexual violence, sexual harassment, and racism, are considered harassment. What constitutes an act of discrimination shall be governed by the legislation by the legislation, regulations and jurisprudence pursuant to the Human Rights Codes for Canada and the Province of Ontario and any of its eventual modifications. The Employer and the Union are committed to actively promoting employment equity and to fostering a work environment that is diverse and inclusive and that is based on respect for all while supportive of the productivity, personal goals, dignity, and self-esteem of every Employee. To this end, the Employer will not tolerate racism, discrimination, or harassment of any kind in the workplace. Every Employee can expect to be treated fairly in the workplace, in an environment free of discrimination based on prejudice, harassment or abuse of authority. The Parties agree that this does not restrict the authority of the Employer to meet its obligations under the Collective Agreement.

The rights under this article are not infringed where discrimination on a prohibited ground is a reasonable occupational qualification.
NO DISCRIMINATION AND HARASSMENT. The parties agree to abide by the terms of the Ontario Human Rights Code regarding their obligations to prevent discrimination and harassment in employment.
