14.4.7.1. Change Time' will not cause the incurrence of a penalty in relation to this clause. The following breaks and payments will apply dependent on the nature of the hours being worked: 14.
Meal Breaks and Crib Breaks. 6.13.1 Meal breaks and crib breaks during ordinary time
(a) Meal breaks for day workers during ordinary time
(i) Day workers shall be entitled to a meal break of a minimum of 30 minutes and a maximum of 60 minutes to be taken during the fifth and sixth hours from the commencement of the day worker’s ordinary hours.
(ii) The current meal break period for day workers in the Innisfail Babinda Regional ▇▇▇▇▇ is 30 minutes. Where agreed between the Company and the majority of day workers directly affected meal times may be altered or staggered.
(iii) When a day worker is required to do any work during the meal break the day worker shall be paid at double time for the time so worked.
(iv) If more than half the meal break is worked the day worker shall continue to receive double time until the day worker is allowed a meal break of 30 minutes, for which no deduction shall be made.
(a) Crib breaks for shift workers during ordinary time
(i) Employees working 8 hour shifts shall be allowed 30 minutes in each rostered shift for meal times (crib) which shall be taken after the completion of 2 hours and prior to the start of the 6th hour after the commencement of the shift worker’s ordinary hours of work.
(ii) Employees working 12 hour shifts, shall be allowed 45 minutes in each rostered shift for meal times (crib) provided that no one break shall exceed 30 minutes in duration (e.g. one break of 30 minutes and one break of 15 minutes).
(iii) Employees working shifts of between 8 hours and 12 hours shall be allowed a proportionate amount of the entitlement provided to 12 hour shift workers for meal times (crib) in each rostered shift.
(iv) Shift workers shall take their crib breaks at such time so as not to interfere with the continuity of work.
(v) Crib times for shift workers shall be taken without deduction of pay.
(vi) Where a shift worker is not relieved for crib and is unable to have a break of 30 minutes for crib within a period of 40 minutes from the time of commencing crib, the shift worker shall be entitled to an additional 30 minutes’ pay at ordinary rates.
(vii) Where shift workers are required to take their crib at their place of work, suitable places for such shift workers to take their crib together with tables and seating shall be provided by the Company.

The following breaks and payments will apply dependent on the nature of the hours being worked: Meal Breaks (Ordinary Hours) A meal break is an unpaid break from work of between 30 minutes and one (1) hour duration during which employees are not required to remain on call or on site. No employee will be required to work for more than five hours continuously without a meal break. When practical meal breaks should be taken during the following hours: Breakfast 07.00 - 10.00 hours Lunch 12.00 - 15.00 hours Dinner 17.00 - 20.00 hours Supper 22.00 - 01.00 hours Break provided late or not taken Any employee required to work for more than five hours continuously without a meal break will be paid a penalty of 100% in lieu of any other applicable penalties from the expiry of the five hour period until the meal break is granted. On a public holiday the penalty rate will be 150%. If an employee is unable to take the required meal break(s) during their shift then overtime at 100% penalty rates (or 150% on a public holiday) will apply for the hours in excess of the ordinary hours rostered. Meal breaks outside ordinary hours shall be of 30 minutes duration.
