– Missed Breaks. If an employee agrees to work through lunch breaks because no relief is available due to unforeseen circumstances, the employee shall receive payment at time and one-half (1.5) their regular rates.

– Missed Breaks. (a) Where a Master is not able to direct an Employee to take a meal or rest break to which they are entitled, the Employer will pay the Employee an allowance for the missed portion of the meal or rest break at the Employee's equivalent ordinary hourly rate of pay. For example, if the Employee misses 5 minutes of their 20-min meal break, the allowance payable is the equivalent of 5 minutes at their ordinary hourly rate of pay. (b) Breaks and the break time is considered as time worked for the purpose of calculating overtime and penalty payments. An Employee wishing to claim for a missed break time allowance must do so via the Time and Attendance system (currently 'Deputy') and include the reason and/or_ reporting code for the missed break. Missed break allowance claims that do not include a valid reason will not be accepted by the Employer. (c) For the purpose of this clause, a missed meal or rest break does not include any time where: (i) The Employee takes a phone call, radio call, or message and is not required to act upon that message in terms of further work, or (ii) A break that is interrupted or not taken but is subsequently made up/taken some time during the shift.
– Missed Breaks. Employees are expected to take their daily rest and meal breaks. If a court assignment is likely to interfere with a normally scheduled break, the impacted employee must notify his/her supervisor in advanced of the missed break in order to allow the supervisor an opportunity to provide coverage. Breaks missed due to the necessity of court proceedings will be compensated either by 1) shortening the work day and allowing the employee to leave early, or 2) paying (subject to the CBA overtime rules) for the missed time. The decision of the supervisor to release the employee early or to pay for the extra time worked, is at the supervisor’s discretion and is not grievable beyond the DJA Director step.

  • Lunch Breaks The lunch break will consist of a one-half hour (or one hour where scheduled) unpaid break taken mid-way during regular work day. In the event that an employee is required to work during his regular lunch period he shall be allowed a one-half hour lunch period between the hours of ll:30 a.m. and l:00 p.m., otherwise he shall be paid double time for working through said lunch period.

  • Tea Breaks (a) Every employee will be entitled to a paid 10 minute tea break in each four hours worked at a time to be agreed between the employee and employer. (b) Subject to agreement between the employer and employee, such breaks may alternatively be taken as one 20 minute tea break. (c) Xxx breaks will count as time worked.

  • Rest Breaks Employees shall receive a fifteen (15) minute break during each four (4) hours worked. It is the Employer's intention to provide uninterrupted rest breaks.

  • Coffee Breaks The Company will provide two (2) fifteen (15) minute coffee breaks during each work day, one in the morning and one in the afternoon.

  • Breaks 40.1 One 10-minute paid morning rest break and one 30 minute unpaid lunch break will be scheduled within 6 hours after work starts. 40.2 Where an Employee is required to work more than two hours overtime after the usual ceasing time of the day or shift they shall be allowed a 20 minute rest break paid at ordinary time rates prior to commencing overtime. Employees who take payment in lieu of stopping work for this break will be regarded as having worked a further 20 minutes and shall be paid at overtime rates. 40.3 An Employee working overtime on a Saturday, Sunday or Public Holiday shall be allowed a 30-minute combined Rest Period/Meal/Crib Break after four hours work, such time to be paid at double ordinary time rates, with a further 20 minute Crib break to be paid at double ordinary time rates if the overtime continues past 8 hours worked. 40.4 In the case of overtime work being cancelled by the Employer at the end of the 4-hour minimum or any time thereafter, Employees will, in addition to the payments as prescribed, be paid for the 30 minutes combined Crib/Meal/Rest Period if not already taken. 40.5 If work proceeds beyond the 4 hours minimum then Employees will be paid for all time so worked.

  • Lunch Break Each Teacher shall receive each day an uninterrupted and continuous period of not less than forty (40) minutes for lunch, free from supervisory, teaching or other assigned duties (reference: Regulation 298.s. 3, Daily Sessions).

  • H3 Break The Authority shall have the right to terminate the Contract at any time by giving three (3) Months’ written notice to the Contractor. The Authority may extend the period of notice at any time before it expires, subject to agreement on the level of Services to be provided by the Contractor during the period of extension.

  • Work Breaks Meal breaks 36.1 There will be a cessation of work and of working time, for the purpose of a meal on each day, of not less than thirty (30) minutes, to be taken between 11.00am and 1.00pm. Such period will be unpaid. 36.2 Where, because of the area or location of a project, the majority of on-site employees on the project request, and agreement is reached, the period of the meal break may be lengthened to not more than forty-five (45) minutes with a consequential adjustment to the daily time of cessation of work. Working during meal break 36.3 If the employer requires an employee to work through the employee’s normal meal break the employee will be paid at the rate of double time until the employee is allowed to take such break. 36.4 Where the meal break is shortened by agreement, the employer will pay for the period by which the meal break is shortened, which will then form part of ordinary time hours. Daily rest breaks 36.5 There will be allowed, without deduction of pay, a rest period of ten (10) minutes, between 9.00am and 11.00am. The times provides in clauses 36.1 and 36.5 are indicative only and subject to the reasonable operational requirements of the employer.

  • Rest Break (a) An employee working overtime must be allowed a rest break of 20 minutes without deduction of pay after each four hours of overtime worked if the employee is to continue work after the rest break. (b) Where a day worker is required to work overtime on a Saturday, Sunday or Public Holiday or on a rostered day off, the first rest break will be paid at the employee's ordinary rate of pay.

  • Meal Breaks The timing of meal breaks on any particular job may be discussed between the Employer and the majority of employees at a particular site and varied by agreement. Occupational health and safety considerations will always prevail.
