PAYMENT FOR UNUSED SICK DAYS. 1. When any employee retires from the district, he/she shall be reimbursed as follows: 2018-21 -- 20 years of service / $60 00 per day / monetary cap of $ 11,000 15 years of service/ $50 00 per day / monetary cap of $ 11,000 10 years of service / $40 00 per day / monetary cap of $ 11,000 a. The employee, in order to be eligible for this benefit, must notify the Board of Education prior to the adoption of the budget for the fiscal year in which he/she plans to retire (December 1). b. If the employee fails to provide such notice, payment shall occur in the following fiscal year. The only exception to this rule would be unforeseen illness that necessitated retirement or an employee with qualified service who decides to retire due to a reduction in force. c. If an employee with qualified service time dies while in the employ of the Board of Education, his/her heir shall be entitled to the reimbursement under the applicable termination provision. d. Sick leave balances shall be paid upon retirement and paid into a 403(B) final pay plan account.

PAYMENT FOR UNUSED SICK DAYS. Employees retiring from the District with at least ten (10) years of continuous service in the District under the New York State Retirement Plan, shall receive the following benefits. If they have accumulated at least fifty (50) unused sick days, they shall receive a cash payment based on fifty (50%) percent of accumulated days (maximum fifty (50%) per cent of one hundred eighty (180) days) at the rate of pay in effect at that time.
PAYMENT FOR UNUSED SICK DAYS. (A) Employees who have accumulated four hundred and eighty (480) hours into their sick leave bank shall continue to accumulate Sick Leave at the rate of four (4) hours per month. Such employees shall automatically be compensated for all hours above four hun- dred and eighty (480) hours on the second (2nd) pay period follow- ing August 1st of each year. The rate of pay for such excess hours shall be the rate in effect as of July 31st of that year. (B) Each year any employee with more than two hundred (200) hours accumulated sick leave may choose to be compensated for any or all hours in excess of two hundred (200). Employees choos- ing such compensation shall inform the Company in writing prior to July 1st in the year in which compensation is requested. The hourly rate of pay for such excess hours shall be the rate in effect as of July 31st of that year. The check will be issued no later than the second (2nd) pay period following August 1st of that year. Employ- ees shall have the option of rolling the entire pre-tax amount into their UPS 401(k) Plan. (C) Employees who retire from the Company under the Western Conference Pension Plan will be paid for all unused sick leave. (D) Employees who have two hundred (200) or more hours in their sick leave bank upon termination shall be paid for all unused sick leave. (E) Employees who terminate with more than one hundred (100) hours in their sick leave bank shall receive one-half (1/2) of their unused sick leave.

(F) An employee who is unable to work due to an off the job injury or illness shall be removed from the seniority list after a period of three (3) years, unless extended by mutual agreement between the Union and the Employer. This provision only applies to employees who go of work due to an off the job injury or illness after August 1, 2013, and not employees off the job prior to August 1, 2013.

PAYMENT FOR UNUSED SICK DAYS. 1. A nurse who has completed fifteen (15) years of employment with the District shall be eligible for a payment for unused accumulated sick leave days. 2. Upon request, the payment will be granted to nurses who qualify. A nurse must make such a request in writing to the Superintendent six (6) months prior to the effective date of retirement. 3. The nurse’s unused accumulated sick leave days over one hundred and sixty-five (165) days (up to a maximum of 50 days) shall be applied to the following formula to determine the amount of the lump sum payment: # of eligible accumulated sick leave days x $50 = cash payment. 4. Payment for eligible accumulated sick leave days shall be made on or before the thirty-first (31st) day of July of the school year next succeeding the school year in which the nurse retires. Date of payment shall be determined by the nurse at time of notification. 5. Payment for accumulated sick leave days shall be made as a non- elective employer contribution to the ING, NYSUT-endorsed, 403-b plan. No nurse may receive cash in lieu of or as an alternative to the District’s non-elective contribution. ARTICLE 136 - XXXXXX LAW 204 IT IS AGREED BY AND BETWEEN THE PARTIES THAT ANY PROVISION OF THIS AGREEMENT REQUIRING LEGISLATIVE ACTION TO PERMIT ITS IMPLEMENTATION BY AMENDMENT OF LAW OR BY PROVIDING THE ADDITIONAL FUNDS THEREFOR, SHALL NOT BECOME EFFECTIVE UNTIL THE APPROPRIATE LEGISLATIVE BODY HAS GIVEN ITS APPROVAL.
PAYMENT FOR UNUSED SICK DAYS. 1. To be eligible for payment for unused sick days, an employee must take an early retirement, a disability retirement, or a service retirement, and must have completed ten (10) years of service within the district. 2. Payment shall be based upon sick leave days that the retiring employee has accumulated beyond 30 days and at the rate, for certificated employees of $70 per day in the current contract, and for non-certificated employees of $49 per day in the current contract. 3. Any employee who dies shall be entitled to have the benefits as outlined in Article XIII.B.2. paid to his/her estate. 4. The employee may opt to receive the reimbursement of sick leave payment in the tax year he/she retires or to receive payment January 15 of the proceeding tax year, provided such deferral is permitted under IRS rules.

PAYMENT FOR UNUSED SICK DAYS. A. Unit members covered by this agreement who leave the employ of the Xxxxxxxx Township Schools, and who, at the time of separation become officially retired under the provisions of the Pension Plan, shall receive reimbursement from the Board for a fraction of unused sick days accumulated during their employment in the Xxxxxxxx Schools. The percentage (32%) used in the formula to determine the amount of sick time retirement payout shall remain in effect for the existing bargaining unit but shall be reduced from thirty-two percent (32%) to twenty-five percent (25%) for all Administrators hired on or after July 1, 2003. The formula to be used to determine the amount is to be the current salary divided by 237 x current sick day bank x 32% for those hired before July 1, 2003. For all Administrators hired on or after July 1, 2003, the formula to be used to determine the amount is to be the current salary divided by 237 x current sick day bank x 25%. 1. A day’s pay shall be calculated by using 1/237 of the contracted salary of a unit member employed on a twelve (12) month contract. 2. In the event employment terminates prior to February 1st of the school year covered by the duration of this Agreement, the Board shall pro-rate one (1) day per month of a completed employment for the last year. 3. Termination occurring after February 1st of the school year covered by the duration of this Agreement shall entitle the unit member to utilize the maximum annual sick leave granted at that time minus all used sick days for final year computation. 4. There will be a cap of eighteen thousand dollars ($18,000) on sick time retirement payout. This cap does not apply to Administrators who vested at least fifteen thousand dollars ($15,000) of accumulated sick leave time as of June 30, 2004. 5. Sick time payout upon retirement will be made over two (2) fiscal years. B. In the event of the death of a unit member who has completed fifteen (15) years of service in the District, payment of such terminal pay as calculated in accordance with Paragraph A. 1, 2 and 3 of this Article shall accrue to said unit member’s estate and/or designated beneficiary(s). Payment of such entitlement shall be made to the beneficiary and/or estate in lump sum payment within one (1) month of the death or within the calendar year.

PAYMENT FOR UNUSED SICK DAYS. Eligible employees at time of retirement shall be entitled to payment for unused sick days at $55.00 per day to a maximum of $8,000. Any employee required to retire because of permanent disability shall be eligible for the above benefits.
