POSTING AND BID PROCEDURE. 9.01 The Board/designee shall determine if job vacancies should be posted, including newly created positions within the bargaining unit within twenty (20) work days of the occurrence of the vacancy or newly created position. The vacancy notice shall be posted for a period not to exceed five (5) work days. The vacancy notices will be posted in all buildings and generally will contain the following information. 1. A general description of the duties and responsibilities of the position; 2. The general qualifications required; 3. Hours and days per contract; 4. The rate of pay; and 5. Building assignment (if applicable). 9.02 Interested employees may submit bids to the Superintendent during the five (5) day posting period. 9.03 Vacancies will be filled within ten (10) workdays after the close of the bidding period. 1. When qualified employees apply for a vacancy, the vacancy will be awarded to the applicant currently employed in the classification of the vacancy. In the event that more than one qualified employee applies for a vacancy within their classification, the employee with the most job classification seniority will be assigned to the vacancy. 2. If none of the applicants are employed in the classification with the vacancy, then the vacancy shall be awarded to the most qualified applicant. Should the qualifications of the applicants be equal, then system seniority will be the determining factor. 3. In determining whether an applicant is qualified and which applicant is most qualified, the Board may consider individual’s qualifications reasonably related to the open position, including evaluations, attendance, disciplinary records and any necessary skills test. The union shall have the opportunity to review the make-up of the tests, prior to the tests being given. 4. Employees who successfully bid into another position shall be placed on the appropriate new salary schedule at the step which represents an increase closest to the current salary the employee is receiving. 9.04 All applicants will be notified when the vacancy is filled. 9.05 The President of the Association will be mailed vacancy notices. During the summer, vacancy notices will be mailed to all employees enclosed with the employeespayroll checks. 9.06 Within five (5) days from the date the vacancy has been filled, the President of the Association will be informed of the name of the successful applicant. POSTING AND BID PROCEDURE. 1. A. Unless the Board determines not to fill a position in accordance with Article VIII of this Agreement, the Board shall post all job vacancies, including newly created positions, revised and promotional positions for a period not to exceed four (4) working days. The vacancy notices shall be posted online on the District's website, which is accessible for all employees to review. Employees reserve the right to print and post these vacancies in their work area(s). At the end of the four (4) working days the bidding shall be closed. The vacancy notices shall contain the location, job description and details of the opening(s). All vacant or newly created positions must be posted for bid and shall be posted as vacated, unless the Board determines not to fill the position. The posting period shall begin not later than five (5) days from the time the position became vacant or was known it was to become vacant. Positions posted during the summer will be for six (6) working days. The general work area of the building, number of hours worked and the time of day to be worked will be stated on the posting. After 20 days, if a vacancy is not filled by either an inside or outside applicant, the vacancy will be reposted for bargaining unit employees to reconsider. All applicable sections of the collective bargaining agreement will be in effect for that reposting.
POSTING AND BID PROCEDURE. 13.01 The Board shall post all job vacancies it intends to fill, including newly created positions and promotional positions, for a period of five (5) working days in the locations described in 13.05, and by email, and shall contain a description and details of the opening(s). The posting period shall begin immediately after the conclusion of the probationary period. Except as otherwise set forth in 13.044, vacancies will be filled at a group meeting in the affected classification until a final position is to be posted outside the classification within five (5) working days after the probationary period ends. All employees in the affected classification must either attend the group meeting or provide a proxy in order to participate in the bidding process. Affected employees who do not attend or provide a proxy will be given the opportunity to bid on any remaining vacancies in the classification prior to a posting for employees outside of the classification. The posting for outside the classification will not occur until the end of the probationary period. Vacancies filled at the group meeting are not subject to challenge by an employee or the union. For the purposes of this article, the following definitions will be used. Transfer is the movement of an employee from one (1) work assignment to another assignment which has, by comparison, the same job description, similar duties and responsibilities, and the same hourly wage rate. Promotion is the movement of an employee from one (1) work assignment to another assignment which has, by comparison, a different job description, expanded duties and/or responsibilities, and a higher hourly wage rate. Demotion is the movement of an employee from one work assignment to another assignment which has, by comparison, reduced duties and responsibilities, a different job description, and a lower wage rate. 13.02 An employee must make a request for the vacant position, by email or in writing, to the appropriate supervisor or superintendent, as indicated in the Notice of Vacancy. 13.03 The awarding and filling of the vacancies shall occur within five (5) working days of the closing of the bids, unless a reason for the delay in the filling of the vacancy is provided in writing to the President of OAPSE Chapter #223. As regular vacancies and new positions occur in the bargaining unit, notice of such vacancy or new position shall be posted on bulletin boards for five (5) calendar days prior to the filling of the position.   • Sealing and Marking of Bids The bidder shall seal the original and each copy of the bid in separate envelopes duly marking the envelopes “ORIGINAL” and “COPY”. The envelopes shall then be sealed in an outer separate envelope.

  • Posting and Filling of Vacancies 8.1(1) When a permanent vacancy occurs within a classification covered by this agreement, which the Employer intends to fill, after the Employer applies the internal job transfer bidding procedure and the ultimate vacancy is thereby identified, such vacancy shall be advertised for ten (10) calendar days provided that nothing herein shall prevent the Employer from advertising such vacancy throughout its system or outside during the ten (10) day period. Probationary employees may, at the sole discretion of the Employer, be considered for another position outside their classification after the signing date of this agreement. The Company reserves the sole and absolute right to carry out any applicable interviewing or testing that is necessary in its opinion. All test processes will be approved by qualified Human Resources staff. An employee will only be allowed to take one test failure for each different job classification bid every four (4) months. Current employees applying for positions which involve increased driving responsibilities must meet corporate driving standards and provide with application a current driving abstract. The opinion of the Employer shall not be exercised in an arbitrary or discriminatory manner. 8.1(2) Internal Job Transfer Bidding Procedure 8.1(3) This internal job transfer bidding procedure is within a given classification as follows: 8.1(4) All employees within each classification, when requested, must submit a “standing application” to transfer to any existing alternate home base or location, shift, shift hours, days off (in order of preference), to transfer from part-time to full-time status, or to indicate that they wish no change, whichever is applicable to each individual within their current classification. 8.1(5) A copy of such standing application submitted will be furnished to the employee. Since a standing application will remain valid indefinitely until it results in action or is replaced by the employee, it is the responsibility of the employee to ensure that a standing application always reflects the employee’s current preferences. 8.1(6) (i) When a permanent classification position vacancy is to be filled, all standing applications will immediately be reviewed with the intention of awarding transfers (including any “resultant” transfers) in order of classification seniority in the following sequence, where applicable: (a) transfer of a full-time employee from one home base or location to another or as referred to above; (b) transfer of an employee from part-time to full- time status; (c) transfer of part-time employees from one home base or location to another or as referred to above; and (d) transfer of full-time employees to part-time.

  • Labor Relations; Compliance No Acquired Company has been or is a party to any collective bargaining or other labor contract or agreement, and there has not been, there is not presently pending or existing, and there is not Threatened, (a) any strike, slowdown, picketing, work stoppage, or employee grievance process, (b) any Proceeding against or affecting any Acquired Company relating to the alleged violation of any Legal Requirement pertaining to labor relations or employment matters, including any charge or complaint filed by an employee or union with the National Labor Relations Board, the Equal Employment Opportunity Commission, or any comparable Governmental Body, organizational activity, or other labor or employment dispute against or affecting any of the Acquired Companies or their premises, except as described in Part 3.21 of the Disclosure Letter, or (c) any application for certification of a collective bargaining agent. No event has occurred or circumstance exists that could provide the basis for any work stoppage or other labor dispute. There is no lockout of any employees by any Acquired Company, and no such action is contemplated by any Acquired Company. Each Acquired Company has complied in all respects with all Legal Requirements relating to employment, equal employment opportunity, nondiscrimination, immigration, wages, hours, benefits, collective bargaining, the payment of social security and similar taxes, occupational safety and health, and plant closing. No Acquired Company is liable for the payment of any compensation, damages, Taxes, fines, penalties, or other amounts, however designated, for failure to comply with any of the foregoing Legal Requirements.

  • Training and Orientation (a) No employee shall be required to work on any job or operate any piece of equipment until he/she has received proper training and instruction. (b) The Employer shall provide sufficient and adequate training and/or orientation to any employee working in a new or unfamiliar work area or position.

The xxxxx heights shown in A6 were selected with the objective of maximum reasonable utilization of the timber, unless Sale Area Map shows special areas where xxxxx heights are lower for aesthetic, land treatment, or silvicultural rea- sons.
