Professional Personnel Records. According to State Department of Education requirements, certain personnel records shall be kept up-to-date and on file for reference at all times. These and other personnel records shall be filed in the Department of Human Resources. These personnel records include: a. Application of reemployment, including references. b. Copy of the latest contract, properly signed. c. Copy of latest salary notice. d. Health certificate card. e. Health History card. f. Ohio teaching certificate. g. Personnel record card. h. Personal and professional data form. i. Transcript of college credits showing the official record of the degree granted, original or certified copy. j. Record of military service. k. Record of tuberculosis or X-ray. The Department of Human Resources shall provide copies of all written documents that the member has a right to review upon written request of said member. Such documents shall be furnished within ten (10) days. Current cost per copy shall be determined by the Treasurer. Members shall have the opportunity to read any material which may be considered derogatory to the member’s conduct, service, character, or personality, before it is dated and placed in his/her personnel file. The member shall acknowledge that he/she has read the material by affixing his/her signature to the copy to be filed and a copy shall be given to the member. His/Her signature shall not indicate agreement with the content of the material, but indicates only that the material has been inspected by the member. He/She shall also have the opportunity to reply to such derogatory material in a written statement to be attached to the filed copy. Members shall be informed within five (5) days of any written complaint by a parent, student or supervisory person which is directed toward that member and may become a matter of record. Only signed written complaints can become a matter of record. Anonymous letters or materials shall not be placed in a member’s file nor shall they be made a matter of record. Each member shall have the right, upon request, to review all contents of his/her own personnel file, with the exception of items a. and i. listed above. A representative of the Association may, at the member’s request, accompany the member in such a review. Professional Personnel Records. A. The Board and the Association agree that the Superintendent's office will maintain a personnel file on each teacher employed by the district. The personnel file will consist of all records, evaluations, honors, letters, and notations made on a teacher during his/her employment as well as pre-employment materials concerning such teacher. The District may develop a procedure to purge this file of pre-employment materials no longer deemed necessary to maintain and/or to discard all such pre-employment materials. Such personnel file may be accessed and copied to the extent permitted by law, but the original and any part of these files may not be taken from the administrative offices. B. It is further agreed that the Treasurer will maintain a business file on each teacher. This file may contain contracts, compensation data, tax information, leave records, etc., but any medical records shall be kept separately. This shall be considered the only official file of recorded information of professional staff members maintained by the Board and Administration. B. All materials placed in the personnel file of the professional staff member shall include the following: 1. A dated stamp of the date the item was placed in the file. 2. The initials of the Administrator and date of placing of the information in the file. C. Letters of recommendation and other related information used for initial employment may be retained in personnel files or maintained by the local Board or Administration including the following: 1. Official transcript of college work. 2. Copy(ies) of certification/licensure authorized by the State Department of Education. D. Anonymous letters or materials shall not be placed in a professional staff member's file, nor shall they be made a matter of record. E. Teachers shall be responsible for supplying one (1) copy of all certificates/licenses held to the Board Office; such certificates/licenses are to be maintained in a valid condition by the staff member. F. The employee shall have the right, upon request, to review the contents of his/her personnel file and to receive one (1) copy at no cost of any documents contained therein. An employee shall be entitled to have a representative of the Association accompany him/her during such review. G. No derogatory material may be placed in an employee's personnel file unless the employee has had an opportunity to receive a copy of the material. Professional Personnel Records. The State Department of Education requires that certain personnel records be kept up to date and in a folder for reference at all times. These personnel records are to be filed in the central office of the school district. Materials placed in a member's personnel file shall be directly related to the member's assignment. In addition to being directly related to the member's assignment, materials shall be relevant, accurate, timely and complete. Members shall have the right to have access to their personnel file in the presence of the superintendent or designee. This access will ordinarily occur during the normal work day providing it does not interfere with the member's assigned duties and is reasonably possible within the member's schedule. A representative of the LHEA may, at the member's request, accompany the said member in such a review. If a conference is requested with an administrator regarding personnel files, twenty-four
Professional Personnel Records. Section 27.1 Personnel records of a teacher within the bargaining unit are to be filed in the local treasurer’s office, and are to be considered private to the fullest extent provided by law. At no time and under no circumstances shall a member of the administration, Board of Education, or secretarial staff voluntarily reveal and/or convey the contents of a teacher’s personnel file to any individual. Section 27.2 Any teacher shall have the opportunity, upon written request, to review his/her personnel file. A representative of the Association may, at the teacher’s request, accompany the said member in such a review. A teacher may acknowledge that he/she has read the material by affixing his/her signature to the copy. His/her signature shall not indicate agreement with the content of the material, but indicates only that the material has been inspected by the teacher. He/ She shall have the opportunity to reply to such critical material in a written statement to be attached to the filed copy. Section 27.3 Anonymous letters or materials shall not be placed in a teacher’s file until the author of such letter or material is verified and noted thereon. Section 27.4 Other than routine evaluations, each employee shall have the right to indicate those documents and/or other materials in his/her personnel file which he/she believes to be inappropriate. The employee shall have the right to request that the inappropriate materials be removed from the file and destroyed. Such request shall be reviewed by the Superintendent. Such material shall be removed if it pre-dates by more than one (1) year the date of issuance of such teacher’s current limited contract. If such teacher is on a continuing contract, such material shall be removed if it was filed more than three (3) years from the date of the request of removal. Section 27.5 A teacher may add material to his/her file upon request to the Superintendent that is relevant to his/her professional performance.
