PROTECTION OF EMPLOYEES, STUDENTS AND PROPERTY. The SPS shall make every reasonable effort to provide a safe and healthful environment for students and employees. Employees shall not be required to work under conditions known to be unsafe or hazardous or to perform tasks which endanger their health, safety, or well-being. The SPS will call upon other agencies such as the police, the courts and social services to help preserve the health and safety of all persons involved in a school situation. To attain these goals, the SPS agrees to the following provisions:
PROTECTION OF EMPLOYEES, STUDENTS AND PROPERTY. The SPS shall make every reasonable effort to provide a safe and healthful environment for students and employees. Employees shall not be required to work under conditions known to be unsafe or hazardous or to perform tasks which endanger their health, safety, or well-being. The SPS will call upon other agencies such as the police, the courts and social services to help preserve the health and safety of all persons involved in a school situation. To attain these goals, the SPS agrees to the following provisions: 1. Preservation of Order in the Schools: a. An employee is authorized to use force, but no more force than is necessary, upon or toward a student or other person on or around school premises whenever the employee is about to be injured, or when the employee lawfully comes to the aid of another about to be injured, or to prevent a malicious trespass, or other malicious interference with that real or personal property which lawfully is in the employees possession, in the possession of another employee or student, or upon school premises. b. The SPS shall give priority consideration to the utilization of appropriate security personnel at functions such as athletic events, school plays, concerts and other school functions, to maintain discipline and order.

The Board of Education shall carry an insurance policy to provide Worker's Compensation for any teacher who is injured while in the performance of his/her duties. B. The Board of Education shall carry liability insurance to protect all teachers in court suits arising out of the performance of office or duties. C. The Board shall endeavor to protect the teachers, students and property from physical injury and shall endeavor to do everything within its power and means to do so to assure safe conditions in the school district. D. In the event of litigation, civil or criminal, the Board will extend to its professionals all of the protections afforded by the Statutes of the State of New Jersey.
PROTECTION OF EMPLOYEES, STUDENTS AND PROPERTY. A. The Board shall continue to fulfill requirements placed upon it by law for the protection of employees, students and property. B. Pursuant to the Statutes of the State of New Jersey, Title 18A: 6-1, no person employed or engaged in a school or educational institution, whether public or private, shall inflict or cause to be inflicted corporal punishment upon a pupil attending such school or institution; but any such person may, within the scope of his employment, use and apply such amount of force as is reasonable and necessary: 1. To quell a disturbance threatening physical injury to others. 2. To obtain possession of weapons or other dangerous object upon the person or within the control of a pupil. 3. For the purpose of self defense. 4. For the protection of persons or property and such acts, or any of them, shall not be construed to constitute corporal punishment within the meaning and intent of this section. Every resolution by law, rule, ordinance, or other act or authority permitted or authorizing corporal punishment to be inflicted upon a pupil attending a school or educational institution shall be void. C. Pursuant to the Statutes of the State of New Jersey, Title 18A: 16-6, whenever any civil action has been or shall be brought against any person holding any office, position, or employment under the jurisdiction of any board of education, including any student teacher, for any act or omission arising out of and in the course of the performance of duties of such office, position, employment, or student teachers, the board shall defray all costs of defending such action including reasonable counsel fees and expenses, together with costs of appeal, if any, and shall save harmless and protect such persons from any financial loss resulting there from, and said board may arrange for and maintain appropriate insurance to cover all such damages, losses and expenses. D. Pursuant to the Statutes of the State of New Jersey, Title 18A: 16-6.1, should any criminal action be instituted against any such person for any such act or omission and should such proceeding be dismissed or result in a final disposition in favor of such person, the Board of Education shall reimburse him for the cost of defending such proceeding, including reasonable counsel fees and expenses of the original hearing or trial and all appeals. An employee may use reasonable force as is necessary to protect himself/herself from attack, to protect another person or property, to quell a disturbance or threatening physical injury to others, or to obtain possessions of weapons or other dangerous objects upon the person or within control of a pupil. C. Whenever any action is brought against an employee before the Board or before the Commissioner of Education of the State of New Jersey which may affect his/her employment or salary status, the Board of Education shall reimburse him/her the cost of his/her defense if the action is dismissed or results in a final decision in favor of the employee. D. 1. The Board shall give full support including legal and other assistance for any assault upon an employee while acting in the discharge of his/her duties.

In the event of any disorder or disruption in the regular school program, the Association shall have the right to meet with the Board before school reopens to develop mutually acceptable programs to guarantee the safety of students, employees and property. B. As specified in 18A:6.1, an employee may, within the scope of his/her employment, use and apply such amounts of force as is reasonable and necessary, to quell a disturbance threatening physical injury to others, to obtain possession of weapons or other dangerous objects upon the person or within the control of the pupil for the purpose of self-defense, and for the protection of persons or property. C. As required under Title 18 A, whenever any action is brought against a teacher before the Board or before the Commissioner of Education of the State of New Jersey which may affect his employment or salary status, the Board of Education shall reimburse him for the cost of his defense if the action is dismissed or results in a final decision in favor of the teacher.

The Association Building Representative shall report in writing to the Office of the Appropriate Principal with a copy to the President of the Ed Tech Association and Human Resources of any working conditions in any school building considered unsafe or hazardous. The Principal or their designated representative will investigate said report and the Principal shall furnish within ten (10) days a written report to the President, Association Representative, and Human Resources describing the results of the investigation and of any action taken or proposed to correct the condition. B. The Association and the Board are committed to the health and safety of all employees. Unsafe conditions and acts must be treated seriously and resolved with a sense of urgency. In order to address broad issues of concern regarding health and safety, the Superintendent or their designee will meet and consult with the Association and other groups to review relevant policies and procedures regarding health, safety, vandalism and student discipline. Employees will immediately report to the central offices of the Portland Public School System any instances of threat, assault, or injury suffered by an employee. Within twenty- four (24) hours the principal will notify the employee of actions taken and planning for next steps. Employees will be notified of final actions. C. If either civil or criminal litigation is indicated or threatened against any employee for actions arising out of and during the course of their employment, the employee shall immediately notify the Superintendent, who shall, comply with any reasonable requests from the employee for information in their possession which relates to the incident. X. Xxxxxxxxx who are eligible for worker’s compensation for service-related injury may elect to take accumulated sick leave in addition to compensation to the extent that it provides full regular pay, and to the extent of the accumulated sick leave credit. Full regular pay means the employee’s normal take-home pay after deduction of federal and state tax withholding. When an employee is absent due to injury and has applied for workers compensation, sick leave shall be used to the extent of the accumulated sick leave credit. When the employee begins receiving workers compensation pay, the employee will be re-credited with use of sick leave accumulation in relation to the amount of worker’s compensatory pay that they received.
