Protection of Work, Property and Persons. A. The Trade Contractor shall be responsible for initiating and maintaining all safety precautions and programs in connection with the work. Neither the Owner nor the Engineer will be responsible for Trade Contractor's means, methods, techniques, sequences or procedures of construction, or the safety precautions and programs incident thereto. The Trade Contractor shall take all necessary precautions for the safety of, and shall provide the necessary protection to prevent damage, injury or loss to all employees on the work who may be affected thereby, all the work and all materials or equipment to be incorporated therein, whether in storage on or off the site, and other property at the site or adjacent thereto, including trees, shrubs, lawns, walks, pavements, roadways, structures and utilities not designated for removal, relocation or replacement in the course of construction.
B. The Trade Contractor shall at all times consult with and obtain the approval of the Owner for the storage of material, operation of equipment, placing of temporary structures or dispositions of any surplus or waste materials upon property of the Owner anywhere outside the limits of construction. The Trade Contractor shall comply with all state, federal and local laws related to the storage or placement of any supplies, equipment, structures, or any other materials.
C. The Trade Contractor shall comply with all applicable laws, ordinances, rules, regulations and orders of any public body having jurisdiction. He shall erect and maintain, as required by the conditions and progress of the work, all necessary safeguards for safety and protection. He shall notify owners of adjacent utilities when prosecution of the work may affect them. The Trade Contractor shall remedy at his expense all damage, injury, or loss to any property or person caused, directly or indirectly, in whole or in part, by the Trade Contractor, any subcontractor or anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable, except damage or loss attributable to the fault of the contract documents or to the acts or omissions of the Owner or the Engineer or anyone employed by either of them or anyone for whose acts either of them may be liable, and not attributable, directly or indirectly, in whole or in part, to the fault or negligence of the Trade Contractor. 11.3 In emergencies affecting the safety of persons or the work or property at the site or adjacent thereto, the contractor, without special instruction or authorization from the engineer or owner, shall act to prevent threatened damage, injury or loss. He will give the engineer prompt written notice of any significant changes in the work or deviations from the contract documents caused hereby, and a change order shall thereupon be issued covering the changes and deviations involved.

The Consultant will take all necessary precautions for the safety of, and will provide the necessary protection to prevent damage, injury or loss to all employees providing work under this Agreement and other persons who may be affected thereby.

The Veterinarian will be responsible for initiating, maintaining and supervising all safety precautions and programs in connection with the services provided under this Agreement. The Veterinarian will take all necessary precautions for the safety of, and will provide the necessary protection to prevent damage, injury or loss to all employees providing work under this Agreement and other persons who may be affected thereby.

It is specifically understood and agreed that during the progress of the Work under this Contract, you shall take extreme precautions against the possibility of fire on our property and maintain adequate protection of the Work, adjacent property and the public, and you shall be responsible for any damage or injury due to your act or neglect. Any other provision in this Contract to the contrary notwithstanding, you hereby assume entire responsibility and liability for any and all damage or injury of any kind or nature whatsoever (including death or personal injury resulting therefrom) to all persons, whether your employees or otherwise, and to all property, caused by, resulting from or arising out of your negligence or that of your agents or employees.

He will take all necessary precautions for the safety of and will provide the necessary protection to prevent damage, injury or loss to all employees on the WORK and other persons who may be affected thereby, all the WORK and all materials or equipment to be incorporated therein, whether in storage on or off the site, and other property at the site or adjacent thereto.

The Contractor shall be solely responsible for initiating, maintaining and supervising all safety precautions and programs in connection with the performance of the Contract. The Contractor shall provide sufficient, safe and proper facilities and safeguards at all times for the prosecution of the Work and the inspection of the Work by the Owner and for the protection of the public from injury. The Contractor shall, on written notice from the Owner, remove all materials, whether worked or unworked, and all portions of the Work which Architect or the Owner shall determine to be unsound or unsatisfactory. The Contractor shall protect and care for his work from the time of delivery at the site until final acceptance of same by the Architect and the Owner. Any portion of the work liable to injury or soiling shall be carefully boxed or otherwise protected by the Contractor in a manner satisfactory to the Architect and the Owner, and, in like manner, he shall protect the Owner's property and the property of any other contractor having a separate agreement with the Owner from injury or loss arising in connection with the Contract. This protection shall be carefully maintained during the construction of the entire Work, and shall be removed from the premises when requested by the Architect or Owner. Should the Contractor fail to properly protect his Work, such protection may be installed by the Owner at the Contractor's expense. The Owner will not assume any responsibility for tools, materials or other property of the Contractor left on the premises.
