Purpose of the Funding Agreement. 1.1 THE EFA is an executive agency of the Department of Education, exercising powers on behalf of the Secretary of State and is acting on behalf of the Crown. Under the Education Xxx 0000, the Secretary of State may give or make arrangements for the giving of grants to any person for or in connection with the provision in the UK of education or of educational funding agreement activities. 1.2 The funding for the supply of these Activities in respect of High Needs Students by THE SPI is provided by both THE EFA and the commissioning local authority which is responsible for meeting the Student’s needs. THE EFA will fund THE SPI as follows: 1.2.1 for High Needs Students aged 16 to 18 and 19 to 25 where they are subject to a learning difficulty assessment or Education Health and Care Plan, THE EFA will pay THE SPI an amount, based on the published standard 16 to 19 funding formula (Element 1), and 1.2.2 a sum of £6,000 per annum, for each planned place declared by local authorities for High Needs Students (Additional Support Funding – Element 2). 1.3 Top-up funding (Element 3) is funding required by THE SPI above the 16 to 19 funding formula and additional support funding (Elements 1 and 2) to meet the total cost of education provision required by a High Needs Student as assessed by the commissioning local authority. This will be agreed and contracted directly between the commissioning local authority and THE SPI. 1.4 This Funding Agreement sets out the terms and conditions under which grant funding and annual allocation funding is provided to THE SPI by the EFA. This Funding Agreement is not a contract for services. The terms and conditions relating to annual allocation funding will be updated annually. The EFA has complete discretion in deciding the amount of funding that shall be paid in each funding year. In exercising this discretion the EFA shall consider all relevant factors, including but not limited to, the Activities of THE SPI in so far as they relate (in any way) to EFA funding and/or the EFA Conditions of Funding. 1.5 The Activities to be funded by THE EFA and delivered pursuant to this Funding Agreement will be core education and additional support, up to the cost indicated by the per place funding thresholds specified in clause 1.2.2 and an amount based on the published standard 16 to 19 funding formula (Elements 1 and 2), for all High Needs Students. Under the Education Act 2002, the Secretary of State may give or make arrangements for the giving of grants to any person for or in connection with the provision in the UK of education or of educational funding agreement activities. 1.2 The funding for the supply of these Activities in respect of High Needs Pupils and Students by THE NMSS is provided by both THE EFA and the local authority which is responsible for meeting the pupil and student’s needs. 1.3 For High Needs Pupils THE EFA will pay THE NMSS an amount equal to £10,000 per annum for each planned place it agrees THE NMSS will set aside for High Needs Pupils in the year. 1.4 Top-up funding (Element 3) is funding the local authority and THE NMSS agree is required above each planned place for pupils under the age of 16 and above the 16 to 19 funding formula and additional support funding (Elements 1 and 2) for students 16 to 19, to meet the total cost of education provision required by a High Needs Pupil and Student as assessed by the commissioning local authority.
