Random Drug and Alcohol Testing. The Union agrees to abide by the City policy regarding drugs and alcohol, including compliance with the mandatory random drug and alcohol testing for employees required to possess CDLs. The City agrees to reimburse the employee for the cost of the CDL endorsement, if the City requires the employee to have a CDL endorsement.
Random Drug and Alcohol Testing. The City shall randomly test employees in accordance with the policy attached as Exhibit 4.
Random Drug and Alcohol Testing. The Union recognizes that the Company is required by the laws of the United States to administer a program of random drug and alcohol testing for drivers who are required to operate in the United States. The Company agrees that random drug and alcohol testing will be limited to the group of drivers necessary to carry out the Company's operations in the United States and to those employees who have voluntarily submitted their names in writing to the Company in order to be eligible for work assignments that operate in the United States, therefore allowing themselves to be part of the random drug and alcohol pool. Upon confirmation that these drivers have been registered in the random drug and alcohol pool, the Company agrees to identify those employees’ names with the bargaining unit by way of a notation on the seniority list.
Random Drug and Alcohol Testing. Contractor shall conduct random testing for drug usage and alcohol consumption by offenders assessed with such risks. Said drug and alcohol testing component, at a minimum, shall include:
3.2.1.1.1 Urinalysis testing, in compliance with state and federal regulations and guidelines, together with appropriate procedures for: (a) confirming positive results; (b) ensuring chain of custody; and (c) addressing sanctions and treatment plan modifications based on test results
Random Drug and Alcohol Testing. One employee per quarter will be randomly selected for random drug and alcohol testing in accordance with AGP Policy 99.100.02.
Random Drug and Alcohol Testing. The Employer shall randomly test employees in accordance with the policy attached as Exhibit D.
Random Drug and Alcohol Testing. The Employer and the Union agree that safety is our first priority. As such, random drug and alcohol testing is important to ensure its workforce is safe, and proper deterrents are in place to help protect its employees and its Guests. Consequently, the Union agrees to include Stage Managers and Audio Mixers in a USH Random Drug and Alcohol Testing program. The program will begin on the same basis as the Employer begins random drug and alcohol testing with employees represented by LiUNA Local 724. Such program will begin no sooner than August 1, 2020. The Employer agrees to allow IBEW up to two (2) representatives to be invited to the discussions regarding the implementation of such program. The Stage Managers and Audio Mixers shall be included in the population of employees tested under the USH Random Drug and Alcohol program.
Random Drug and Alcohol Testing. In the interests of promoting the highest standards of workplace excellence and safety, the parties agree to adopt a random drug testing program. Employees shall be subject to random drug and alcohol testing in accordance with the protocol and procedures specified in 49 CFR Sec. 382.305. The program shall become effective at such time as the Employer implements a parallel program for non-represented employees.
Random Drug and Alcohol Testing. Random drug testing will be conducted in accordance with the Department of Transportation Rules and Regulations. In addition to those bargaining unit employees already subject to random drug and alcohol testing pursuant to the Rules and Regulations of the U.S. Department of Transportation, the City and the Union agree to expand random drug and alcohol testing to the entire bargaining unit. In exchange for the union’s agreement to expand random drug and alcohol testing to the entire bargaining unit, the Mayor agrees to be included in the random testing pool along with bargaining unit employees. A minimum of 25% of the bargaining unit will be subject to random drug and alcohol testing annually. The City will contract with a third party administrator and a medical review officer to administer its drug and alcohol testing program. The TPA’s rules and protocols will be shared with the union and employees before the program begins. Testing will occur throughout the year, and only during the work hours and on the work days of the employees. The TPA will determine the frequency of tests, as well as the dates and times of testing. The TPA will test for the presence of alcohol and those classes of drugs required by the Rules and Regulations of the U.S. Department of Transportation/Federal Motor Carrier Safety Administration at the levels prescribed by these regulations. 49 C.F.R. Parts 40 and 382. Any employee testing positive for alcohol or drugs pursuant to the definitions in Sections 3. H. and I. above, shall be subject to the remaining provisions of this Substance Abuse Policy, including the penalties for a positive alcohol or drug test as set-forth in Section 8 - Prohibitions.
Random Drug and Alcohol Testing. Random drug and alcohol tests will be unannounced and spread reasonably throughout the year with no more than twenty-five (25) employees tested annually. There will be no pattern to when random drug and alcohol tests will be conducted and all on duty employees have an equal chance of being selected for testing from the random pool each time random tests are conducted. Employees shall remain in the pool even after being selected and tested. Therefore, an employee may be selected for a random test more than once during a year. The Chief and a member of the union executive board shall verify that all on duty employees are in the pool for random testing. The process of selecting employees for testing will be performed by the Chief in the presence of a union executive board member. Employee numbers shall be placed in a container and drawn by the Chief. The random selection of an employee will not result in that employee’s name being removed from any future selection process. Any employee randomly selected for a drug and alcohol test will be ordered to report as soon as available during their current shift. When an employee is informed that they have been randomly selected to undergo a drug or alcohol test, such employee shall be entitled to Xxxxxxx advisements. Under this section, the consequences of a positive drug or alcohol test shall be discharge.
