RETURN FROM LEAVES OF ABSENCE. The Board of Education in granting a leave of absence indicates its intent to re-employ the educator at the end of the leave period. The educator must notify the Board of Education/Administration on or before March 1 of his/her intent to return to work. Failure to notify the Board of Education/Administration of such intent to return will result in termination of employment. Request to return from leave of absence granted for health reasons or temporary disability must be accompanied by a physician’s statement certifying the employee is ready to return to work.
1. Certified employees who are on leave for one (1) year or less shall be guaranteed their same position upon return provided the employee complies with all requirements of his/her re-employment and returns on the first day of the ensuing school year (subject to the exceptions below). Employees granted leaves of absence for health reasons may return during the school year to their same position (subject to the exceptions below).
2. If a position vacated by an employee during his/her leave of absence is eliminated due to curriculum, enrollment, funding or redistricting, the employee shall be guaranteed a position upon his/her return provided the employee meets the other requirements of this policy. Additionally, any position that is considered by the district to be a position that is difficult to fill may be filled during an employee’s leave of absence (subject to FMLA provisions), and the employee will be guaranteed a position upon his/ her return provided the employee meets the other requirements of this policy. The district will notify the employee of “difficult-to-fill” status before the position is filled, and the employee will be given an opportunity to rescind his/her leave request.
3. Certified employees returning from a leave at any time other than the first day of the ensuing school year shall be guaranteed a position provided the employee complies with all requirements of his/her reemployment.
RETURN FROM LEAVES OF ABSENCE. An employee absent on authorized leave of absence may return to work prior to expiration of the period of authorized leave upon receiving permission thereto from the District. However, employees are responsible for reporting to work promptly following the last day of said official leave of absence.

RETURN FROM LEAVES OF ABSENCE. (A) A bargaining unit member may return to work prior to the expiration of any unpaid leave of absence provided reasonable notice is given by the member, in writing, stating the date, time and place for the member to return. The right to return to work earlier than scheduled is subject to the availability of work in the member's position classification.
RETURN FROM LEAVES OF ABSENCE. All teachers on an unpaid leave of absence must give written notice to the director of human resources by March 15th of the year the leave expires of the teacher’s intention to return, request an extension, or resign. Failure to furnish such notice may, at the discretion of the Board, lead to dismissal proceedings in accordance with the Tenure Act.
RETURN FROM LEAVES OF ABSENCE. When returning from an approved leave of absence, a member is entitled to assume the same position (subject, grade level and building) as held prior to the leave if said position remains in the Board program. For the purposes of this article, said position shall be determined not to exist if the number of positions is reduced due to a decline in enrollment and/or the elimination of a program/course.
RETURN FROM LEAVES OF ABSENCE. 19.13.1 Return from Leave of Absence, Ten Weeks or Less
RETURN FROM LEAVES OF ABSENCE. Teachers who are on an extended leave of absence (one semester, one semester extended to a second semester, or one year) which will last through the end of the school year must inform the District in writing no later than April 1 of their intention to return from leave for the coming school year. Failure to do so by April 1 of that year constitutes the immediate and permanent resignation of that teacher.
RETURN FROM LEAVES OF ABSENCE. 15.07.01 An employee returning from any leave of absence will be returned to the permanent job they had at the time the leave commenced, subject to Articles 13 or 14.
15.07.02 Both parties to the Agreement recognize that excessive employee absenteeism is detrimental to the operation and can negatively impact other employees. As a result, work time missed due to personal illness or injury, which would qualify as emergency leave under the provisions of the Employment Standards Act will all be offset from the annual emergency leave allowance provided to each employee, under the Employment Standards Act.
RETURN FROM LEAVES OF ABSENCE. A. Health Related: Employees shall be returned to employment following an Employer approved medical leave of absence which shall be for a maximum of six (6) months. Employees shall be returned to their original position held prior to the approved medical leave of absence.
B. Non-Health Related Leaves of Absence: Employees off on a leave of absence must return to work on a prearranged date. When an employee is reinstated to his/her previous position or job classification, he/she shall receive a rate of pay not less than his/her previous position. Employees who return from a non-health related leave of absence will be placed into their previous position if vacant. If a vacancy does not exist then the employee shall be placed in the next available vacant and open position to which the employee’s seniority and qualifications entitle them. The regular bidding process will be bypassed. This placement will not be subject to the grievance procedure. If an opening is unavailable on the date upon which the employee is due back he/she will have rights to any open positions for which he/she qualifies for the following 3 month period. Should the employee be unable to secure an open position within the three month period of their leave end date, they will lose seniority rights.
C. Employees absent on a pre-approved unpaid leave of absence lasting less than two weeks will be placed into their position upon successful return.
D. The Employer may require a physical and/or psychological exam by a physician or psychologist, at the Employer’s expense, to determine the employee’s ability to perform his/her regular duties if the Employer has a reasonable basis to question the ability. The employee may obtain a second opinion, at the employee’s expense, and in the event that there is a dispute between the Employer’s physician and employee’s physician, both of these physicians shall select a third physician whose decision shall be final and binding on the parties. The expense of the third physician’s opinion shall be split 50/50 by the Employer and the employee, if not covered by the employee’s insurance.
