Right to Fair Share Fee a. Payroll Deduction of Fair Share Fee The Board shall deduct from the pay of members who elect not to become or to remain members of the Association, a Fair Share Fee for the Association’s representation of such nonmembers during the term of this Agreement. No nonmember filing a timely demand shall be required to subsidize partisan political or ideological causes not germane to the Association’s work in the realm of collective bargaining.
b. Notification of the Amount of Fair Share Fee Notice of the amount of the annual Fair Share Fee, which shall not be more than one hundred percent (100%) of the unified dues of the Association, shall be transmitted by the Association to the Board Treasurer on or about January 15 of each year during the term of this Agreement for the purpose of determining amounts to be payroll deducted, and the Board agrees to promptly transmit all amounts deducted to the Association.
c. Schedule of Fair Share Fee Deductions
1) Payroll deduction of such annual Fair Share Fees shall begin at the first pay date of February except that no Fair Share Fee deductions shall be made for members employed after January 1 until the second paycheck, which period shall be the required probationary period of newly employed members.
2) Upon termination of membership during the membership year, the Board Treasurer shall, upon notification from the Association that a member has terminated membership, commence the deduction of the Fair Share Fee with respect to the former member, and the amount of the fee yet to be deducted shall be the annual Fair Share Fee less the amount previously paid through payroll deduction.

No non-member filing a timely demand shall be required to subsidize partisan political or ideological causes not germane to the Association's work in the realm of collective bargaining.

Notification of the Amount of Fair Share Fee Notice of the amount of the annual fair share fee, which shall not be more than 100 percent of the unified dues of the Association, shall be transmitted by the Association to the treasurer of the Board on or about September 15 of each year during the term of this contract for the purpose of determining amounts to be payroll-deducted, and the Board agrees to promptly transmit all amounts deducted to the Association.
Right to Fair Share Fee. 1. It shall be a continuing condition of employment with the Board that all employees having completed 30 days in active employment status and covered by this Master Contract shall:
i. Become and remain members of the Union in good standing to the extent of paying the uniform local, state and national Union membership dues, initiation or reinstatement fees; or,
ii. Tender an agency fee to the Union in the amount equal to the monthly membership’s dues of local, state and national OAPSE members, but shall not be subject to initiation fees, special assessments or reinstatements fees.
2. The Board agrees to deduct, in equal installments from the first employee paycheck of the month, dues or where applicable, a service fee, for the American Federation of State, County and Municipal Employees/AFL-CIO, their state affiliate Union, the Ohio Association of Public School Employees and their local affiliate, Local #238. Monies so deducted and a list of affected employees shall be mailed to the Treasurer of the Ohio Association of Public School Employees state organization within 10 days of the deduction.
3. By July 1 of each year, the Board shall supply to the OAPSE State Treasurer notice of the annual salary for each member of the Union. The OAPSE State Treasurer shall notify the Board of the amount to be deducted for state and national dues and service fees by August 30. If no notification is received by the Board, the amount deducted shall be the same as that of the preceding year.
4. It shall be the responsibility of the Union to prescribe an internal procedure to determine a rebate for non-Union employees which complies with federal law and the provisions of ORC §4117.09(C).
5. An employee may withdraw from membership in the state and national Union each year during the period from August 22 through August 31 by providing written notification received within the time limits to the OAPSE State Office. Should an employee withdraw during this period, the Treasurer shall deduct the fair share fee in accordance with §§1[a][ii] and [b] of this section.

Right to Fair Share Fee. All of the provisions of Section Q Right to Fair Share Fee of Article 5 of this Agreement, shall be suspended until such time as a court of competent jurisdiction or legislative body makes these provisions legal again.

Notification of the Amount of Fair Share Fee Notice of the amount of the annual fair share fee, which shall not be more than 100 percent of the unified dues of the Association, shall be transmitted by the Association to the Treasurer of the Board by September 15 of each year during the term of this contract for the purpose of determining amounts to be payroll- deducted, and the Board agrees to promptly transmit all amounts deducted to the Association.
3. Schedule of Fair Share Fee Deductions
a. All Fair Share Fee Payors Payroll deduction of such fair share fees shall begin at the second payroll period in January except no fair share fee deductions shall be made for newly employed bargaining unit members until after sixty (60) days, which period shall be the required probationary period of newly-employed bargaining unit members.
b. The deduction of the fair share fee by the treasurer of the Board from the payroll check of the employee and its payment to the Association after the grace period, shall be automatic and does not require the written authorization of the teacher. The fee deductions shall be made on the same payroll days that Association dues are deducted. The obligation of the Board to deduct the fee shall cease upon the removal of the bargaining unit member from the Board’s active payroll for any reason. Teachers hired after the beginning of the school year shall be obligated for a pro rate portion of the “fair share fees” after the grace period. Such fee shall be deducted from the remaining paychecks which are subject to payroll deduction for dues and fees, to the extent funds are available in such paycheck(s).
