ROLES AND RESPONSIBILITIES UNDER THIS AGREEMENT. 7.1 Signatories are responsible for ensuring that adequate resources are available within their respective organisations to fulfill the commitments made to the other partners under this agreement. 7.1.1 Signatories must bear in mind that information sharing about individuals will most frequently be subject to legal constraints based on the rights of the individual, and that where information sharing is founded on the voluntary capacity of that person to have their information shared, there is a strong ethical consideration to ensure that the wishes of that individual are respected. Whilst it is outside the scope of this document to prescribe what levels of training and expertise may be required within each organisation, the signatories must ensure that such ethical considerations (as they may each interpret them) are understood and fulfilled by all personnel authorised to be involved in sharing of personal information with other organisations. 7.1.2 This includes ensuring that all personnel and staff who may be involved in sharing information under this ISA are suitably trained and qualified with regard to its requirements, and that sufficient staff resources are in place to cover absences and leave. 7.2 In order that the most appropriate resources within the partner organisations can be brought together as quickly as possible, each signatory will identify one or more individual role-holders to be primary ‘Points of Contact’ (PoC’s) for information sharing under this agreement within their respective organisations. 7.3 The nominated role-holders appointed to act as PoC’s for each organisation will be listed alongside the signatory details in Section 12.6 below. However, the partners agree that although PoC role-holders must be listed, for security reasons their respective contact details will be attached as a separate Appendix (Appendix ‘B’) to this document, to be exchanged privately between the organisations concerned, and not published as part of this agreement. 7.4 The chief responsibility of each PoC will be to ensure that there is no barrier to information sharing, those directly involved in a case are fully and properly informed of any relevant information shared by another partner, and so are as fully equipped as possible to support and protect the interests and welfare of the individuals under their care. 7.4.1 The PoC’s must also ensure that shared information disseminated to those involved in a given case is only used for the purposes for which ...

The sharing of information must only take place where it is valid and legally justified. 7.2 All partners signed up to this agreement are both receivers and disclosers of information. For the purposes of this agreement each partner will be data controllers in common - sharing a pool of personal data, disclosing data to each other but with each processing the data independently of the others. 7.3 Each Partner maintains responsibility for Freedom of Information Requests and Subject Access Requests.

The “SPOC” will also be responsible for any reviews or amendments to the Agreement. The “SPOC” for each partner should also be notified of any breach or dispute and will be responsible for obtaining authorisation to disclose any information to a third party. SPOC’s should maintain regular contact with each other and ensure that appropriate audit trails of sharing are retained and made available when required. Any changes in SPOC will be notified in writing as soon as practicable and in any event within 5 working days after such a change has occurred. The SPOCs are: Norfolk County Council Children’s Services Only appropriate and properly authorised persons will have access to the information specified in this Agreement. If in doubt, a person intending to share or access information should contact their SPOC or Data Protection /Information Management Team. All Parties must be fully aware of their obligations under the GDPR and DPA 2018 and must have the appropriate training, policies and procedures in place to ensure compliance. It will be the responsibility of all partners to ensure that: • Realistic expectations prevail from the outset • Ethical standards are maintained • A mechanism exists by which the flow of information can be controlled • A mechanism exists by which the integrity of the data is upheld • Appropriate training with regard to both this agreement and the GDPR and DPA 2018 in general is given to all relevant staff • Adequate arrangements exist to audit adherence to the Agreement • The sharing is covered under each party’s privacy information notice The Parties are aware that the deliberate or reckless disclosure of personal data (obtained under this Agreement) to other organisations or persons may amount to a criminal offence under the DPA. ROLES AND RESPONSIBILITIES UNDER THIS AGREEMENT. 5.4.1 Each partner must appoint a named single point of contact (SPoC) who must work together to jointly solve problems relating to this agreement. 5.4.2 All Police Officers or Police staff who are responsible for the specific task of the effective exchange of information and will be required to comply with current Data Protection legislation. The sharing of information must only take place where it is valid and legally justified 5.4.3 It will be the responsibility of the designated Police Officer or Police staff to disclose only relevant and appropriate information and will be accountable for that disclosure. 5.4.4 The designated Police Officer or Police staff member must ensure that the request meets a policing purpose. Where the information refers to a victim or witness, their written consent must be obtained. 5.4.5 SPoCs must meet regularly to discuss and prioritise incidents of criminal or anti-social behaviour. It must include copies of the request for information, details of the data accessed and notes of any meeting, correspondence or phone calls relating to the request. Access and use will be monitored using both system audit trails and formal auditing procedures. 5.4.8 All non police employees must sign the Official Secrets Act prior to undertaking work that involves regular access to the information being shared. 5.4.9 A Memorandum of Understanding will be drawn up for each agency requiring access. The procedure to follow is detailed in the Information System Access Policy. This will be personal to the agency and will be drafted at a local level. It will outline specifically what information they will use and in what circumstances. This will be subject to annual reviews.

If there is a problem such as a potential information security breach, relevant SPOCs must be contacted. 5.9.3 It is the responsibility of everyone sharing information and accessing and using the information that has been shared to take appropriate decisions, then hold the information securely, in accordance with the standards set out in the overall Framework and this agreement. Any person who is not sure of the requirements on them should read this this Agreement, then, if necessary, contact their SPOC. 5.9.4 Only appropriate and properly authorised persons will have access to the information specified in this Agreement. If in doubt, a person intending to share or access information should contact their SPOC.

If there is a problem such as a potential data breach, relevant SPOCs must be contacted (and in the case of a potential data breach the System & Information Management Officer of the Council). 5.1.5 Only appropriate and properly authorised persons will have access to the information specified in this Agreement.
