Seniority Loss. An employee's seniority shall be lost and his/her employment shall be terminated upon the occurrence of any of the following:
a. He/she quits or retires and does not rescind such action within five (5) calendar days;
b. He/she is discharged and the discharge is not reversed;
c. He/she has been laid off and not actively working for the Employer for a period of three (3) years.
Seniority Loss. An employee will lose seniority and all re- employment rights by (a) resignation; (b) discharge, unless vacated by a valid arbitration award either accepted by the University or judicially confirmed; (c) continuous layoff for a period longer than his/her seniority, or two (2) years, whichever is the lesser; (d) absence for three (3) consecutive scheduled work days without notifying the University in advance or without providing a reasonable and valid excuse; (e) failure to report for work on schedule from a vacation, leave of absence, or disciplinary suspension without notifying the University in advance or without providing a reasonable and valid excuse; (f) failure to return to work from layoff on the date ordered which shall not be earlier than ten (10) days after delivery or attempted delivery of a recall notice from the University; (g) two (2) year absence for illness or disability (however, return to work after a disability leave exceeding 130 working days shall depend upon the availability of a position); and (h) subject to Federal law, voluntary extension of military service.
Seniority Loss. An employee shall lose all seniority if any of the following events occur:
a. Voluntary resignation or retirement;
b. Discharge of a regular employee for just cause or discharge of a probationary employee at will;
c. Layoff of more than twelve (12) months’ duration pursuant to Section 8 of this Article;
d. Failure to notify the County of intent to return to work pursuant to a written recall notice pursuant to Section 8 of this Article, sent by certified mail, return receipt requested, to the last address provided to the County through personnel records within ten (10) days of receipt or ten (10) days of delivery, whichever is later;
e. Failure to report for work immediately upon expiration of an authorized leave of absence or, in the case of an absence due to off or on-the-job injury or illness, failure to report for available work within seven (7) days of receipt of notice of a limited or a full medical release to return to work.

a) Voluntarily quitting.
Seniority Loss. A member shall forfeit all accrued seniority and, if reemployed subsequently, have only the status of a new member, under any of the following conditions:
a. When the member resigns from employment with the District, or
b. When the member is discharged or resigns in lieu of dismissal, or
c. When the member retires, or
d. When the member fails to return to work at the expiration of an authorized leave of absence.
Seniority Loss. An employee shall lose all seniority if any of the following events occur:

Seniority Loss. Any employee will lose seniority by discharge, by failure, without a reasonable and valid excuse, to return to work within ten working days of recall, following any authorized absence, or by transfer to a position not covered by this Agreement for a period of three months. No employee will lose seniority when utilizing any provision of the Civil Service Law pertaining to leaves, paid or unpaid and who returns to work in the specified time period.
