SERVICES OF LANDLORD. A. During the Term, Landlord shall furnish Tenant with the following services: (a) hot and cold water in Building Standard bathrooms and chilled water in Building Standard drinking fountains; (b) electrical power sufficient for lighting the Premises and for the operation therein of typewriters, voicewriters, calculating machines, word processing equipment, photographic reproduction equipment, copying machines, personal computers and similar items of business equipment which consume, in the aggregate, less than five (5) wxxxx per square foot of Net Rentable Area of the Premises and require a voltage of 120 volts single phase or less, (c) heating, ventilating or air-conditioning, as appropriate, during Business Hours at such temperatures and in such amounts as customarily and seasonally provided to tenants occupying comparable space in office buildings in the Atlanta, Georgia suburban area; (d) electric lighting for the Common Areas of the Project; (e) elevator service (if the Building has elevators), in common with others, for access to and from the Premises twenty-four (24) hours per day, seven (7) days per week; provided, however, that Landlord shall have the right to limit the number of (but not cease to operate all) elevators to be operated after Business Hours and on Saturdays, Sundays and Holidays; (f) janitorial cleaning services; (g) facilities for Tenant’s loading, unloading, delivery and pick-up activities, including access thereto during Business Hours, subject to the Rules and Regulations, the type of facilities, and other limitations of such loading facilities; and (h) replacement, as necessary, of all Building Standard lamps and ballasts in Building Standard light fixtures within the Premises. All services referred to in this Section 7.1A shall be provided by Landlord and paid for by Tenant as part of Tenant’s Operating Costs Payment.
B. If Tenant requires air-conditioning, heating or other services, including cleaning services, routinely supplied by Landlord for hours or days in addition to the hours and days specified in Section 7.xX, Landlord shall make reasonable efforts to provide such additional service after reasonable prior written request therefore from Tenant, and Tenant shall reimburse Landlord for the cost of such additional service; provided however, that, if any other tenants in the Building served by the equipment providing such additional service to the Premises request that Landlord concurrently provide such service to such ot...
SERVICES OF LANDLORD. III.1.1 Landlord shall maintain the public and common areas of the Building, including lobbies, stairs, elevators, corridors and restrooms, the windows in the Building, the mechanical, plumbing and electrical equipment serving the Building, and the roof (subject to Tenant's obligations under Exhibit H hereto) and structure itself in reasonably good order and condition except for damage occasioned by the act of Tenant, which damage shall be repaired by Landlord at Tenant's expense.
III.1.2 Landlord shall furnish the Premises with (a) elevator service, if applicable, and (b) window washing with reasonable frequency. Landlord shall not be in default hereunder or be liable for any damages directly or indirectly resulting from, nor shall the rental herein reserved be abated by reason of (i) the installation, use or interruption of use of any equipment in connection with the furnishing of any of the foregoing services, unless caused by Landlord's gross negligence or willful misconduct, (ii) failure to furnish or delay in furnishing any such services when such failure or delay is caused by accident or any condition beyond the reasonable control of Landlord or by the making of necessary repairs or improvements to the Premises or to the Building, or other cause other than Landlord's gross negligence or willful malfeasance, (iii) the limitation, curtailment, rationing or restrictions on use of water, electricity (for common areas only), gas or any other form of energy serving the Premises or the Building, unless caused by Landlord's gross negligence or willful misconduct, and (iv) if Landlord and Tenant have entered into an agreement whereby Tenant uses Landlord's Backup Generator, the failure of such Backup Generator to perform as specified except due to the gross negligence or willful misconduct of Landlord. Landlord shall use reasonable efforts diligently to remedy any interruption in the furnishing of such services. In the event any such interruption continues for more than ten (10) Business Days, Tenant may xxxxx Rent by 10% of the monthly Rent for each subsequent Business Day thereafter that such services are interrupted
SERVICES OF LANDLORD. Landlord shall furnish reasonably adequate electric current, water and lavatory supplies during normal business hours, and normal and usual cleaning and janitorial service after business hours. Landlord further agrees to furnish elevator services and heat and air conditioning in judgment sufficient to reasonably cool or heat the Demised Premises from 8:00 a.m. to 6:00 p.m., Mondays through Fridays inclusive; and from 9:00 a.m. to ??:00 p.m. Saturdays (said services not being furnished on Sundays or legal holidays as observed by the Landlord), provided, however, that Landlord shall not be liable for failure to furnish or for suspension in delay in furnishing such services due to breakdown, maintenance, or repair work, strike, riot, civil commotion, governmental action or any other cause beyond the reasonable control of Landlord.
SERVICES OF LANDLORD. (a) The normal business hours of the Building shall be from 8:00 AM to 6:00 PM on Monday through Friday, and 8:00 AM to 1:00 PM on Saturday, exclusive of national holidays. Landlord shall furnish the following services during normal business hours of the Building except as noted:
(i) Elevator service for passenger and delivery needs.
(ii) Heat and air conditioning at a temperature of approximately 72 to 76 degrees Fahrenheit, using Landlord's commercially reasonable efforts and subject to governmental regulations, Building rules and regulations and routine repair, maintenance and replacement.
(iii) Cold running water for all restrooms and lavatories.
(iv) Soap, paper towels, and toilet tissue for public restrooms.
(v) Janitorial service, which includes sanitizing, dusting, cleaning, mopping, vacuuming and removal of trash not requiring special handling, five days a week.
(vi) Electrical and mechanical maintenance services are provided five days a week.
(vii) Electric power, for small desk top types of machines, or hand held devices, such as typewriters, adding machines and recording machines.
(viii) Electric lighting, at a level of at least 80 foot candles at desk height except in corridor or storage areas, and including the replacement of Building standard lamps and ballasts as needed.
(ix) Repairs and maintenance as described in Section 10 of this Lease.
(x) General management, including supervision, inspections, record keeping, accounting, leasing and related management functions.
(b) The services provided in subparagraph (a) above, and the amount of Rent prescribed herein, are predicted on and are in anticipation of certain factors as follows:
(i) Air conditioning design is based on sustained outside temperatures being no higher than 92 degrees Fahrenheit and no lower than 22 degrees Fahrenheit with sustained occupancy of the Premises by no more than one person per 000 xxxxxx xxxx xx xxxxx xxxx and electric power for lighting and outlets not in excess of a total of 4 xxxxx per rentable square foot of the Premises at 100% connected load.
(ii) Tenant shall have no right to any services in excess of those provided herein. SERVICES OF LANDLORD. The Landlord shall provide, at the Landlord's expense except as otherwise provided, the following services:
a. Janitorial service in and about the Premises, Saturdays, Sundays and holidays excepted.
b. Heat and air-conditioning, daily from 8:00 a.m. to 6:00 p.m., and 8:00 a.m. to 1:00 p.m. on Saturdays (if not a holiday), Sundays and holidays excepted, sufficient to maintain comfortable temperature on the basis of one person per 100 square feet of space reasonably subdivided. This paragraph shall conform to any government regulations preserving limitations thereon and such conformity shall be deemed to satisfy this Landlord obligation. Whenever heat generating machines or equipment which affect the temperature otherwise maintained by the air-conditioning system are used in the Premises, Landlord reserves the right, at its option, either to require Tenant to discontinue the use of such heat generating machines or equipment or to install supplementary air-conditioning equipment in the Premises. The cost of such installation shall be paid by Tenant to Landlord promptly on being billed therefor, and the cost of operation and maintenance of said supplementary equipment shall be paid by Tenant to Landlord promptly on the monthly rent payment dates at such rates as may be agreed on, but in no event at a rate less than Landlord's actual cost therefor of labor, materials and utilities.
c. Water for drinking, lavatory and toilet purposes.
d. Passenger elevator service at all times. Any or all elevator service may be automatic.
e. Window washing of all exterior windows, both inside and out, weather permitting.
f. Provision, installation and replacement of ballasts and tubes for lighting purposes.
g. Removal of ice and snow from walks, drives and parking facilities.
h. Electricity typically provided in general office space, specifically excluding any extraordinary requirements of the Tenant. If Tenant shall require electric current in excess of that usually furnished or supplied for use of the Premises as general office space, Tenant shall first procure the consent of Landlord, (which Landlord may refuse in its sole discretion), to the use thereof. Landlord may cause an electric check meter to be installed in the Premises. Landlord shall also have the right to cause a reputable independent electrical engineering or consulting firm to survey and determine the value of the electric service furnished for such excess electric current. SERVICES OF LANDLORD. (b) Landlord shall furnish the Premises with (1) electricity for lighting and the operation of office machines, (2) heat and air conditioning to the extent reasonably required for the comfortable occupancy by Tenant in its use of the Premises during the period from 8:00 a.m. to 6:00 p.m. on weekdays and from 8:30 a.m. to 1:00 p.m. on Saturdays, except for holidays declared by the Federal government, or such shorter period as may be prescribed by any applicable policies or regulations adopted by any utility or governmental agency, (3) elevator service, if applicable, (4) lighting replacement (for building standard lights), (5) restroom supplies, (6) window washing with reasonable frequency, (7) and daily janitor service five (5) days a week during the times and in the manner that such services are customarily furnished in comparable office buildings in the area. Landlord shall not be in default hereunder or be liable for any damages directly or indirectly resulting from, nor shall the rental herein reserved be abated by reason of (i) the installation, use or interruption of use of any equipment in connection with the furnishing of any of the foregoing services (ii) failure to furnish or delay in furnishing any such services when such failure or delay is caused by accident or any condition beyond the reasonable control of Landlord or by the making of necessary repairs or improvements to the Premises or to the Building, or (iii) the limitation, curtailment, rationing or restrictions on use of water, electricity, gas cir any other form of energy serving the Premises or the Building. SERVICES OF LANDLORD. Section 7.1 A. During the Term, on each Business Day (as defined in Article 27), Landlord shall furnish Tenant with the following services: (a) hot and cold water in Building Standard bathrooms and drinking water; (b) permit Tenant to use Central systems, such as then existing feeders and risers, to obtain electrical power from the utility supplier sufficient for lighting the Premises and for the operation therein of equipment which consume a reasonable amount of xxxxx per square foot of Rentable Area of the Premises; (c) heating, ventilating or air-conditioning, as appropriate, to the Premises and the Common Areas of the Project, during Business Hours; (d) electric lighting for the Common Areas; (e) facilities for Tenant’s loading, unloading, delivery and pick-up activities, including access thereto during Business Hours, subject to the Rules and Regulations, the type of facilities, and other limitations of such loading facilities; and (f) All services referred to in this Section 7.1A shall be provided by Landlord and paid for by Tenant as part of Tenant’s Operating Costs Payment. At no time shall use of electricity in the Premises exceed the capacity of existing feeders and risers to or wiring in the Premises. Any risers or wiring to meet Tenant’s reasonable excess electrical requirements shall, upon Tenant’s written request, be installed by Landlord, at Tenant’s sole cost, if, in Landlord’s reasonable judgment, the same are necessary and shall not (i) cause permanent damage or injury to the Project, the Building or the Premises, (ii) cause or create a dangerous or hazardous condition, (iii) entail excessive or unreasonable alterations, repairs or expenses or (iv) interfere with or disturb other tenants or occupants of the Building.
SERVICES OF LANDLORD. In addition to the services set forth in Article 7 of the Lease, Landlord agrees to clean the exterior of the windows of the Premises not less often than annually during the Term of this Lease.
