Teacher-Initiated Transfers. Any teacher employed by USD 469 who is licensed for and makes a written request (within five (5) school days of posting) to the building administrator to transfer to a vacant position within the district will be considered. The administrator will discuss the viability for the position with the employee and provide written confirmation of the discussion. Any employee who transfers to an administrative or supervisory position, and who later returns to former status, shall be entitled to retain such rights as may have been accrued under this Agreement prior to such transfer. This provision should not be construed to create any right on the part of the employee to return to his or her former status.
Teacher-Initiated Transfers. A. All bargaining unit positions that the Board decides to fill shall be posted on the District’s website for a period of five (5) calendar days (excluding weekends and holidays). The Board will also simultaneously send an email to all bargaining unit members informing them of the posting. If the Board elects not to fill a position, it shall notify the Association President within thirty (30) days of the vacancy occurring.
B. Vacancies will be filled on the basis of certification/licensure and qualifications. The Board will interview all internal applicants for a vacancy and will notify unsuccessful internal candidates why they were not selected for a specific vacancy.
C. During the summer, the Board will send an electronic alert/notice to all bargaining unit members when it posts vacant bargaining unit positions on the District’s web site.
Teacher-Initiated Transfers. 10.1.1 Teachers may initiate transfer requests at any time on the “Teacher Transfer Questionnaire” submitted to their supervisor or directly to the Human Resources Department. The teacher should, but need not, discuss his/her interest in a transfer with his/her supervisor. Transfer requests for the subsequent year must be submitted by February 15. The District will make every effort to distribute teacher request forms (“Teacher Transfer Questionnaire”) approximately at least two (2) weeks prior to February 15. An active list of persons requesting transfers will be maintained by the Superintendent or designee.
10.1.2 In the event a principal assignment is made following the February 15 deadline for teacher transfers, the teachers at the school affected shall be given a two (2) week period after the assignment in which to initiate a transfer.
10.1.3 The Superintendent or designee will evaluate the “Teacher Transfer Questionnaire”, consider the needs of the District and also the following in granting/rejecting transfer requests, in no particular order:

Teacher-Initiated Transfers. (a) The Board and the Union endorse the concept that voluntary transfers are one method by which teachers experience professional growth.
(b) Following the placement of teachers who in the previous school year have been moved pursuant to Article 25.03(a) and have been offered a vacant or unfilled position at his/her original school and the placement of surplus teachers pursuant to Article 26.05 (c), the Director of Human Resources will cause to be posted in each school and provide to the Chairs of the Regional Economic Welfare Committee and the South Shore Regional Representative Council and the Presidents of the NSTU Locals a list of all positions which remain vacant and are therefore available for transfer of permanent contract teachers.
(c) Permanent contract teachers may apply for such posted vacant positions. In filling vacant positions, the candidates shall compete on the following criteria: qualifications, abilities and experience, and the Board shall determine the weight to be given to each of the criteria. When qualifications, abilities, and experience are relatively equal, seniority shall be the determining factor.
(d) A teacher who is successful in attaining a transfer to a different vacant position is not eligible for further participation in the teacher transfer process. Said teacher must agree to remain in the position to which he/she has been transferred for a minimum period of the entire ensuing school year.
(e) Except where waived by the Board because of a legitimate change in personal circumstances, a teacher requesting a transfer(s) is only entitled to refuse offers of transfer in the first round, before being ineligible to participate any further in the teacher transfer process for the school year under consideration.
(f) There shall be no fewer than two (2) nor more than three (3) rounds of transfer before June 15th in each school year.
Teacher-Initiated Transfers. Teachers who desire a change in grade and/or subject assignment or who desire to transfer to another building, may file a written statement of such desire with the Superintendent and/or building principal, indicating their preference of assignments. In the determination of requests for voluntary reassignment, the wishes of the individual teachers shall be considered. If the request is denied, the teacher will receive the reasons, in writing, if the teacher makes a written request for such reason(s).

Applications for transfer must be renewed annually. If a vacancy becomes available for which a person is certified and has requested transfer, such person will

Teachers wishing to transfer shall send, using the current transfer form, a request to the office of the Superintendent or designee and a copy to the CPEA President indicating the reason for transfer and listing building, subject and grade preferences. Letters may be used to apply for specific openings that are announced.
b. Bargaining unit members who have applied for a transfer from the same building two (2) years in a row and have been denied the transfer, will be given a teacher initiated transfer to an existing vacancy in the third year, or thereafter if no vacancy is available, assuming the teacher possesses proper licensure for the position.
c. In exceptional circumstances where a transfer has not been carried out after the third year, the Association President and the Superintendent shall confer to attempt a workable solution.
Teacher-Initiated Transfers. 1. The Union and the Employer endorse the concept that voluntary transfers are one method by which teachers experience professional growth.
2. Teachers may apply for transfer to any vacant position advertised in a position vacancy notice at the time it is posted. Alternately, teachers may apply for a general transfer by request in writing to the Superintendent by March 31. The Employer agrees to inform teachers of deadlines in this clause by March 1 of each school year by written notice posted on staff bulletin boards. In unanticipated circumstances, transfer requests will be received at other times in the school year.
3. The filling of vacancies pursuant to this article shall proceed in accordance with Section E.21 of this Agreement.
4. As many transfers as possible shall be finalized prior to June 15 of the school year.
5. If the request for transfer is fulfilled, the teacher shall be notified in writing as soon as possible.
6. Teachers with unmet transfer requests will be advised in writing and may, within seven days (7) of notification, request a meeting with the Superintendent or designate to discuss the reasons for the denial of the transfer. The teacher may be accompanied at such meeting by a member of the Union.
