Testing and Capacity Ratings. 7.1 Testing of the Facility Prior to the Commercial Operations Date
Testing and Capacity Ratings. 12.1 Operator represents that the Estimated Dependable Capacity for the Facility is 413 MW.
12.2 The Dependable Capacity for the Facility shall be determined by testing described in this Article 12. Operator shall give PREPA at least seven (7) Days notice as to when the Facility will be tested. Operator shall perform the test according to Exhibit G and PREPA shall have the right to monitor the test.
12.3 If the test is completed successfully according to Exhibit G, Operator shall set the Dependable Capacity within plus or minus ten percent (±10%) of the Estimated Dependable Capacity as specified in Section 12.1.
12.4 The Operator may request additional tests described herein if Operator is not satisfied with the test and has not set the Dependable Capacity. Requests for additional tests can be made only after five (5) Days have expired since the termination of the most recent previous test. Upon completion of such additional test (s), if any, Operator shall set the Dependable Capacity at any level within plus or minus ten percent (±10%) of the Estimated Dependable Capacity as specified in Section 12.1.
12.5 Upon completion of the first Agreement Year, the Dependable Capacity may be reset by Operator by testing as described in this Article 12. At least fourteen (14) Days prior to completion of that first Agreement Year, Operator shall notify PREPA of its intention to reset the Dependable Capacity. The payments for Dependable Capacity thereafter shall be made based on this new Dependable Capacity. This new Dependable Capacity shall be within plus or minus ten percent (±10%) of the Dependable Capacity set pursuant to Section 12.3, but also must be within plus or minus ten percent (±10%) of the Estimated Dependable Capacity specified in Section 12.1.
12.6 Following the initial setting of the Dependable Capacity as per this Article, Operator shall notify PREPA in writing of the set Dependable Capacity and consequently the Commercial Operation Date. ARTICLE13 - FUELPROCUREMENT
(a) Operator shall maintain at all times a list of qualified suppliers for Fuel and for Fuel transportation to the Facility (the "Suppliers List"), which shall be updated and submitted to PREPA at least once a year. Testing and Capacity Ratings. 1Testing The Company shall carry out testing of the Dependable Capacity of the Facility before and after the Commercial Operations Date in accordance with Schedule 4. GPL shall be given prior written notice of any testing or Commissioning procedure in accordance with Schedule 4 and shall be entitled to have representatives present for the purpose of observing any such procedure.

Testing and Capacity Ratings. 11.1 Operator's Estimated Dependable Capacity is 198 MW for the Summer Period and 202 MW for the Winter Period.
11.2 The Dependable Capacity level for which the Operator will be paid the Capacity Purchase Price shall be determined for each Summer and Winter Period by testing as set forth in this Article 11.
11.3 When the Facility is ready to establish the Commercial Operations Date, the Operator shall notify Virginia Power that it is ready to attempt a Commercial Operations Test of the Dependable Capacity of the Facility and such Test shall be initiated and monitored by Virginia Power within fourteen (14) days of Virginia Power's receipt of such notification.
11.4 If Operator is not satisfied with the results of the attempted Commercial Operations Test, Operator may request additional tests to establish the Commercial Operations Date with at least three (3) Business Days notice provided to Virginia Power between tests, but Operator will not be paid for capacity for the time period(s) between tests to establish the Commercial Operations Date.
11.5 When the Operator is satisfied with a test to establish the Commercial Operations Date, the Operator shall provide written notice to Virginia Power that it has designated such test as the Commercial Operations Test and shall set the Initial Dependable Capacity for the appropriate Summer or Winter Period at any level up to the tested level but such level shall not exceed one-hundred ten (110)% of the Estimated Dependable Capacity level for the appropriate Summer Demonstration Period or Winter Demonstration Period.
11.6 In addition to the Commercial Operations Test, Initial Dependable Capacity for the Summer Demonstration Period and Winter Demonstration Period shall be determined by testing as follows:
a) The Commercial Operations Test shall constitute the Initial Dependable Capacity for the appropriate Summer Demonstration Period or Winter
Testing and Capacity Ratings. 8.1 During the term of this Agreement, Xxxxxx LLC shall provide O&R with the results of the DMNC test which Xxxxxx LLC performs for each capability period (as defined by the NYPP or the ISO or their successors) in accordance with NYPP Procedures or any similar test established by the ISO Protocols.
Testing and Capacity Ratings. 8.1 During the term of this Agreement, NY-Gen LLC shall provide O&R with the results of the DMNC test which NY-Gen LLC performs for each capability period (as defined by the NYPP or the ISO or their successors) in accordance with NYPP Procedures or any similar test established by the ISO Protocols.
Testing and Capacity Ratings. 11.1 During the Initial Capacity Test Period, the Dependable Capacity of the Facility during each Month of the Initial Capacity Test Period shall equal the following: Y= The sum of the hourly integrated kW output of the Facility at the hour of Buckeye’s system peak demand during such Month and at the hour of each of the next four highest Buckeye system demands during such Month. In the event that any of such hours occurs during a Schedule Outage or a Forced Outage, including a Forced Outage caused by an event of Force Majeure, the Dependable Capacity of the Facility shall nevertheless be determined during such hours.
11.2 For each Capacity Test Period other than the Initial Capacity Test Period, the Facility shall be rerated as described below in this Section 11.2, and the Dependable Capacity of the Facility during each Month of the Capacity Test Period shall equal the following: Z = The sum of the hourly integrated kW output of the Facility at the hour of Buckeye’s system peak demand during the immediately preceding Summer Season and at the hour of each of the next nineteen highest Buckeye system demands during such Summer Season. In the event that any of such hours occurs during a Schedule Outage or a Forced Outage, including a Forced Outage caused by an event of Force Majeure, the Dependable Capacity of the Facility shall nevertheless be determined during such hours. Notwithstanding the above, the Dependable Capacity of the Facility shall not exceed 1 MW except by mutual agreement of the Parties.
Testing and Capacity Ratings. 11.1 Operator’s original Estimated Dependable Capacity is 40 MW for the Summer Period and 41 MW for the Winter Period.
11.2 All testing for the determination of Dependable Capacity shall be in accordance with the following criteria:
(a) Testing shall last for six (6) hours during a Winter Period test and twelve (12) hours during a Summer Period test from the time set forth in the notice provided by North Carolina Power pursuant to the notice provision of Section 11.2(c).
(b) Normal station use and operation of (i) unit auxiliaries (including without limitation spray modules and cooling towers required by regulatory or governmental authority) using steam or electricity produced at the Facility; and (ii) auxiliary equipment that produces steam or electricity is required during tests for Dependable Capacity; provided that the use and operation of auxiliary steam-producing equipment shall not be required during any such tests from and after the date as of which Operator relinquishes the Facility’s QF status as permitted pursuant to Section 4.1 hereof.
(c) North Carolina Power shall provide notice to Operator of the date and time of all tests. Such notice shall be provided to Operator no earlier than forty-eight (48) hours in advance of the date and time of the test and no later than necessary to allow the Facility, pursuant to the Design Limits, to reach the appropriate Summer Period or Winter Period Estimated Dependable Capacity for the appropriate Summer Period or Winter Period. Tests shall be initiated within fourteen days after the start of the appropriate Summer Demonstration Period or Winter Demonstration Period.
(d) During all tests, Operator may operate the Facility at any level consistent with Prudent Utility Practices, Prudent Electrical Practices, all licenses and permits, and technical limits of the Facility’s equipment.
(e) The lowest half-hour integrated kW demand reading from North Carolina Power-owned meters during any such test shall equal the tested level (the “Tested Level”). 45
(f) North Carolina Power shall not schedule a test for Dependable Capacity to be conducted during a Scheduled Outage or, if Operator notifies North Carolina Power of a Maintenance Outage before North Carolina Power notifies Operator of a proposed test, during such Maintenance Outage, In addition, if Operator has notified North Carolina Power prior to North Carolina Power’s notice of commencement of a test that the Facility is experiencing a Forced Outage, then North ...
