Unpaid Leave - General. Upon the recommendation of the Superintendent and the approval of the Board, a professional staff member may be granted a leave of absence without pay and without credit for experience on the salary schedule (excepting those teachers who teach 120 days). The leave shall not be for a period of time longer than one (1) school year. The factors listed below shall be taken into account by the Superintendent in making a recommendation: a. The disruptive effect the leave may have upon instruction; b. The availability of a satisfactory replacement; c. The types and frequency of other leaves granted to the professional staff member; d. The length of the leave; e. The amount of time between the professional staff member's request and the start of the leave; and f. The reason for the leave. To apply for this leave a professional staff member must: a. Have been employed by the Board at least three (3) full school years prior to the leave; b. Submit a written request to the Superintendent indicating the beginning and ending dates of the leave and the reason(s) therefor; and c. Meet with the Superintendent or his/her designee for the purpose of discussing the professional staff member's request. Each leave shall be evaluated upon its individual merit, and decisions made shall not necessarily constitute precedent. * See general provision (Section 28.11 below)

  • LEAVE GENERAL 30.1 For purposes of earned leave credits or other leave entitlements, a day shall be equal to seven decimal five (7.5) hours for employees to whom Schedules 2 (Supervisory) and 1, 2, 4, 5, and 6 (Non-supervisory) of the Pay Schedules apply or eight (8) hours for employees to whom Schedules 3 (Supervisory) and 3 (Non-supervisory) of the Pay Schedules apply. 30.2 When leave is granted, it will be granted on an hourly basis and the number of hours debited for each day of leave shall be equal to the number of hours of work scheduled for the employee for the day in question. 30.3 Notwithstanding the above, Article 35.2 Bereavement Leave, a day will mean a calendar day. 30.4 When an employee has been permitted to liquidate more vacation or sick leave with pay than the employee has earned and the employee’s employment is terminated by death, the employee shall be considered to have earned such leave. 30.5 When an employee has been permitted to liquidate more vacation or sick leave with pay than the employee has earned, and the employee’s employment is terminated for reasons of incapacity or layoff, the employee shall be considered to have earned such leave if at the time of termination for reasons of incapacity or lay-off the employee has completed two (2) or more years of continuous service. Following notice of termination for reasons of incapacity or lay-off, an employee is entitled to liquidate earned leave only. 30.6 The amount of leave with pay credited to an employee by the Council at the time when this Agreement becomes effective, or at the time when the employee becomes subject to this Agreement, shall be retained as leave by the employee, except as provided for in those clauses providing for the liquidation of compensatory leave. 30.7 An employee is entitled at least once in each fiscal year to be informed, upon request, of the balance of his vacation, compensatory and sick leave. 30.8 An employee is not entitled to leave with pay during periods of leave without pay or when the employee is under suspension. 30.9 An employee shall not be granted two (2) different types of leave with pay in respect of the same period of time.

  • Sick Leave Abuse ‌ When the Employer suspects sick leave abuse, the employee will be provided the opportunity to explain the circumstances surrounding their sick leave use prior to disciplining the employee, or making reference to sick leave use in the employee’s performance evaluation. The Employer may not adopt or enforce any policy that counts the use of paid sick leave time as an absence that may lead to or result in disciplinary action for an authorized purpose. The Employer may not discriminate or retaliate against an employee for the use of paid sick leave for an authorized purpose.

  • Unpaid Leave - Union Business ‌ (a) Short-term leave of absence without pay to a maximum of fourteen (14) days at one time shall be granted to employees designated by the Union to transact Union business including conventions and conferences unless this would unduly interrupt the operation of the department provided, however, that these designated employees shall be paid by the Employer for time lost in attending meetings during working hours whenever their attendance is requested by the Employer. The Union shall give reasonable notice to minimize disruption of the department and the Union shall make every effort to give a minimum of seven (7) days’ notice. (b) Long-term leave of absence without pay shall be granted to employees designated by the Union to transact Union business for specific periods of not less than fourteen (14) days unless this would unduly interrupt the operation of the department. Such requests shall be made in writing sufficiently in advance to minimize disruption of the department. Employees granted such leave of absence shall retain all rights and privileges accumulated prior to obtaining such leave. Seniority shall continue to accumulate during such leave and shall apply to such provisions as annual vacations, increments and promotions. (c) Leave of absence without pay shall be granted to employees designated by the Union for the purpose of collective bargaining. Seniority and all benefits shall accumulate during such leave. (d) The foregoing provisions shall not limit the provisions of Article 5.10, 9.01, 9.02, 9.03, 11.05, 11.06, 12.01, 12. (e) Every effort will be made by the Employer to retain employees on unpaid leave of absence for Union business on the Employer’s payroll and where such employees are retained, the Union shall reimburse the Employer for the wages and benefits involved. This provision does not apply to employees on extended leaves of absence who are employed by the Union on a regular full-time basis.

It is also the policy of the State to take corrective action for unauthorized use of sick leave and/or abuse of sick leave.
