Usage and Limitations. LICENSEE is entitled to use the SOFTWARE within the scope of the Agreement. The license granted to LICENSEE under this Agreement is a simple, non-exclusive, non-transferable and non-sublicensable right to use SOFTWARE in ACADEMIA for ACADEMIC PURPOSES and for PRIVATE USE, limited in time to the term of this Agreement. Usage and Limitations. The Service Provider does not guarantee that the Software will be compatible or operate with the Client’s computer, internet provider’s service plan, mobile carrier’s service plan, or any other piece of hardware, software, equipment, or device they use to access or use the Software. The Client is responsible for providing, maintaining, and ensuring the compatibility of all hardware, software, and other system requirements necessary for their access to and use of the Software. They are responsible for all third-party charges and fees, including to their internet service provider and mobile carrier, in connection with their access and use of the Software and for complying with any contracts, terms of service Agreements, and restrictions associated with such third-party services. The quality and availability of the Software may be affected by factors outside of the Service Provider’s control because the Software is provided over the internet. Discretionary leave may be used at the discretion of the teacher to cover any absence not described in Section 2 Child Care leave, Section 3 Bereavement Leave, Section 4 Enrichment Leave, Section 5 Educational Leave, Section 6 Professional Leave, Section 7 Association Leave and Section 8 Jury Duty.

Additional teachers, in excess of the 15% shall be granted discretionary leave in the event of personal illness or the illness of a family member. Discretionary leave and Accumulated Sick Bank leave may not be used on days that long-term disability insurance benefits are paid. Absences due to approved school business will not incur a discretionary or accumulated leave deduction. Teachers who utilize discretionary leave or short duration time off on a designated District professional development day will be responsible for making up the learning that was missed. Building principals will provide guidance on the expected requirements.
