Warranty and Repairs. 1. Contractor shall provide a minimum of one (1) year warranty on all new parts and equipment.
2. Contractor shall include, when applicable, all manufacturers’ warranties and/or extended warranties in excess of the one (1) year warranty expressly required in paragraph B.1. above.
3. Remanufactured parts or supplies will not be accepted by the County.
4. Contractor shall respond to all warranty repair requests during normal business hours of 8:00 AM – 5:00 PM Pacific Time (PT) Monday through Friday, within eight (8) hours of the logged call to Contractor.
5. Should County request emergency services not covered under warranty to be provided during evening hours, weekends or holidays, Contractor shall provide the requested services and shall invoice County pursuant to Attachment B – Cost/Compensation.
6. Contractor shall warranty all labor and materials used to complete its Projects for a period of one (1) year plus any manufactures’ extended warranty after completion of and acceptance of the Contractor’s work by the County.
7. Contractor shall assure that low voltage contractor must have a certified Xxxxxx Installer (CI) on every low voltage cabling installation.
Warranty and Repairs. The Artist warrants:
(a) that he/she will create the Artwork using high quality materials and adequately skilled labour and guarantees the materials and labour used in creating the Artwork for 12 months;
(b) that the design and Artwork have been developed exclusively for the Site and that the Artist will be the sole author of the Artwork; and
(c) that the Artwork will not breach copyright, other intellectual property rights, privacy, common law, or contractual agreement of any other person or entity in complying with the terms of this Agreement. The Artist will rectify, without charge to the Principal, defects in the Artwork that become apparent during a 12 month warranty period commencing on the Completion Date.
Warranty and Repairs a. Except for Software, which is defined and provided for in Section 13, ANALOGIC warrants to TOMOTHERAPY that all of the Components sold to TOMOTHERAPY under this Agreement will be at the time of their delivery, free from defects in workmanship and material and in compliance with the Specifications. ANALOGIC further warrants that all of the Components sold to TOMOTHERAPY under this Agreement will, on the date of shipment by ANALOGIC, have been manufactured by ANALOGIC in accordance with the FDA’s current Good Manufacturing Practices, Quality System Regulations, ISO 9001.
b. The warranty period for the Components shall be twelve (12) months from the date of shipment by TOMOTHERAPY to a customer of a System into which the Components have been integrated or fifteen (15) months from the date of shipment of the Components by ANALOGIC to TOMOTHERAPY, whichever period occurs earlier. ANALOGIC will, at its option, repair or replace defective Components returned during the warranty period at no cost to TOMOTHERAPY, provided that each Party is responsible for the shipping cost of the Components it sends to the other.
c. ANALOGIC shall perform an inspection and test of field-returnable Components to confirm that there is a defect requiring warranty repair or replacement. Returned Components found not to be defective or no longer under warranty shall be repaired at TOMOTHERAPY’s expense at ANALOGIC’s then current standard rates for out of warranty repairs. These warranties are made upon the express condition that:
i. ANALOGIC is given prompt notice upon discovery by TOMOTHERAPY of such nonconformity, with an explanation of the alleged deficiencies.
ii. Such Product is returned to ANALOGIC at the expense of TOMOTHERAPY after receipt of a Return Authorization (RA) from ANALOGIC. Upon their repair or replacement, they shall be returned to TOMOTHERAPY as directed, at the expense of ANALOGIC.
iii. Examination of such Components by ANALOGIC discloses that the nonconformity actually exists and was not caused by accident, misuse, neglect, alteration, improper installation or use, improper repair or improper testing; and
iv. Such Components (including the Software, as defined below) have not been modified, altered or changed by any person other than ANALOGIC or its duly authorized repair agents, and other than modifications by TOMOTHERAPY as provided under Section 13 a. iii. of this Agreement. Warranty and Repairs. All notebooks in the 1 to 1 Laptop Program are covered by Warranty. The College provides insurance for non- warranty claims, damage, or loss with an excess for each claim. This support is designed to provide rapid resolution of technical issues and significant reductions in critical downtime. Repair and replacement costs of less than the excess, including battery chargers, are the responsibility of parents. Repairs to or replacement of the computer or its parts that are not covered by warranty or insurance must be paid for in full by parents/guardians. All laptops are covered by warranty for the duration of the rental. It is warranted that the hardware products will be free from defects in materials and workmanship. In the event of failure of the computer, damage or loss, the parent or guardian must inform the IT Support as soon as possible of the event. College staff, or agents acting on behalf of the College, will determine the appropriate course of action including whether a warranty or insurance claim is applicable, or settlement of an invoice is to be made by the parent or guardian. Generally, a credit card authority from parents or guardians is required prior to commencement of repairs to expedite these processes. Warranty and Repairs. A. As part of the service process MDG may delete and refresh the computer system to its original, equivalent, or other pre-determined software environment. MDG IS NOT RESPONSIBLE FOR ANY LOSS OF YOUR DATA. PLEASE BACK UP ALL FILES BEFORE SERVICES ARE PERFORMED AND REMOVE ANY NEEDED DATA FROM PARTS OR PRODUCTS RETURNED TO MDG. It is the customer’s responsibility to reinstall all data and software programs.

This does not cover abuse or accidental damage. ○ Accidental damage would only be covered by the (Optional) Accidental Damage Coverage listed below. ○ Parent/Guardian will be sent an email or receive a phone call when a device is determined to be abused or damaged. ● Accidental Damage Coverage - (Optional) Accidental Damage Coverage is available for purchase to provide coverage for repair costs for damage occurring accidentally. (This does not cover abuse!) ○ This annual coverage can be purchased each year for: $30 ○ Payment for Accidental Damage Coverage must be received within 2 weeks after student receives device. ○ Claim Year is from July 1, 2024 – June 30, 2025. This coverage resets in July every year.
Warranty and Repairs. 11.1 Medaxis warrants the flawless quality and workmanship of all delivery items from the date of delivery to the user (warranty periods can be found in the individual user manuals). Defective delivery items are repaired or replaced without charge during this period as long as the customer has not used them improperly.
11.2 Claims exceeding the described scope of warranty, particularly liability for consequential damages caused by the defect, are barred. Moreover, the right to cost-free replacement of defective parts does not apply if unauthorized persons have interfered with the device. To take advantage of the warranty, the device must be delivered to a Medaxis service center. Repair costs outside of the warranty are quoted in advance.

Warranty and Repairs. 4.4.1. The Customer shall be entitled to the statutory warranty rights. The Customer’s claims for defects shall become statute-barred one year after handover of the Turtle product.
4.4.2. Section 377 of the German Commercial Code (HGB) shall apply and shall also apply in the same way to the rights set forth in sections 4.4.3. to 4.4.7. above.
4.4.3. With regard to Turtle boxes, the rights granted in the following clauses shall apply in addition to the statutory warranty rights:
4.4.4. Turtle’s obligations under Sections 4.4.4, 4.4.5 and 4.4.6 are subject to the following cumulative conditions: I the Turtle Box and all of its components have been used solely for their intended purpose. “Intended use” of the Turtle Boxes does not include, without limitation, any of the following or similar situations: Accidents involving large forces, such as falling from a vehicle, fire, collision with heavy objects or machinery, falling from a great height, and violent conduct, such as forcible opening of Turtle boxes by customs officials; II the Turtle Box and all of its component parts have been used and handled with due care and in accordance with all operating instructions issued for it, including but not limited to the Turtle Case Manual; and III the Turtle Box and its components have never been repaired or adjusted by any third party and have never been repaired in a manner inconsistent with any operating instructions issued for the Turtle Box, including but not limited to the Turtle Case Manual.
4.4.5. If Turtle provides new components to Customer at no charge pursuant, Customer shall install such components
4.4.6. Turtle expressly reserves the right to inspect the Turtle Box, all of its components and compliance with the specified conditions by visiting the Customer’s premises in the event that the Customer makes a claim under clauses 4.5.4, 4.5.5 and/or 4.5.6. If the Customer fails to comply with a request for inspection, Turtle may, at its sole discretion, refrain from making the requested repairs free of charge and/or provide the requested component(s) free of charge.
4.4.7. For the avoidance of doubt in relation to clauses 4.4.4. to 4.4.6., Turtle will not repair Turtle Boxes and/or provide components free of charge if the relevant Turtle Box and/or component(s) have suffered damage that does not render the Turtle Box unfit for its intended use, such as scratches and scuffs. Warranty and Repairs. 9.1 The Owner warrants that the Equipment shall substantially conform to its specification, be of satisfactory quality and fit for any purpose held out by the Owner. The Equipment may not be new and the Owner is under no obligation to provide new or unused Equipment.
9.2 The Owner shall use all reasonable endeavours to remedy, free of charge, any material fault or defect in the Equipment provided that:
(a) the Hirer notifies the Owner of any fault or defect in writing within 7 days of the fault or defect occurring or of becoming aware of the defect;
(b) the Owner is permitted to make a full examination of the alleged fault or defect;
(c) the fault or defect did not materialise as a result of misuse, neglect, alteration, mishandling or unauthorised manipulation by any person other than the Owner's authorised personnel; and
(d) the fault or defect is directly attributable to defective material, workmanship or design.
(e) If the equipment is not able to be repaired, it will be replaced free of charge.
