Agency Head or Designee. If the grievance is not resolved at Step 1, the Association may move it to Step 2 by filing the written grievance with the agency head, with a copy to the Human Resources Office, within fifteen (15) days of the Association’s receipt of the Step 1 decision. Upon agreement of the parties, the agency head or designee will meet or confer by telephone with an Association xxxxxxx and/or staff representative and the grievant within fifteen (15) days of receipt of the Step 1 decision. Management will provide a written response to the Association within fifteen (15) days after the meeting and if the remedies are denied the response will include an explanation.
Agency Head or Designee. When the answer at Step I does not resolve the grievance or when the parties agree that the issue is more properly addressed at Step II, the grievance shall be submitted by the Union representative and/or the grievant to the agency head or his/her designee within seven (7) days of the Step I response or, in the case of a grievance ripe for submission directly to Step II, within the period specified in Section Five. Within fourteen (14) days after receipt of the grievance, a meeting will be held with the employee and/or his/her representative and a written response issued within five (5) working days thereafter.

Emergency - Escape, riot, fire, hostage situation, natural disaster, or other similar situation, declared by the Director, which threatens or may threaten the security of the institution, work area or safety of the public, employees and/or offenders, others. Employee - An employee in a regular full-time or part-time position. Employer - The State of Nebraska and shall not include any political subdivision thereof. Fiscal Year - Shall mean the fiscal year of the State of Nebraska (July 1 - June 30). Patrol - The Nebraska State Patrol. Personnel Files or Personnel Records - The official personnel records of bargaining unit members which are maintained at the Agency. Policies and Procedures - The formal, written policies and procedures of the employing agency. Service Anniversary Date - The service date is the date of hire for a new employee. The service date for rehired employees shall be adjusted by the number of calendar days absent if reemployed within one year. Suspensions without pay and leaves of absence which exceed 30 calendar days (except military leave) also require adjustment of the service date. Employees who left state service for other than disciplinary reasons and return within one year shall be given credit for previous state service by having their service date reinstated minus the amount of time absent. The service anniversary date shall be the date used for calculating vacation and sick leave accumulation. Superintendent - The Superintendent of the Nebraska State Patrol.

If the grievance is still unresolved, a legible copy of the grievance form shall be presented by the Union to the Agency Head or designee in writing within ten (10) days after receipt of the Step Two (2) response or after the date such response was due, whichever is earlier. Within fifteen (15) days after the receipt of the written grievance, the parties shall meet in an attempt to resolve the grievance unless the parties mutually agree otherwise. By mutual agreement of the parties, agencies may schedule Step Three (3) meetings on a monthly basis, by geographic areas, so that all grievances that have been newly filed, that have been advanced to Step Three (3) or that have been continued since the previous month, can be heard on a regular basis. At the Step Three (3) meeting the grievance may be settled or withdrawn, or a response shall be prepared and issued by the Agency Head or designee, within thirty-five (35) days of the meeting. The response will include a description of the events giving rise to the grievance, the rationale upon which the decision is rendered. The Agency may grant, modify or deny the remedy requested by the Union. Any grievances resolved at Step Three (3) or at earlier steps shall not be precedent setting at other institutions or agencies unless otherwise agreed to in the settlement. The response shall be forwarded to the grievant and a copy will be provided to the Union representative who was at the meeting or one who is designated by the Local Chapter. Additionally, a copy of the answer will be forwarded to the Union's Central Office. This response shall be accompanied by a legible copy of the grievance form. Step Four (4) - Mediation/Office of Collective Bargaining If the Agency is untimely with its response to the grievance at Step Three (3), absent a mutually agreed to time extension, the Union may appeal the grievance to Step Four (4) requesting a meeting by filing a written appeal and a legible copy of the grievance form to the Deputy Director of the Office of Collective Bargaining within fifteen

Step 3 - Pre-Arbitration Review Meetings (PARM): If the grievance is not resolved at Step 2, the Union may file a request for a PARM (with a copy of the grievance and all responses attached). It will be filed with the OFM State Human Resources Labor Relations Section (OFM/SHR/LRS) at xxxxx.xxxxxxxxx@xxx.xx.xxx and the agency’s Human Resources Office within fifteen (15) calendar days of receipt of the Step 2 decision. Within fifteen (15) calendar days of the receipt of the request, the LRS will schedule a PARM (in-person, telephone, or web-conferencing) that will take place within sixty (60) calendar days of receipt of the request, with the LRS designee, the agency’s Human Resources Office representative, and the Union’s representative to review and attempt to settle the dispute.
