Accumulated Sick Leave Bank. Employees who have a sick leave bank, in accordance with the “Sick Leave Transition” Letter of Understanding attached to this agreement, may utilize their bank to “top-up” the sick leave provided under Article 10.01 as follows:
(a) When an employee exhausts 100% days, he/she will be paid at the 70% rate for absences. If the employee has a top-up bank his/her sick pay will be topped up to 100% on a seven (7) hour work day this will result in 2.1 hours drawn from their top-up bank of being paid at the 70% rate or “topping-up” to 100%.
(b) When an employee exhausts all sick leave credits and is subject to being placed on hours without pay in accordance with Article 10.01, he/she will have the option to “top-up” from his/her sick leave bank.
Accumulated Sick Leave Bank. Members who have a sick leave bank in accordance with the Sick Leave Transition provisions may utilize their bank to top-up sick leave provided under paragraphs 3 and 4 of the Sick Leave Transition provisions as follows:
(a) when a member exhausts 100% days, he or she will be paid at the 70% rate of absence for one-half day or less. If the absence is for more than one-half day, the member will have the option of being paid at the 70% or topping-up to 100%;
(b) when a member exhausts all sick leave and is subject to being placed on hours without pay in accordance with paragraph 4, he or she will have the option of top-up from his or her accumulated sick leave bank;

Accumulated Sick Leave Bank. The parties agree that the sick leave accumulation bank frozen at March 31, 1989, will be made available to employees to support any unpaid sick leave periods. Further, for employees who had ten (10) or more years of service at April 1, 1989, fifty (50) percent of the sick leave credit remaining will be paid out upon retirement or upon separation of employment other than for cause as outlined in Article 21.2. Similarly, employees who had five (5) or more years of service at April 1, 1989, will continue to earn service credits until the required ten (10) years of service are met and will have the remaining sick leave paid out as above.
Accumulated Sick Leave Bank. 1. The purpose of the sick leave bank is to relieve certified school employees from undue financial burdens due to absences from work on a long-term basis due to illness, injury or incapacitation sufficiently severe that it would make their presence at school not advisable. The sick leave bank may only be used for the illness of its members.
2. The Board will not contribute any days to the sick leave bank. Only member's actual days may contribute to create the sick leave bank. Membership in the sick leave bank will be open to all certified school employees. A member shall be defined as a certified school employee who has made a contribution of one (1) day of leave to the sick leave bank at the appropriate time of enrollment. Enrollment shall be open until September 30th of each school year. No current member will be required to contribute a day if the total number of days in the bank exceeds eighty

(i) Long Term Disability (LTD). Employees who have completed their probationary period and who are absent for periods exceeding twenty-six (26) weeks of medical leave shall be eligible to apply for LTD benefits Where an LTD claim is established, the University will maintain the employee’s current health and welfare benefits and will pay both the employee and employer premiums.
(ii) Retain former position: If prior to or at the time the employee is eligible to apply for LTD benefits, the medical prognosis is that the employee will be able to return to the employee’s regular position; then the employee’s regular position shall be retained. When there is satisfactory medical support for the return of the employee to regular full time work, the University shall return the employee to the payroll at the employee’s previous job and at the rate of pay currently applicable for a period of two (2) months to determine if the employee is capable of performing the job the employee held at the time of the injury or illness. If after two (2) months it is proven to the satisfaction of the University that the employee is unable to perform the job held at the time of injury or illness, the University shall place the employee in a job which the employee can do, within the union jurisdiction, at the rate of pay applicable to that position, when such a position becomes available within the bargaining unit, or failing this, will endeavor to have the employee employed within the general scope of the University. If the University is unable to secure placement within twelve (12) months, the employee may be subject to termination.
