Association and Faculty Rights. A. The Association on behalf of the faculty of the College, hereby retains and reserves unto itself all rights, powers, authority, duties and responsibilities conferred upon and vested in it by Act 379 of Public Acts of 1965.
B. The Association shall be supplied with reports or information prepared by the College for public distribution. The Association shall pay the College for any expense involved in the preparation of information solely for Association use.
C. Machine or machines to be used in preparation of Association materials will be designated by the College Business Office for use without charge.
D. The Association may use the buildings of the College for meetings and to transact Association business without charge, provided that there is no additional cost to the College. Additional costs will be absorbed by the Association with arrangements being made through the Business Office of the College prior to the meeting.
E. A bulletin board shall be designated for Association use. Use of intra-college information media and mailboxes for notices of Association business is authorized. Classroom and hallway bulletin boards may not be used for such notices. All such notices must carry a designation of the individual or group responsible for the notice.
F. The provisions of this Agreement shall be applied in a reasonable and equitable manner and without regard to race, creed, religion, color, sex, age, political affiliation or belief, marital status, sexual orientation, handicap, veteran status, national origin or ancestry or any protected classification.
G. The Board and the Association pledge themselves to seek to extend the advantages of public education to every student without regard to race, creed, religion, color, sex, age, marital status, sexual orientation, handicap, political affiliation or belief, veteran status, national origin or ancestry or any protected classification and to seek to achieve full equality of educational opportunity for all students.
H. The Association shall accord just and equitable treatment to all members of the profession in their exercise of professional rights and responsibilities.
I. All committees appointed by the President of the College which have faculty representatives may have, at the discretion of the Association, at least one Association-selected representative.

Association and Faculty Rights. 16.1 Officers and committee chairs of the Association shall have the right to use college equipment such as typewriters, computers, calculating machines, and audio-visual equipment at all reasonable times when such equipment is not otherwise in use, subject to regulations determined by the Xxxx of Business Services and subject to the approval of the individual who is charged with the responsibility for that piece of equipment.
16.2 The Association’s Negotiation Committee’s expenses for duplicating with College equipment material for use of the Board or Board Committee in negotiations shall be paid for by the College out of funds budgeted for the Board.
16.3 The Board agrees to furnish regularly to the Association two (2) copies of the agenda, minutes, and the complete packet of information distributed for all Board meetings, such copies to be made available at the same time as distribution to Board members. Any materials distributed to the Board during the meetings, except those restricted to executive sessions matters, shall be made available to the Association prior to the meetings.
16.4 At each regular and special Board meeting that is open to the public, faculty members shall be afforded time, subject to reasonable constraints, to comment to or ask questions of the Board.
16.5 An individual’s personnel file shall be open to him/her upon request, with the exception that any confidential credentials or references submitted by a party outside the College shall not be revealed without the permission of the originator. The Association shall have similar access to an individual’s personnel file with the individual’s written consent, subject to the same restriction in regard to confidential materials originated outside the College. Reproduction of materials shall be subject to limitations imposed by law and/or by the originator if the originator is from outside the College. The following material shall be maintained in each faculty member’s file:
A. Application for employment with references, placement date if submitted, and complete transcripts of academic credit earned prior to and subsequent to employment by the College.
B. Copies of all evaluation reports and recommendations regarding the faculty member’s professional performance and competence.
C. Copies of each contract and notification of change of status, e.g., promotion and tenure, of the individual.
