CALENDARS a) When CONTRACTOR is a Non-Public School, the CONTRACTOR shall submit to LEA a school calendar with the total number of billable days not to exceed 180 days for the regular school year, plus extended school year billable days as determined by the IEP/IFSP team ((34 CFR § Section 300.106); a minimum of 20 instructional days (excluding July 4th). Billable days shall include only those days that are included in the submitted and approved school calendar, and/or required by the IEP/IFSP for each student. CONTRACTOR shall adhere to the requirements for providing Extended School Year as outlined in Title 5, Article 4 of the California Code of Regulations. Unless otherwise specified by the students IEP/IFSP, educational services shall occur at the school site. b) When CONTRACTOR is an NPA, CONTRACTOR shall be provided with a LEA developed/approved calendar; CONTRACTOR herein agrees to observe holidays as specified in the LEA-developed/approved calendar. CONTRACTOR shall provide services pursuant to the LEA-developed/approved calendar, or as specified in the LEA pupil’s IEP/IFSP and ISA. Unless otherwise specified in the LEA student’s IEP/IFSP and ISA, CONTRACTOR shall provide related services to LEA pupils on only those days that the LEA pupil’s school of attendance is in session and the LEA student attends school. CONTRACTOR shall bill only for services provided on billable days of attendance as indicated on the LEA calendar unless otherwise specified in the LEA student’s IEP/IFSP and ISA. c) CONTRACTOR shall identify at least five (5) “emergency days” in their calendar to be used as regular school days during school closure when no attendance waiver is approved by the CDE.

CALENDARS. School year calendars will contain the following provisions: (A) Early dismissal on last student school day for employees for closing out school year. (B) In the event of school closure prior to January 1st, the Friday holiday in February will be utilized as a school make-up day. If schools are closed due to inclement weather prior to the second Friday in February the closure day will be made up on the Friday prior to Memorial Day in May. Make up of additional closure days will be mutually agreed upon between the District and the Association. The scheduled end of first semester shall not be changed unless there are more than 3 closure days to make up from first semester. (C) The first Waiver Day will be during the first half of the school year. The second Waiver Day will be attached to the Presidents’ Day holiday. Continuation of these days is contingent on state funding and/or an approval of a waiver of the 180-day student school year requirement and/or appropriate program hour requirements. (D) Winter break will consist of a minimum of ten (10) school days. (E) Mid-winter break consisting of one (1) day will occur on Friday in February prior to the Presidents’ Day holiday on Monday (four-day weekend). (F) Spring break will consist of five (5) consecutive days, the majority being in the first week of April. (G) Three one-half days early dismissal at elementary and four one-half days early dismissal at secondary for parent reporting preparations. (H) The two full supplemental days (waiver days) are included in the one hundred eighty (180) day calendar for activities related to meeting Essential Academic Learning Requirements (EALRs). These days will follow the same guidelines outlined in Article 18 (Section 5 Learning Improvement Days). (a) Calendar options for the following year will be prepared by the District and presented to the Association President no later than January 10th of each school year for Association recommendation. (b) The Association recommendation is due to the District by the last school day in February of each school year. (c) The calendar for the following school year will be announced by March 15th of each school year. If the Association fails to provide a recommendation by the last day of February, the District will arrive at a school year calendar by the second Board meeting in March.

It is understood that services may not be provided on weekends, holidays and other times when school is not in session.

CONTRACTOR herein agrees to observe holidays as specified in the LEA-developed/approved calendar. CONTRACTOR shall provide services pursuant to the LEA-developed/approved calendar; or as specified in the LEA student’s IEP and ISA. Unless otherwise specified in the LEA student’s ISA, CONTRACTOR shall provide related services to LEA students on only those days that the LEA student’s school of attendance is in session and the LEA student attends school. CONTRACTOR shall bill only for services provided on billable days of attendance as indicated on the LEA calendar unless CONTRACTOR and the LEA agree otherwise, in writing. Student must have actually been in attendance and/or received services on a billable day of attendance in order for CONTRACTOR to be eligible for payment. It is specifically understood that services may not be provided on weekends/holidays and other times when school is not in session, unless agreed to by the LEA, in writing, in advance of the delivery of any nonpublic agency service provided by CONTRACTOR. Any instructional days provided without this written agreement shall be at the sole financial responsibility of the CONTRACTOR.
CALENDARS. The school year calendar(s) for the term of this Agreement is/are set forth in Appendix 4. The Association and the District will meet prior to April 1 for the purpose of agreeing upon a calendar for the school year following the expiration of this Agreement. If agreement is not reached by June 1, the District will establish the first day of school for students and may establish a calendar setting forth the work year for regular contracted employees which shall include the following: 1. A work year consistent with the provisions of A. above. 2. Holidays/Breaks as set forth in the current year’s calendar.
CALENDARS. A calendar will be distributed each year to educational support staff indicating work days and holidays. Calendars shall be developed for each job site as needed.
