Censures. (a) Whenever OC or its agent deems it necessary to censure an employee in a manner indicating that dismissal may follow any repetition of the act complained of or omission referred to, or may follow if such employee fails to bring his/her performance up to a required standard by a given date, OC shall, within 10 working days after the censure, give written particulars of such censure to the employee and the Union. (b) Subject to Clause 37.2(c) after a period of 12 months and upon a request in writing by the censured employee, written censures shall be removed from personnel records and destroyed, provided there are no further censurable infractions. (c) In the case of a written censure issued as a result of a sexual harassment complaint, the censure shall be removed from personnel records and destroyed after a period of 5 years, upon a request in writing by the censured employee, and provided there are no further censurable infractions under this clause.

Censures. Procedure ABSENCE LEAVE FOR OFFICERS
Censures. Whenever OUC or its agent deems it necessary to censure an employee in a manner indicating that dismissal may follow any repetition of the act complained of or omission referred to or may follow if such employee fails to bring their work up to a required standard by a given date, OUC shall, within 10 working days after the censure, given written particulars of such censure to the employee and the Union. After a period of 24 months and upon a request in writing by the censured employee, written censures, adverse reports, and letters of reprimand shall be removed from personnel records and destroyed, provided there have been no further infractions.
Censures are not prosecutions, but rules relating to admissibility of evidence still apply to the investigation and the evidence gathered must be robust and adequate to demonstrate a breach(es) of health and safety law.

  • Population The Population shall be defined as all Paid Claims during the 12-month period covered by the Claims Review.

  • Licensure The Contractor covenants that it has: (a) obtained all of the applicable licenses or permits, permanent, temporary or otherwise as required by Title 27 of the Virgin Islands Code; and (b) familiarized itself with the applicable provisions of Title 27 of the Virgin Islands Code pertaining to professions and occupations.
