Earned Paid Leave. 22.8.1 Upon execution of this Agreement and pursuant to 26 M.R.S. Sec. 637, employees will accrue one (1) hour of Earned Paid Leave (EPL) for every forty (40) hours worked and shall be subject to the City’s personnel policies regarding EPL. EPL shall be credited and posted on a weekly basis.

14.9.3 EPL may be used for 1) an emergency, illness, or sudden necessity;
Earned Paid Leave. 1. Except for emergencies all leave must receive prior approval at least three days before leave can be taken.
2. A full-time employee may be granted up to five (5) days earned paid leave each year as of the first official day of the school year. This leave may be taken in increments of one (1) hour. Part-time employees’ earned paid leave time shall be pro-rated.
3. Except for emergencies, earned paid leave shall not be used during educator in- service days or the first and last week that pupils are in attendance, the week before and after the following school breaks: Christmas break, February break, and April break, unless approved in advance by the Superintendent.
4. All earned paid leave, and exceptions to earned paid leave provisions, MUST be approved by the Superintendent of Schools. Any unauthorized days absent may be subject to disciplinary action.
5. A completed request shall be submitted to the employee’s immediate supervisor. The immediate supervisor shall forward the request to the Superintendent. In emergency situations this notification may be ex-post facto.
6. Employees may choose to roll over their unused earned paid leave time into sick leave at the end of the school year.

Sec. 637, employees will accrue one (1) hour of Earned Paid Leave (EPL) for every forty (40) hours worked and shall be subject to the City’s personnel policies regarding EPL. EPL shall be credited and posted on a weekly basis.
17.9.2 Employees may accumulate up to a maximum of forty (40) hours of EPL in a calendar year. Unused EPL hours will roll over from one calendar year to the next, but employees will not be awarded more than 40 hours in a calendar year, including hours that are rolled over.
17.9.3 EPL may be used for 1) an emergency, illness, or sudden necessity; or 2) any reason other than emergency, illness, or sudden necessity, including vacation or personal time. Where EPL is taken for an emergency, illness, or sudden necessity, the employee must make a good faith effort to provide as much notice as is feasible under the circumstances, and in accordance with the Department’s regular procedures. Where EPL is taken for any reason other than emergency, illness, or sudden necessity, an employee must request to take EPL in accordance with the Department’s regular procedures as outlined in article 17.5.
17.9.4 Employees hired prior to January 1, 1979 shall be compensated for all accumulated vacation leave and EPL at the time of separation with a combined maximum payout of 240 hours. Employees hired on or after January 1, 1979 shall be compensated for all accumulated vacation leave and EPL at the time of separation with a combined maximum payout of 160 hours. Any accrued EPL over these amounts is forfeited at the time of termination of employment.
17.9.5 If at any time Maine’s EPL law is rescinded, employees shall not earn any additional EPL and vacation leave accrual rates will be restored as follows: 1.54 hours per week in the first through the second year of service; 2.31 hours per week in the third through sixth year of service;
Earned Paid Leave. The City will provide Earned Paid Leave only to the extent required by 26 M.R.S.A. Section 637 and associated Maine Department of Labor Regulations.
Earned Paid Leave. This section is intended to implement Maine’s Earned Paid Leave (EPL) Law, 26 MRSA § 637.
1. Accrual of Earned Paid Leave
a. Effective with the effective date of this agreement, employees shall accrue one hour of EPL for every 40 hours worked, beginning with the first day of employment, up to a maximum of 40 hours per week.
b. EPL accrued under the law is not additional leave beyond what is provided in the Employee’s Employment Agreement of the Collective Bargaining Agreement under which the terms and conditions of employment is governed.
c. Employees may not use EPL until they have been employed for 120 calendar days. EPL cannot be used before it is earned and must be used in one-hour increments.
d. Employees employed by the school unit prior to January 1, 2021, will be eligible to use accrued EPL 120 days after their start date.
e. For eligible employees the designated year for purposes of accrual and use of earned paid time off shall be the contract year.
f. Any use of such EPL shall run concurrently with any other type of paid leave for which the employee is eligible (such as sick or personal). The employee may designate which type of leave EPL will be deducted from.
2. Allowable Uses and Notice Requirements – EPL may be used for any purpose, planned or unplanned.
a. Planned purpose: Employees shall provide three days’ advance written notice to their supervisor to use EPL for a purpose that can be planned. Such purposes include but are not limited to; weddings/social events, vacation, or recreational activity. Any such use of EPL shall run concurrently with any other type of paid leave for which an employee is eligible for this purpose (such as sick, vacation, or personal leave). Planned EPL cannot be used on the days immediately before and/or after a holiday or vacation period, or on any other days determined by the employee’s supervisor to conflict with the school unit’s operational needs without prior approval of the Superintendent.
b. Unplanned/Emergency Purpose: EPL may be used for an emergency, illness or injury, or other sudden necessity for which the employee does not have advance notice; is beyond the employee’s control to schedule; and is otherwise unforeseeable. The employee’s supervisor may request appropriate documentation demonstrating the necessity of using EPL for unplanned purposes if an employee requests such leave for three (3) consecutive workdays or more.
Earned Paid Leave. Effective January 1, 2021, employees in the State of Maine are entitled to receive up to forty
Earned Paid Leave. Full-time employees will be credited in advance with forty (40) hours of Earned Paid Leave (EPL) at the beginning of each contract year (September 1 to August 1). The following notice requirements apply depending on whether EPL leave is used for planned purpose or unplanned/emergency purposes.
Earned Paid Leave. 1. Employees are entitled to accrue up to forty (40) hours of EPL per calendar year for an emergency, illness or other sudden necessity at the rate of 1 hour for every 40 hours worked. Absent an emergency, illness or other sudden necessity, an employee shall give reasonable notice to their supervisor of their intent to use the earned leave. Use of leave must be scheduled to prevent undue hardship on the employer as reasonably determined by the employer. Pursuant to this article, unit members can annually utilize up to forty (40) hours of their earned paid leave for the purposes permitted under the EPL Law. Any such leave utilized by the employee for EPL purposes shall be counted towards the employee’s annual permitted use of EPL and indicated by said employee when calling in and on their timesheet.
2. EPL will be allowed to be used only after an employee has been with the City for 120 days per the EPL Law. EPL time may be used on hour by hour basis.
3. Employees will be paid for one hundred percent (100%) of their unused year’s EPL balance as of November 30th, in the second (2nd) pay period of December each year. The annual forty (40) hours of EPL accrual will be uploaded December 1st each year just like as in sick time. EPL will be pro-rated and paid out in full based on the employee’s date of hire and date of termination with the City of Xxxxxxx.
4. Between the dates of July 1, 2021 and November 30, 2021 an employee shall use their current accruals (sick, vacation or personal time) towards EPL time they utilize up to forty (40) hours per the 2021 calendar year.
