JURY DUTY AND BEREAVEMENT LEAVE. Employees working the 12-hour shift schedule will be paid for jury duty in accordance with Article 17.01 and bereavement leave in accordance with Article 18.01 at the rate of 12 hours' pay at their regular rate.

JURY DUTY AND BEREAVEMENT LEAVE. When an Employee is unavailable by virtue of Jury Duty, Xxxxxxx's Court Duty or Bereavement Leave his/her guarantee is not prejudiced. (a) Supreme Court and Xxxxxxx's Court Duty 1. Payment will be only made for days actively engaged in Jury selection, sitting on Supreme Court Jury Duty or Coroner's Court Duty. 2. JURY DUTY AND BEREAVEMENT LEAVE. When a Despatcher or Ship Planner is unavailable by virtue of Jury Duty, Coroner’s Court Duty or Bereavement Leave, the following shall apply: (a) Supreme Court and Xxxxxxx’s Court Duty 1. Payment will be only made for days actively engaged in Jury selection, sitting on Supreme Court Jury Duty or Coroner’s Court Duty. 2. A Despatcher or Ship Planner will receive a per diem payment for days actively engaged in Jury selection, sitting on Supreme Court Jury Duty or Coroner’s Court Duty equivalent to his/her base annual salary divided by 260 days and multiplied by the number of days on jury leave, less the wage portion of the daily reimbursement from the Supreme Court or Xxxxxxx’s Court.
JURY DUTY AND BEREAVEMENT LEAVE. 13.1 Employees who are required to be absent from work to serve on Jury Duty will receive normal straight-time wages from the Employer. 13.2 Bereavement Leave of three (3) days at the discretion of the Employer shall be allowed where death has taken place in the immediate family. Immediate family shall be defined as parent, spouse, children, brothers, sisters and grandparents of the employee. 13.3 The Employer shall be reimbursed for all straight-time wages paid to employees for the aforementioned absences from the "Industrial Benefit Fund." Funding shall be provided by the Employer who shall contribute a sum equal to $0.04 per hour paid for each employee covered by this Collective Agreement. These funds shall be remitted to and administered by D.A. Townley & Associates. (See Article 12.7.)
JURY DUTY AND BEREAVEMENT LEAVE. 14.01 An employee who has attained seniority shall be granted a leave of absence with pay at his regular hourly rate for the normally scheduled number of hours the employee would have otherwise worked up to a maximum of eight (8) hours per day for the purposes of serving jury duty or as a material witness subpoenaed to an appearance in which the employee has no personal involvement, provided that the employee shall reimburse the Company to the full amount of jury pay or witness fees received by him. 14.02 Up to three (3) days off with pay shall be granted to an employee for the purpose of attending the funeral or making necessary arrangements for the funeral of an immediate member of the family. An immediate member of the family means mother, father, sister, brother, daughter, son, husband, wife, mother-in-law, father-in-law, and grandparents. One day off with pay shall be granted to an employee for the purpose of attending the funeral or making necessary arrangements for the funeral of the employee’s sister-in-law, brother-in-law, uncle, aunt and first cousin. The bereaved employee may, at management’s discretion, be granted extra days off for acceptable reasons but such days shall be without pay. The Employer shall not be required to make payment for any days that the bereaved employee would not have otherwise worked. 14.03 For compassionate grounds, where the death of a member of the employee’s immediate family, as defined in Article 14.02, is verified as having occurred outside Canada, the employee shall be granted two (2) days off with pay for bereavement, provided the employee does not attend or make necessary arrangements for the funeral.
JURY DUTY AND BEREAVEMENT LEAVE. 15.01 An employee who is called for jury duty will receive the difference between their straight time wages and the payment they received for such duties for those days they would actually have been at work during their service as a juror. The Company agrees to pay the difference between straight time wages and payment received for any employee who is subpoenaed as a Crown Witness and who is not a party to the action. Payment will be for hours they would have normally worked during their service as a witness. 15.02 Should a bereavement occur in an employee’s immediate family, members of their household, parents, brothers, sisters, grandparents, mother-in-law, father- in-law, common- law partner which means a person who is cohabiting with the employee in a conjugal relationship for a period of at least one (1) year, or grandchildren, they may request a bereavement leave and they shall be granted such time off with pay as is reasonable under the circumstances to enable them to look after funeral arrangements, to attend the funeral or memorial service. The general standard of bereavement leave shall be five (5) working days in the case of a spouse, or children and three (3) working days for all others. However, the extent of such leave shall be at the discretion of the Company, after consultation with the Union, taking into consideration the time of the bereavement in relation to their regular time off, the distance to be traveled, etc. Employees asked to be pallbearers at a funeral shall be granted such time off with pay as is reasonable to attend the funeral, not however to exceed one (1) day. In addition, one (1) day will be granted for aunts, uncles, nieces, and nephews.

If an employee does not use all his days in a calendar year, he is entitled to carry over one (1) day for one (1) additional calendar year provided he is at the same employer and provided it is used because of illness.
