Layoff and Displacement a. Teachers who have been surplused by May 31, pursuant to Article C.21 Transfers and Surplus C.21.1.c, d, e, f and g, and who are unable to obtain work through the posting and filling process under E.22 Filling Vacant Positions, may be laid off and provided with a layoff letter and a list of all positions held by teachers with less seniority. i. The Board will identify teachers with the lowest seniority to be displaced by the laid off teacher. ii. A teacher served layoff notice pursuant to this article, who believes they possess the necessary qualifications to perform the duties of a position occupied by a teacher with less seniority, shall make written application outlining their qualifications for the position, to the Human Resources office within five (5) working days of receipt of the layoff notice. If the teacher’s application is successful, they shall be placed in the requested position. iii. A laid off teacher, who is not able to secure a position under the layoff and displacement process, has the option to be placed on the TTOC list. b. A teacher who is offered a position pursuant to Article C.22.3.a.ii shall inform the Board whether or not the offer is accepted within seventy-two (72) hours of the receipt of such offer exclusive of weekends and statutory holidays. c. Layoff and Displacement. Procedure and who accept layoff shall be eligible for recall in order of seniority to permanent positions within their classification provided the employee has the qualifications, ability and fitness to perform the work required.

(c) In the event that a regular employee is not eligible to fill a vacant position or displace in accordance with Article 36.03(b), subject to Article 36.03(a), such regular employee shall have the option to fill a position by choosing one (1) of the following sequential options: (i) a vacant benefit-eligible part-time position in the same paygrade, if available; (ii) displace the least senior benefit-eligible part-time employee in the same paygrade; (iii) a vacant benefit-eligible part-time position in a lower paygrade, if available; (iv) displace the least senior benefit-eligible part-time employee in a lower paygrade; (v) a vacant part-time position in the same paygrade, if available; (vi) displace the least senior part-time employee in the same paygrade; (vii) a vacant part-time position in a lower paygrade, if available; (viii) displace the least senior part-time employee; (ix) be laid off. (d) A regular employee displaced due to the provisions of this Article shall be eligible to be placed into a vacant position or to displace another regular employee in accordance with the provisions of this Article.

Layoff and Displacement. 10.1 In the event of a layoff, employees may exercise their Seniority by bumping the least senior employee in their classification on any shift if no other position is available provided the employee is qualified to do the job. The employee who is unable to bump will be laid off and placed on the recall list. (a) Employees who are displaced will have the right to bump using the same method as laid off employees. 10.2 Employees shall have a thirty-day notice of a layoff, except for an emergency. Union leadership shall be notified prior to notice to the affected members. 10.3 Employees who are laid off shall be placed on a recall list for twenty-four (24) months. 10.4 No new employees in the classification shall be hired until all employees in the classification on the recall list have been recalled or offered a position. Employees being recalled shall be given a minimum of seven (7) days’ notice. 10.5 Those on the recall list are responsible for keeping their mailing information current.
