Loss of Seniority and Employment Rights. An employee shall lose all service and seniority and shall be deemed to have terminated if the employee: (a) has been laid off for thirty (30) months; (b) resigns; (c) is absent from scheduled work for a period of three (3) or more consecutive working days without notifying the Employer of such absence and providing a reason satisfactory to the Employer and failure to notify was due to circumstances outside the employee’s control; (d) fails to return to work on the expiration of leave of absence, except for reasons beyond the employee’s control, or utilizes a leave of absence for a purpose other than that for which it was granted unless excused by the Employer in writing; (e) fails upon being notified of a recall to signify his or her intention to return within three (3) calendar days after he or she has received the notice of recall mailed by registered mail to the last known address according to the records of the Employer and fails to report to work within seven (7) calendar days after he or she has received the notice of recall or such further period of time as may be agreed upon by the parties. (f) fails to provide the Employer proof of registration or licence with the relevant professional association when requested on an annual basis.

Loss of Seniority and Employment Rights. 11.01 An employee shall lose all service and seniority and shall be deemed to have been terminated if they: (a) Have been laid off for 36 months; (b) Resign; (c) Are discharged and not reinstated through the grievance and arbitration procedure; (d) Are retired; (e) Are absent from scheduled work for a period of 3 or more consecutive working days without notifying the Hospital of such absence and providing to the Hospital a satisfactory reason for the absence; (f) If an employee has been laid off and fails to return to work within 7 calendar days after the employee has been notified by the Hospital through registered mail and/or certified mail addressed to their last address on the records of the Hospital. It is the employee's responsibility to ensure that their home address and telephone number are current at all times. If the employee fails to do this, the Hospital will not be responsible for failure to notify. (g) Fails to return to work upon the expiration of a leave of absence granted by the Hospital, without permission in writing from the Hospital. (h) Utilizes a leave for purposes for other than which it was granted Article 11.01 shall be interpreted in a manner consistent with the Human Rights Code.

Loss of Seniority and Employment Rights. An employee shall lose all service and seniority and shall be deemed to have terminated if he: (a) quits, resigns, or is discharged, and the discharge is not reversed through the grievance and arbitration procedure; (b) has been laid off for the lesser of the employee's seniority or twenty-four (24) calendar months (full time and regular part time employees only); (c) is absent from scheduled work for three (3) or more consecutive scheduled work days without notifying the Employer, and without providing a reason that is satisfactory to the Employer (full time and regular part time employees only); (d) utilizes a leave of absence for a purpose other than that for which it was granted, or, fails to return to work upon the expiration of a leave of absence without a reason that is satisfactory to the Employer (full time and regular part time employees only); (e) refuses to continue to work or return to work during an emergency which seriously affects the Employer's ability to provide adequate services to its clients, without providing a reason that is satisfactory to the Employer; (f) fails upon being notified of a recall to signify his intention to return within five
Loss of Seniority and Employment Rights. An Employee shall lose all service and seniority and shall be deemed to have terminated if he: a) quits, resigns, or is discharged; b) has been laid off for eighteen (18) calendar months; c) is absent from scheduled work for three (3) or more consecutive scheduled work days without providing a reason that in the Employer’s opinion is satisfactory; d) utilizes a leave of absence for a purpose other than for which it was granted, or, fails to return to work upon the expiration of a leave of absence without a reason acceptable to the Employer; e) refuses to continue to work or return to work during an emergency which seriously affects the Employer’s ability to provide adequate services to its clients, unless a satisfactory reason is given to the Employer; f) fails upon being notified of a recall to signify his intention to return within four (4) business days after he has received a notice of recall and fails to report to work within ten (10) business days after he has received the notice of recall or such further period of time as may be agreed upon by the parties. Notice of recall shall be sent by registered Mail. It is the Employee’s responsibility to ensure that his home address and telephone number are current at all times. Notification of change of address and telephone number must be given to the Program Supervisor. If the Employee fails to do this, the Employer will not be responsible for failure to notify. Business days exclude Saturdays, Sundays and Statutory Holidays. An Employee who turns down a recall offer to a position other than their own (pre-layoff) classification shall not be deemed to have lost their seniority. And additionally, in the case of a part-time Employee if: g) a part-time Employee repeatedly refuses to accept shifts offered in accordance with their stated availability h) a part-time Employee repeatedly cancels shifts without providing a reasonable explanation (it is understood that under normal circumstances, Employees must supply to the Employer at least eight (8) hours cancellation notice). i) a part-time Employee repeatedly fails without a reasonable explanation to respond to messages left by the Employer j) a part-time Employee does not work for the Employer for a period of six (6) calendar months (excluding lay-off).

Notice of recall shall be sent by Registered Mail. Business days exclude Saturdays, Sundays and Statutory Holidays (full time and regular part time employees only). (f) for relief employees, where the relief employee fails to provide her availability for a minimum 4 shift every month without providing a reason which is satisfactory to the Employer. (g) for relief employees, where the relief employee refuses to accept work or fails to work without a reason satisfactory to the Employer at least eight (8) shifts in a sixty (60) day period, that are at least eleven (11) hours apart. (h) if an employee is absent from work due to illness or injury for a period of twenty-four (24) months (this provision shall be interpreted in accordance with the Ontario Human Rights Code).

It is understood that this provision shall be interpreted in a manner consistent with the provisions of the Ontario Human Rights Code.
