SCOPE & RECOGNITION. 1.01 The Association recognizes the Union as the sole collective bargaining agent for all members of each local of the Union and all other employees, employed by members of the Association and despatched pursuant to the terms of this Agreement.
1.02 The Union recognizes the Association as the Employers’ organization which represents all Employers who are members of the Association or who during the term of this Agreement become members of the Association. The Association will not unreasonably deny membership to Employers wishing to join the Association.
1.03 This Agreement shall apply to all such persons employed and despatched pursuant to the terms of this Agreement for the performance of work in connection with the movement of inbound or outbound cargo from the time it enters or leaves the dock, or with the movement of cargo from the stow to release from conventional or other ship’s gear or vice versa, and so long as it remains at a dock and under the control of a member of the Association covered by this Agreement. Work in connection with the movement of such outbound and inbound cargo shall include the operation of stationary and mobile cargo handling devices and equipment; to or from railroad cars, trucks, trailers, other vehicles, barges or scows when any or all of the foregoing are alongside within reach of conventional or other ship’s gear and comes under the control of a member of the Association covered by this Agreement up to the point at which it is stowed in or discharged from a deepsea or coastwise vessel.
1.04 This Agreement shall apply to all members of the Association who employ and have despatched, pursuant to the terms of this Agreement, members of the Union or other persons for whom the Union is or for whom, during the term of this Agreement, the Union becomes, bargaining agent.
1.05 This Agreement shall not apply to foremen nor to supervisory, office or clerical personnel, who are employed by members of the Association.
1.06 It is the intent and responsibility of the Parties that each will police the terms and conditions of this Agreement in accordance with its spirit and intent. The Parties agree that there will be no agreements made by any person bound by the terms of this Agreement which are contrary to its terms and conditions or its spirit and intent.
1.07 With respect to the operation of leased mobile cranes it is agreed that the existing practices will continue in effect unless changed by the Parties.
SCOPE & RECOGNITION.
1.1 The general purpose of this Agreement is to establish and maintain the collective bargaining relations between the Employer and its Employees represented by the Union and to establish and maintain matters covering working conditions and rates of pay and to provide procedures for the prompt and equitable disposition of grievances. This Agreement constitutes the entirety of the agreement between the parties.

2.1 This Agreement shall apply to all full and part-time teachers, a person who performs substantial teaching responsibilities (and also holds an administrative position such as Vice Principal in relation to such teaching responsibilities), Conseiller pédagogique, Co-ordinator for French Examinations, Co-ordinator- for Supervision of Extended Essays, Extended Essay Coordinator, Level Co- ordinators, Guidance counsellors, Librarian, Learning Strategist, Assistant for Language Laboratory, Psycho-Educational Consultants, Student Affairs Coordinators, Coordinator of Curriculum and Professional Development, Primary Curriculum Coordinator, Senior Teachers, Mentors, Athletic Directors, Supernumerary and Long term Occasional Teachers, Replacement Teachers, Department Coordinators, Curriculum Leaders, Year Leaders, CAS Coordinators, Teachers Responsible for IT Integration and retired employees hired on a contract basis pursuant to Article 11.06 at Metropolitan Toronto and Mississauga (West Campus), save and except Head, Assistant Head, Principals, Director of Primary Studies, Director of French Studies, Director of Curriculum, Xxxx of Student Affairs, Consulting Psychologist, Short term occasional teachers, Branch Supervisors, persons above the rank of Branch Supervisor and persons solely engaged in a clerical, administrative or support capacity
a) For the purpose of clarity:
i) Child-care staff, lunchroom supervisors, surveillants and the like shall be deemed to be excluded from the bargaining unit as persons solely engaged in a support capacity and;
ii) A person who performs substantial teaching responsibilities and also holds an administrative position such as Vice-Principal shall be deemed to be excluded from the bargaining unit in relation to such administrative position but not in relation to such teaching responsibilities. Insofar as a person referred to in this Article 2.2 has substantial teaching responsibilities, such person shall be required to adhere to the Employer's standards of confidentiality, conflict of interest, etc. A person referred to in this Article 2.2 shall in any event not be eligible for election to the executive of the Alliance; provided that if any such person holds such a position or seeks such a position, there shall be no right or remedy on the part of the Alliance or any other person against the Employer.

SCOPE & RECOGNITION. 2.1 The Employer recognizes and agrees that the Union is the sole and exclusive bargaining agent for all employees in the bargaining unit defined by the Canada Industrial Relations Board in its Certificate issued February 7, 2005. The Employer and the Union have agreed that, further to the CIRB Certificate, the following positions are excluded from this Agreement: Employees in the ZoomerMedia Limited Information Technology department including Systems Analysts and Help Desk Technicians and the ZoomerMedia Limited Sales Research Department; Manager, Mosaic Screening; Vice President Original Content; Creative Director; Post Production Manager; Producer; Videographer; On-Air Talent.
2.2 The Employer and the Union agree that there will be no intimidation, discrimination, interference, restraint or coercion exercised or practiced by either of them or their representatives or members because of an employee’s membership or non-membership in the Union or because of activity or lack of activity in the Union.
2.3 The Employer shall notify the Union of any newly created position(s) or classification(s) including positions or classifications for which it claims an exclusion from the bargaining unit. This notice shall be given within seven (7) calendar days of the creation of the position or classification and where the Employer seeks to exclude the position(s) or classification(s) from the bargaining unit, the notice shall include the reasons for the exclusion. In the event the Union disputes the proposed exclusion, the parties will meet within seven (7) calendar days of the Union being notified. Should the parties fail to reach agreement on any proposed exclusion, this matter shall become the subject of a grievance and may be referred to binding arbitration as per the provisions of this Agreement.
SCOPE & RECOGNITION. 2.01 This Agreement shall apply to all employees of the Employer in the cities of Cambridge, Brantford and Waterloo, the towns of Dunnville and Haldimand and the townships of Centre Wellington, Mapleton, Guelph/ Eramosa, East Luther Grand Valley, North Dumfries, and County of Xxxxx save and except managers, persons above the rank of manager, professional and graduate engineers employed in an engineering capacity, office and clerical employees, students employed during the school vacation period and employees employed pursuant to Section 25 of the Employment Insurance Act.
2.02 The Employer recognizes the Union as the sole collective bargaining agent for all employees of the Employer in the bargaining unit defined above.
SCOPE & RECOGNITION. The scope of this Agreement as it applies to each individual Employer shall be the extent to which the Local Union, party hereto, has established a collective bargaining relationship with that Employer and the extent to which that Employer employs Employees within the scope of such bargaining relationship, and the extent to which the Employer is engaged within the trade jurisdiction set out in the registration certificate held by the Employers' Organization party hereto. It is agreed that notwithstanding the consolidation of Local (Red Deer), Local (Lethbridge), and Local (Medicine Hat) into Local (Calgary), and Local into Local (Edmonton), and whose territorial jurisdiction was defined in the Collective Agreement pursuant to [then] Registration Certificate No. the collective bargaining relationship with the expanded Locals and shall be in respect to those territories as were affected by collective bargaining relationships with the respective Local Unions and as formerly defined in the Collective Agreement. Notwithstanding any other provisions herein, maintenance, service and repair work incidental thereto, are not included within the scope of this Agreement. The Parties agree that the terms of this Agreement do not apply to residential work, which is defined as single-family housing including duplexes, walk-up apartments and condominiums up to a maximum of three (3) floors in height. The Employer recognizes each Local Union as the exclusive bargaining agent of those Employees of the Employer for whom each Local Union has established and retained or subsequently establishes and retains the right of collective bargaining, to the extent that the said Employees are engaged in the territories and trade jurisdiction to which Agreement applies. The respective Local Unions party hereto each recognize the Employers' Organization party hereto as the exclusive representative in collective bargaining of each of those Employers who is or who becomes affected by registration certificate number to the extent that each of the said Employers is or becomes affected by the said registration certificate. SCOPE & RECOGNITION. 2.01 The Employer recognizes the Union as the exclusive bargaining agent of all employees of the Hilldale/Xxxxxxxx Retirement Living Ltd., in the City of Thunder Bay, save and except supervisors, persons above the rank of supervisors and those persons covered by Section 1(3)(b) of the Labour Relations Act. For avoidance of doubt, the parties agree that the Business and Finance Administrator is excluded from the bargaining unit.
SCOPE & RECOGNITION. 2.01 The CMHA recognizes OPSEU as the sole and exclusive bargaining agent of all employees of the Canadian Mental Health Association, Hamilton Branch, employed in the City of Xxxxxxxx, save and except directors, coordinators and persons above the rank of directors, and coordinators, employees in the Finance and Human Resources department and students funded through the Canada Summer Jobs program or working an unpaid internship as part of an academic program.
2.02 With respect to a newly created position, if the primary duties of that position are the same as those normally assigned to employees in the Bargaining Unit, the person holding that position will be deemed included in the Bargaining Unit.
