Monetary Awards. 5.1 The net funds to be made available from the FWC Qualified Settlement Fund for payment to the Claimants shall equal the amount of the FWC Qualified Settlement Fund less expenses, costs, and attorney fees permitted by the Settlement Agreement or the Final Orders and Judgments.
5.2 The net funds in the FWC Qualified Settlement Fund shall be distributed into the following Sub-Qualified Settlement Funds as follows:
5.2.1 Minor Child Sub-Qualified Settlement Fund–64.5% of the net funds in the FWC Qualified Settlement Fund;
5.2.2 Minor Adolescent Sub-Qualified Settlement Fund–10% of the net funds in the FWC Sub-Qualified Settlement Fund;
5.2.3 Minor Teen Sub-Qualified Settlement Fund–5% of the net funds in the FWC Qualified Settlement Fund;
5.2.4 Future Minor Sub-Qualified Settlement Fund–$35,000,000 to be taken on a prorated basis from the total amount allocated to the Minor Child, Minor Adolescent, and Minor Teen Qualified Settlement Funds;
5.2.5 Adults and Property Damage Sub-Qualified Settlement Fund–18% of the net funds in the FWC Qualified Settlement Fund (15% for Adult Claimants and 3% for Property Damage Claimants);
5.2.6 Business Economic Loss Sub-Qualified Settlement Fund– 0.5% of the net funds in the FWC Qualified Settlement Fund; and
5.2.7 Programmatic Relief Sub-Qualified Settlement Fund–2% of the net funds in the FWC Qualified Settlement Fund.
5.3 The Settlement Amount for each Sub-Qualified Settlement Fund shall be distributed to provide the Monetary Awards established for each Settlement Category set forth on Exhibit 8. Each Claimant assigned to each Settlement Category (excluding Settlement Category 27B) shall receive the same net Monetary Award, subject to any deductions for lien obligations owed by the Claimant as set forth in Article XV–Liens. Claimants assigned to each identified age group in Settlement Category 27B shall all receive the same gross Monetary Award, subject to any deductions for lien obligations owed by the Claimant as set forth in Article XV-Liens and payment of attorneys’ fees and expenses subject to Section 5.4. Such attorneys’ fees may be subject to a common benefit assessment if so ordered by the Court.
5.4 If the McLaren Defendants do not exercise the right to rescind, terminate, or cancel their participation in the Settlement Agreement as set forth in Paragraph 18.2 or Article XVII-Rescission, common benefit assessments, attorneys’ fees and expenses to be paid by Claimants assigned to Settlement Category 27B shall be...
Monetary Awards. If a grievance is sustained, the aggrieved party shall be paid for financial loss, as determined in the final disposition. No claim for back wages shall exceed the amount of wages the employee would otherwise have earned at the regular rate and any wage settlement will be reduced by income earned from other sources.
Monetary Awards. The Arbitrator may make an order awarding an amount of money for:
6.3.1. A complete or partial refund of the cost of repairs to Your Vehicle where those repairs have clearly been identified as all or part of Your Claim;
6.3.2. A refund of reasonable and documented expenses not to exceed $1,000 (inclusive of applicable taxes) incurred prior to the date of the hearing for vehicle rentals, accommodation, towing, taxis and weigh scale fees that established eligibility under section 4.3.1;
6.3.3. A complete or partial refund not to exceed $500 (inclusive of applicable taxes) for diagnostic testing of Your Vehicle done prior to the date of the hearing; and
6.3.4. A reimbursement not to exceed $200 (inclusive of applicable taxes) incurred by You for the removal and/or reinstallation of an Aftermarket Part that was removed pursuant to section 5.5 where the Arbitrator has determined the Claim or allegation was not an Aftermarket Part(s) Issue.
Monetary Awards. Any monetary award of the arbitration panel shall be made and payable in U.S. Dollars. Any such monetary award shall accrue interest at the maximum rate allowed under the law of which governs this Agreement, from the date of the notification of the dispute in accordance with Exhibit D to the date when the award is paid in full.
Monetary Awards. Any damages or other monetary awards recovered shall be allocated first, to the costs and expenses of the Party bringing suit, and the costs and expenses, if any, of the other Party. Any amounts remaining shall be allocated as follows: (i) in accordance with the allocation of Profits and Losses if the Parties have entered into a Joint Commercialization Agreement, or (ii) to the Party bringing the suit, which amounts shall be treated as Net Sales of Products or Net Sales of Other Products subject to the applicable royalty obligations set forth in this Agreement. A settlement or consent judgment or other voluntary final disposition of a suit under Sections 8.4(b) or (c) may not be entered into without the prior written consent of the Party not bringing the suit.

Dollar amounts are determined by the value of benefit and application of the contribution to the Forest Service mission or goals. Nonmonetary awards can be given in conjunction with monetary recognition. Types of monetary awards include extra effort, spot, gain sharing, and suggestions.

Special Contribution Awards The special contribution award is a special act or service award which recognizes individuals or groups for major accomplishments or contributions which have promoted the mission of the organization. Award amounts should be linked to the significance and impact of the accomplishment or contribution. A special contribution award may be made to an individual employee or to a group. A group may consist of individuals from a single organization or multiple components/offices/units. Instant Awards This is a special act or service award given to an employee for noteworthy contributions or accomplishments in the public interest which are connected with or related to the recipient’s official employment. The distinction between a special contribution award and an instant award rests in the relative significance of the contribution or accomplishment. Suggestion Awards The Department will encourage employees to file suggestions under the Department’s Suggestion Program. Suggestions will be considered in a fair and equitable manner. Suggestion awards will be appropriate for tangible suggestions, intangible suggestions, and problem identification, as defined in the Department’s Suggestion Program. In the event no decision is made regarding adoption or non-adoption of a suggestion within 90 days of submission, the employee, upon request, will be given a written or oral status report. Non-adoption of employee suggestions is to be written and contain specific reasons for non-adoption. If the idea set forth in a rejected suggestion is later adopted, the appropriate suggestion coordinator will reopen the case for award consideration if the matter is brought to their attention within two years after the date of rejection notice.
Monetary Awards. 1. Quality Step Increase (QSI). A pay increase that provides faster than normal progression within grade steps for permanent General Schedule (GS) employees. A determination to grant a QSI should be made as soon as practicable after a rating of record is approved. The employee's current rating of record is the basis for a QSI. To be eligible, the employee must achieve an overall rating of Outstanding (level 5) or equivalent on their Employee Performance Appraisal Plan (EPAP) and display outstanding performance that is expected to continue. A brief specific example of how expectations were exceeded for each element must be provided in the justification. Only one QSI may be granted in a 52-week period. QSI is recommended by the immediate supervisor or rating official, and are approved under appropriate bureau delegations.
Monetary Awards. (a) Any monetary award shall be made in Dollars and shall be payable free of any Tax, withholding, deduction or offset. If a party is required to withhold or otherwise account for any such Tax, withholding, deduction or offset, such party shall:
(i) pay and bear such Tax, withholding, deduction or offset; and
(ii) ensure that the other party receives an amount equal to the amount of such award without deduction for any such Tax, withholding, deduction or offset.
(b) If a party (the “First Party”) makes a Tax deduction in respect of a monetary award payment to the other party (the “Second Party”) and a corresponding Tax payment to any taxing authority or Governmental Authority and the Second Party has obtained a refund of such Tax payment, or used such Tax payment as a credit against its Tax liabilities, then the Second Party shall reimburse the First Party the amount of such Tax payment as will leave the Second Party (after such reimbursement) in no better or worse position than it would have been in had no Tax payment been required.
(c) An Arbitral Tribunal shall include pre-award and post-award interest (including compound interest) at commercial rates from the date of any breach until the date such award is paid in full, including interest due. Any costs, expenses and fees incident to enforcing any award (including attorney’s fees) shall, to the maximum extent permitted by the Applicable Law, be charged against the party against whom such enforcement is sought.

The distinction between a special contribution award and an instant award rests in the relative significance of the contribution or accomplishment.
5.3 Good Ideas Awards. USMEPCOM will encourage employees to file suggestions under USMEPCOM’s Good Ideas Awards Program. Good Ideas will be considered in a fair and equitable manner. Good Ideas awards will be appropriate for Good Ideas that improve upon business operations or functions performed across USMEPCOM. The USMEPCOM Good Ideas Awards Program will comply with the requirements of USMEPCOM Policy Memorandum 2-1, Guidance for Submission of “Good Ideas”. Any future changes to the policy memorandum will be negotiated by the Parties.
