New or Vacant Positions. Unless provided otherwise in this Agreement, the staffing provisions in this Article apply to any new permanent position, any vacant position, or any temporary or term position of more than twelve (12) months duration, falling within the bargaining unit covered by this agreement.

New or Vacant Positions. The Employer may create a new position or change an existing vacant position which will require an employee(s) to work at more than one (1) site within the Regional Health Authority.
New or Vacant Positions. Where the Employer's operations require work weeks other than Monday to Friday or hours of work other than the standard hours for a classification, such adjustments shall be for bona fide business reasons and be by mutual consent between the Employer and the Union and such consent by the Union shall not be unreasonably withheld. Such adjustments shall be reflected in a Letter of Understanding between the parties.
New or Vacant Positions. (1) For new or vacant positions, the Employer shall be able to determine the start and stop times, days of the week and shift schedules provided that: (a) the establishment of the start and stop times, days of the work week, and shift schedules shall be based on bona fide business reasons; (b) new and vacant position(s) shall be established on an alternate work schedule such as Earned Days Off, nine day fortnight, a four day work week or on the Park Board flexible scheduling system; (c) the existing daily and weekly hours normally recognized for the classification of the position shall be used; (d) non-standard shift start times and days of the week shall be included in the job posting prior to the position being filled; and (e) split shifts shall not be created. (2) Upon filling the position on a regular basis, Sections A, B and C of Clause 11.1 shall apply. (3) Where the Employer intends to establish new positions on or convert existing vacant positions to non-standard hours, the Employer further agrees that: (a) the Union will be provided with at least fifteen (15) working days prior notice of the proposed hours of work for the positions so as to afford the Union reasonable opportunity to consider them and make representations with respect to changes to the proposed non-standard hours; (b) any applicable premiums currently provided for in the Collective Agreement will be reviewed at that time; (c) this provision will not be used to revert positions from the EDO system or a compressed work week back to a five day week; and (d) the Hours of Work Umpire, is not bound to accept an Employer argument that the hours of work of existing employees should be altered simply because one or more new or vacant positions have been established on a non standard basis (see Section B – Formal Change to Hours of Work of the Letter of Understanding on Hours of Work dated 1995 November 16).

New or Vacant Positions. 20.4.1 When a new position is created or an existing position becomes vacant, the District shall, prior to filling the position, give first consideration to those unit members with transfer requests on file, provided that the unit member meets the established qualifications for the vacant position. If the transfer is denied, the unit member will participate in the interview process for further consideration. 20.4.2 Unit members who are denied a transfer shall be notified within five (5) working days after recruitment is completed and may request a meeting with Human Resources to discuss the reasons for denial. The final selection is within the sole discretion of the District.
New or Vacant Positions. 10.01 New Positions Although the Board has the sole right to create or to designate a new position which comes within the scope of this Agreement, it is agreed that the salary and the additional allowance for such a position shall be arrived at by consultation with authorized representatives of the Local before the new position is advertised or the appointment is made. 10.02 Vacant Positions 10. 02.01 Where a vacancy or new position occurs in the elementary teaching staff, it shall be posted electronically for a period of four (4) working days before the vacancy shall be advertised elsewhere in order that qualified Teachers within the system shall have the first opportunity to submit applications for the position as posted on the approved form (see Appendix B – Posting Template). If the vacancy or new position is a term position (such as a coordinator/consultant), the length of the term shall be stipulated in the posting.
