Nine Day Fortnight. 8.1.5.1 Technical Staff, Assistant Instructors and Faculty Employees who have no assigned student contact hours may, with the agreement of the Union and the Manager, arrange their hours so as to result in a nine-day fortnight. 8.1.5.2 When establishing the hours of work, the Employees concerned and the Manager shall be guided by the following: 8.1.5.2.1 Service shall not be diminished or diluted; 8.1.5.2.2 A three (3) month trial period shall be implemented; 8.1.5.2.3 If either party, at the end of the three (3) month trial period, deems that the nine-day fortnight has diminished or diluted service, then the nine-day fortnight shall be abandoned. Hours of work will then be as before the trial period. 8.1.5.2.4 Any nine-day fortnight system which has passed the trial period above shall be subject to reassessment once each academic year thereafter. Continuance of the system is contingent upon service being maintained at appropriate levels.

Nine Day Fortnight. 12.2.1 Application of the nine day fortnight system must not produce any additional cost, (i.e. overtime, additional staffing requirements or fringe benefit costs) or noticeable reduction in service from the level of service rendered as at the commencement of the term of this Agreement.¹ 12.2.2 Employees will work 7-3/4 hours each regularly scheduled work day in every 2 week period. 12.2.3 A year is defined as a calendar year and divided into 26 fortnight periods. 12.2.4 Employees are entitled to a maximum of 24 fortnight days off in each year. There will be 2 biweekly periods each year in which no fortnight days off will be scheduled. 12.2.5 Employees on the fortnight system for less than 26 bi-weekly periods in a year will have their fortnight days off prorated. For example, employees on the fortnight system for 22 bi-weekly periods will receive 20.3 fortnight days off. 12.2.6 The biweekly periods in which there are no fortnight days off may normally be scheduled at a time that takes into consideration the needs of the department and the desires of employees. The preferred periods, if other periods have not been agreed to, are the biweekly periods overlapping Christmas and Easter. 12.2.7 Scheduled days off, one every two weeks, will preferably be Monday or Friday, or any other day taking into consideration the commitment of the College, the needs of the department and the desires of the employees. 12.2.8 Overtime rates will apply for authorized work performed in excess of 7-3/4 hours per day, excluding time worked when making up time owed by employees. 12.2.9 Supervisors will post work schedules for employees. 12.2.10 Supervisors are responsible for keeping accurate records of employee overtime and time owed to and by employees. 12.2.11 Neither acting capacity nor shift differentials will be paid if the higher level of work performed or hours of work are directly due to the nine day fortnight. 12.2.12 Gratuity days are earned as 7 hour days (Article 14.6

Nine Day Fortnight. 2.1 The nine-day fortnight is: (i) available to all full-time permanent employees; (ii) not available during probationary periods. 2.2 The day not worked in a nine-day fortnight is a rostered day off ("RDO"). 2.3 Those electing to work a nine-day fortnight shall work 7 hours 37 minutes per day with a lunch period of 53 minutes per day (the lunch period to be taken between 12.07pm and 1pm, 1.07pm and 2pm or, if applicable, 12.37 to 1.30 pm). 2.4 The hours worked shall commence either at 8am, 8.30am or 9am and conclude at either 4.30pm, 5pm or 5.30pm respectively. 2.5 Allocations of days off shall, over a four-weekly period, be on the basis of 1 day mid-week and the other end-on to a weekend, subject to change with the consent of the appropriate Assistant General Secretary ("AGS") or the Employee Relations Coordinator, plus relevant staff or in emergency circumstances subject to the consent of the staff member concerned. 2.6 An employee who takes one day or more of annual leave during a nine-day fortnight shall not be entitled to a rostered day off in that fortnight. 2.7 Employees taking leave of 1, 3 or 5 weeks' duration will not be entitled to work the nine-day fortnight one of either the week prior to or following the completion of such leave commences. 2.8 Sick and FACS leave shall be calculated on the basis of 7 hours 37 minutes per day. An employee taking any of these types of leave during a 9-day fortnight is still entitled to the RDO. 2.9 Should an employee take sick leave, or any combination of the leave described in the foregoing clause, for a period of 10 days within that two-weekly block then sick leave will be calculated on the basis of normal hours, ie. 7 hours per day, and the employee will not be entitled to a day off.
Nine Day Fortnight. 3.7.1 In those Districts where the majority of employees work a 9 day fortnight all new employees and existing employees will maintain an entitlement to a 9 day fortnight (if the effected employee in the District wishes to change from a 19 day month to a 9 day fortnight). 3.7.2 During the life of the agreement, sites working other than a 9 day fortnight may seek to have their work pattern altered to a 9 day working pattern: (a) following meaningful consultation; and (b) where this is agreed between the employer and the majority of affected employees; and (c) if it is operationally feasible to do so. 3.7.3 Operational feasibility may be assessed by agreeing to trial a different pattern of work for a set period of time. In such circumstances evaluation criteria must be agreed prior to the commencement of any trial.
