Overtime and Time off in Lieu (TOIL) / Te Wā Tāpiri me te Wā Nama ki te Kaimahi 12.1 Overtime is any time worked in excess of the ordinary hours of 40 hours per week or 8 hours per day, unless arrangements to work an extended number of hours in a day were made in accordance with clause 11.4 or clause 20 applies. Overtime shall be calculated on a daily basis except where clause 20 applies. 12.2 All overtime is voluntary, must be authorised by the employee’s immediate supervisor / manager, and shall be paid at the rate of time and half. Both the employee and the manager are responsible to ensure that the employee is not working so many hours that might amount to a risk to health and safety. 12.3 For the purposes of this clause ordinary hours shall include hours taken as leave as 12.4 Paid overtime will normally only be applicable for employees below Band H. Employees in Bands H and above will be eligible for TOIL, as described below. In exceptional cases, overtime may be paid to employees in higher bands, but such an exception will need to be signed off by the relevant Tier 3 manager. 12.5 The employee and their manager may also agree for the employee to accrue time off in lieu instead of paid overtime. Such an agreement will have to be made in advance of the time worked. Time off in lieu shall be accrued on an hour for hour basis. 12.6 All time off in lieu accrued must be recorded through the payroll system and shall be taken within 3 months of accruing. TOIL may be paid out at the appropriate rate before the expiry of the 3 month period, by agreement. 12.7 However, the manager and the employee may mutually agree to extend the time frame within which it must be taken. Any such agreement shall be recorded in writing and advised to the payroll department. 12.8 In the event that the parties agree that the time in lieu cannot be taken within the three (3) months or the longer timeframe agreed, the accrued time shall be paid out at overtime rates. 12.9 Emergency work and call out shall be paid in accordance with Clause 13 below.

  • Place and Time The closing of the sale and purchase of the Shares (the “Closing”) shall take place at the offices of Xxxxx Xxxxx & Associates, PLLC, 0 Xxxxx Xxxxxxx Xxxxxx, Xxxxxxxxx Xxxxxx, X.X. 00000 on such date (the “Closing Date”) and time as the parties shall so agree. Except as agreed to by the parties, the Closing shall occur simultaneous with the execution and delivery of this Agreement.

  • Date and Time The provisions of Section 6.3 are subject to any cut-off date and cut-off time agreed between the applicable Novation Netting Offices and Matched Pair Novation Netting Offices of the Parties.

  • Crib Time (i) When an Employee is required to work overtime after the usual ceasing time for the day or shift for two hours or more, he/she shall be allowed to take, without deduction of pay, a crib time of twenty minutes in duration immediately after such ceasing time and thereafter, after each four hours of continuous work, he/she shall be allowed to take also, without deduction of pay, a crib time of 30 minutes in duration. (ii) In the event of an Employee remaining at work after the usual ceasing time without taking the crib time of twenty minutes and continuing at work for a period of two hours or more, he/she shall be regarded as having worked twenty minutes more than the time worked and be paid accordingly.

  • Sick Time An employee shall have all of his/her accrued sick leave credits transferred when the employee is transferred to a different State agency.

  • Overtime and Compensatory Time Overtime work shall be compensated as follows: A. Hours in an active pay status in excess of forty (40) hours in any calendar week shall be compensated at the rate of one and one-half (1 1/2) times the total rate of pay, as defined by Section 43.01, for each hour of such time. Total rate of pay includes the base rate plus longevity, all applicable supplements, and shift differential where applicable. B. An employee may elect to take compensatory time off in lieu of cash overtime payment for hours in an active pay status more than forty (40) hours in any calendar week. Such compensatory time shall be granted on a time and one-half (1 1/2) basis. C. The maximum accrual of compensatory time shall be two hundred forty (240) hours and compensatory time must be taken within one (1) year of its being earned. D. When the maximum hours of compensatory time accrual is rendered, payment for overtime work shall be made in cash. Compensatory time not taken within one (1) year shall be paid in cash to a maximum of eighty (80) hours in any pay period. E. Compensatory time is not available for use until it appears on the employee’s earnings statement and on the date the funds are made available. F. Upon termination of employment, an employee shall be paid for unused compensatory time at a rate which is the higher of: 1. The final total rate received by the employee, or 2. The average total rate received by the employee during the last three (3) years of employment. For the purposes of this Article, active pay status is defined as the conditions under which an employee is eligible to receive pay, and includes, but is not limited to, vacation leave and personal leave. Sick leave and any leave used in lieu of sick leave shall not be considered as active pay status for purposes of this Article. Compensatory time requests must be submitted in writing twenty-four (24) hours in advance of the anticipated time off, unless the need for time off is of an emergency nature.

  • Overtime for Part-Time Employees ‌ (a) A part-time employee working less than the normal hours per day of a full-time employee, and who is required to work longer than their regular workday, shall be paid at the rate of straight-time for the hours so worked, up to and including the normal hours in the workday of a full-time employee. (b) A part-time employee working less than the normal days per week of a full-time employee, and who is required to work other than their regularly scheduled workdays, shall be paid at the rate of straight-time for the days so worked up to and including the normal workdays in the workweek of a full-time employee. (c) Overtime rates shall apply to hours worked in excess of (a) and (b) above.

  • Overtime Meals When employees are required to work more than two (2) hours beyond their regular work days, the Employer will provide hot meals at no cost to the employees, up to a maximum of sixteen dollars ($16.00) (receipts to be submitted) plus paid meal periods of one-half (1/2) hour at the prevailing rate and thereafter at four (4) hour intervals. Any early morning start before regular starting time is entitled to a paid meal. The breakfast limit is thirteen dollars ($13.00) (receipts to be submitted).
