PAI D HOLIDAYS. Days to be as paid holidays during the year shall be New Year’s Day, Good Friday, Easter Monday, Victoria Day, Canada Day, Civic Day, Labour Day, Thanksgiving Day, the day immediately before Christmas Day, Christmas Day, Boxing Day, and the day immediately before New Year’s Day or the day which may be observed as the effective paid holiday for any of such days and in addition to the above, any additional holiday which may be proclaimed by the Governor General or Lieutenant Governor in Council. NEW In order to qualify for payment of the Paid Holidays outlined in Article employees work both the day before and the day after such Holidays (or those days as the effective Paid Holidays). However, Employees who are not at work on said days will be deemed to qualify for Holiday pay, for reasons including but limited to Union Leave, Bereavement Leave, long term illness, short term illness (with a Dr’s note), Training, Vacation (including Lieu time), Jury Duty, Injury (whether or not it is compensable under and/or a regularly scheduled day off those Employees who are not at work on said days will be deemed to qualify for Holiday When any of the paid holidays listed falls on a Saturday or a Sunday and should any other day not be observed as the effective paid holiday by statute, a day off in lieu of for non-shift employees will be designated to fall within the previous week or the following week contiguous to the weekend. The designated days, if any, will be posted by January in each year. When a paid holiday or the day which may be observed as the effective paid holiday falls within the vacation of the non-shift employee, such paid holiday shall not be counted as vacation but shall be allowed to the employee at a time satisfactory to Management. For each of the paid holidays or those days observed as the effective paid holiday all shift employees who work such paid holiday shall either: Receive a days pay of eight hours at the regular hourly rate and, in addition, receive payment for the hours worked at a rate two times the regular hourly wage or Take a lieu day of eight hours off with pay (at the regular hourly rate) at a time mutually agreed upon by the employee and management and, in addition receive payment for those hours worked at a rate two times the regular hourly rate. PAI D HOLIDAYS. Nurses who qualify shall receive the following paid holidays: New Years Day Labour Day 2nd Monday February Thanksgiving Day Good Friday Christmas Day Victoria Day Boxing Day Canada Day 2nd Friday June Civic Holiday November If an additional permanent statutory holiday should be proclaimed during the term of this Agreement, such additional proclaimed holiday will replace the 2nd Monday in February specified above. The intent is that there will not be more than twelve (12) paid holidays per year for the duration of this Agreement, Holiday pay will be computed on the basis of the of hours the nurse would work had there been no holiday at her regular rate of pay. In order to qualify for holiday pay a nurse must work her full scheduled shift immediately preceding and immediately following the holiday except where the nurse is absent due to illness or approved leave of absence. If the nurse is absent on a paid holiday when scheduled to work, she shall forfeit all pay for the holiday unless due to illness or approved leave of absence subject to Article A nurse who qualifies for holiday pay will be eligible for one (1) day holiday pay during any one period of illness. A nurse who qualifies for holiday pay and is absent due to illness or injury shall not also claim payment from income protection credits. Full-time nurses will be paid at the rate of one and one- half times their applicable hourly rate for work performed on paid holidays, as set out paragraph Such nurses shall also be entitled to an additional day off with pay within a period four (4) weeks on either side of the holiday. In the case of a full-time nurse who has not completed her probationary period, the additional day off with pay may be taken within a period four (4) weeks after the holiday. In lieu of this provision, the Employer and the nurse may agree that the nurse will receive an additional day's pay. Failing mutual agreement as to the scheduling of the lieu day, the Employer may schedule such lieu day or pay one pay. A nurse who i s e n t i t l e d t o a l i e u day as provided f o r i n A r t i c l e such day shall be granted within sixty (60) days after the date on which the holiday was observed, t o be taken on a day arranged between the nurse and her Immediate Supervisor. Similarly, the Hospital w i l l endeavour t o schedule nurses who are scheduled on the weekend immediately adjacent t o the holiday t o work on the paid holiday. This provision i s not applicable t o Christmas Day, Boxing Day, New Year's Day, Easter Monday and Good Friday. For purposes o f t h i s Article i n the matter o f the determining o f the time period f o r which a nurse w i l l be paid overtime premium when working on a holiday w i l l be from the commencement o f the day tour on the holiday t o the completion o f the night tour.
