PROMOTIONS AND APPOINTMENTS. 33.01 Notification of all vacant and newly created positions within and outside the bargaining unit shall be conveyed in writing to all employees so that they shall have an opportunity to make written application for such positions.
33.02 With the exception of vacancies of four (4) months or less, the promotion and/or transfer of employees to positions within and outside the bargaining unit save and except positions excluded from the collective bargaining process, shall be the result of a competition based on the following factors:
(a) skill, competence and efficiency;
(b) continuous employment with the Alliance and its Components. Where the factors in Sub-Clause (a) are relatively equal, length of continuous employment with the Employer shall govern.
33.03 If a position is identified as bilingual by the Employer, unilingual employees will be eligible to make written application, provided that an appointment to this position constitutes a promotion for the employee and provided that they undertake to become proficient in the other official language within a two (2) year period from the date on which the Employer approves the employee to commence language training. If an employee fails to meet the language requirements of the position within the above-noted two (2) year period, the employer shall make every possible reasonable effort to place the employee in a position at a classification level equivalent to the employee's former position. An employee shall be granted leave with pay for the purpose of language training and the Employer shall bear all costs associated with such training.
33.04 The Employer shall not make appointments from outside the bargaining unit to any position within the bargaining unit until the selection process, in accordance with Clause 33.02, is completed and the selection board determines that there is no qualified candidate.
33.05 A successful applicant shall be placed on probation, in accordance with Article 32, except that in the case of an employee who, in accordance with Clause 33.03, is on language training, the probationary period will terminate only when the employee has completed six (6) months of work in the position, excluding the time spent while on training.
33.06 In the event an employee is rejected on probation following a promotion, the Employer shall make every possible reasonable effort to place the employee in a position at a classification level equivalent to the employee's former position.

PROMOTIONS AND APPOINTMENTS. Employees who promote to a position in a higher pay range shall have their rate of pay adjusted to the lowest rate in the new range which is at least five percent (5%) higher than the rate in the class from which promoted.

PROMOTIONS AND APPOINTMENTS. (i) Promotion and/or appointment shall be by merit, provided however that no employee with a claim to seniority shall be passed over without having their claims considered.
(ii) In the case of an employee or employees disputing a promotion and/or appointment the Employees and the Union , or other elected representative as nominated by the employee may apply to the CEO of the Affiliated Health Organisation for determination of the dispute.
PROMOTIONS AND APPOINTMENTS.
32.01 a) Subject to the application of Article 32.10 b), all indeterminate employees shall have the right to apply for a transfer into a vacant or newly created position in the Bargaining Unit which has similar duties or skills requirements and for which the employee is qualified. On or before the date a competition poster is issued for such position, the Employer shall notify all employees of such position. Applications for transfer must be submitted to the Human Resources Section on or before the closing date of the competition as specified in the competition poster.

Classified employees who accept a position in the unclassified service in a higher pay range shall have their rate of pay adjusted to the lowest rate in the new pay range which is at least five percent (5%) higher than the rate of the class from which the employee left. The Director of Human Resources will continue to follow the established certification and interview process that assures impartial selection as previously negotiated.
PROMOTIONS AND APPOINTMENTS. 40.01 Notification of vacancies and newly created positions within the USJE shall be posted prior to the vacancies being advertised outside the USJE to ensure employees will have an opportunity to make written application.
40.02 The employer shall not make appointments from outside the USJE to any position within the bargaining unit when an employee of the USJE who has applied for the position in accordance with clause 41.01 is found qualified by a Selection Board.
41.03 Promotions and appointments shall not be the subject of arbitration.
40.04 Casual and term employees are not eligible to apply in closed competitions before they have completed six (6) months of continuous employment.
40.05 Any term employee who commences employment following the signing of this agreement and who is continuously employed for a period of three years or more in the same position shall become an indeterminate employee. A part time term employee will become a part time indeterminate employee.

Classified employees who accept a position in the unclassified service in a higher pay range shall have their rate of pay adjusted to the lowest rate in the new pay range which is at least five percent (5%) higher than the rate of the class from which the employee left. The Director of Human Resources will continue to follow the established certification and interview process that assures impartial selection as previously negotiated.
PROMOTIONS AND APPOINTMENTS. 34.01 Notification of all vacant and newly created positions within the Component shall be conveyed in writing to all employees of the bargaining unit so that they shall have an opportunity to make written applications for such positions.
34.02 The promotion of employees to positions within the Component shall be the result of a competition based on the following factors:
a) skill, competence and efficiency;
b) continuous employment with the Alliance and its Components.
34.03 The Employer shall not make appointments from outside the Component until the selection in accordance with clause 33.02 is completed and the selection board determines that there is no qualified candidate.
34.04 A successful applicant who was an employee prior to her/his new appointment within the bargaining unit shall be placed on probation for a period of three (3) months.
34.05 In the event an employee is rejected on probation following a promotion from within the UCTE, the Employer shall make every effort to place the employee in his former group and level.
34.06 The salary to which an employee becomes entitled upon appointment in accordance with clause 33.05 shall be that to which the employee would have been entitled in the former position as if the appointment to the higher position had never been made.
34.07 If the employee is required to transfer, she/he shall not be required to serve a new probationary period.
34.08 Promotions and appointments shall be the subject of arbitration.
PROMOTIONS AND APPOINTMENTS. (i) Promotion and/or appointment shall be by merit, with the use of eligibility lists in appropriate cases.
(ii) In the case of an employee or employees disputing a promotion and/or appointment the employees and the Union, or other elected representative nominated by the employee, may refer the matter to a disputes committee established under clause 26, Dispute Resolution.
(iii) Eligibility lists are intended to be used in the following manner:
(a) The employer may create eligibility lists for all base grade vacant positions.
(b) Lists to operate for six months.
(c) There should be three lists
(1) List of persons willing to perform temporary relief work at short notice;
(2) List for part-time positions;
(3) List for full-time positions;
(d) Eligibility lists should be created in accordance with normal selection criteria taking account of the following where appropriate:-
(1) Priority of employment guidelines;
(2) Merit;
(3) Placement or transfer of excess staff within the Public Health Organisation.
(a) Requests for transfer from permanent part-time and part-time to full-time or full-time to permanent part-time within the same classification within a Public Health Organisation should be done on the basis of merit.
(b) Requests for transfers within a Public Health Organisation should be done on the basis of merit.
