Reinstatement Upon Return From Leave. Upon return from FMLA leave, an employee shall be restored to the position held when the leave commenced or to an equivalent position with equivalent employment benefits, pay, and other terms and conditions of employment, provided the employee is able to perform the essential duties of the position. If FMLA leave was due to the employee's own serious health condition, prior to returning to work, the employee shall provide a certification from the health care provider that the employee is able to resume the essential duties of the position.

Upon expiration of leave, a unit member is entitled to be restored to the position of employment held when the leave commenced, or to an equivalent or comparable position. As a condition of restoration of a unit member whose leave was due to the unit member’s own serious health condition, which made the unit member unable to perform his/her job, the unit member shall obtain and present a fitness-for-duty certification from the health care provider that the unit member is able to resume work. Failure to provide such certification will result in denial of restoration.

B. As a condition of restoration of an employee whose leave was due to the employee’s own serious health condition, which made the member unable to perform their job, the employee shall obtain and present a fitness-for-duty certification on the form approved by the District from the health care provider that the employee is able to resume work. Failure to provide such certification will result in denial of restoration.

Reinstatement Upon Return From Leave. A. Right To Reinstatement Upon expiration of leave, an employee is entitled to be reinstated to the position of employment held when the leave commenced, or to an equivalent position with equivalent employment benefits, pay, and other terms and conditions of employment. Employees have no greater rights to reinstatement, benefits and other conditions of employment than if the employee had been continuously employed during the FMLA/CFRA period. If a definite date of reinstatement has been agreed upon at the beginning of the leave, the employee will be reinstated on the date agreed upon. If the reinstatement date differs from the original agreement of the employee and City of Cathedral City, the employee will be reinstated within two business days, where feasible, after the employee notifies the employer of his/her readiness to return.
Reinstatement Upon Return From Leave. Pursuant to the provisions of this Contract, when the leave of absence has expired, the Superintendent shall return the ESP to an equivalent position. The administration may require a physician's consent for reinstatement from a medical leave.
Reinstatement Upon Return From Leave. Pursuant to the provisions of this Contract, when the leave of absence has expired, the Superintendent shall return the teacher to the position occupied by any person hired to replace him/her, providing that position exists. If the teacher does not wish to return to the same/equivalent position (as stated above), he/she may request a transfer at the time that he/she notifies the Board of his/her return, and said request shall be considered in the same manner as any other voluntary transfer request under Article XVII. The administration may require a physician's consent for reinstatement from a medical leave.
Reinstatement Upon Return From Leave. An employee who returns from an injury, illness, maternity or personal leave within twelve (12) weeks of the commencement of the leave (ninety (90) days in the case of personal leaves) shall be reinstated to the same position, hours and rate of pay held before the leave began. An employee who has been granted an additional injury, illness, or maternity leave and who returns within the time period designated by the leave, may be restored to any open and available position the employee is eligible and qualified to perform. The reinstatement shall begin with the payroll period being scheduled following written notification by the employee to the Employer of the intention and ability to return to work.
Reinstatement Upon Return From Leave a. Return from health, home responsibility, parental, or family care leave (reference Section 14 C of this Article): Unit members shall have all return rights prescribed by state and federal laws relating to health or parental leaves. In cases where return rights are not specified by law, and are instead to be as established by school district rules and regulations, unit members shall be restored to the position from which leave was taken if a position is vacant when the employee returns. Otherwise, the employee shall be returned to a position as similar as practicable to the position from which the leave was taken. The above- described return rights are subject to the right of the district to reassign an employee as provided by law. Employees who are reassigned, or who are to be reassigned, may apply for other vacant positions for which they are qualified.
b. Return from all other leaves (reference 14.B of this Article): Unit members shall have the right to return to a classroom teaching position. Unit members shall also have the right to apply for vacant management positions for which they are qualified.
Reinstatement Upon Return From Leave. Upon expiration of leave, a unit 20 member is entitled to be restored to the position of employment held when the leave 21 commenced, or to an equivalent or comparable position.
