Seniority During Absences. If an employee is absent from work because of sickness, accident, layoff, or leave of absence approved by the Employer, the employee shall not lose seniority rights. An employee shall only lose their seniority in the event: 1. They are discharged for just cause and are not reinstated. 2. They resign. 3. They are absent from work in excess of one (1) working day without notifying their Employer, unless such notice was not reasonably possible. 4. After a layoff, they fail to return to work within five (5) calendar days, after being notified by registered mail to do so, unless through sickness or other just cause. It shall be the responsibility of the employee to keep the Employer informed of their current address. 5. An employee who is laid off shall not attain seniority recall rights if employed for less than three (3) months. If they are employed in excess of three (3) months, the employee shall not retain seniority rights if they are laid off and not reemployed within twelve (12) months after layoff.

Seniority During Absences. Employees will continue to accumulate seniority during absences authorized by the Company due to illness or injury, and during authorized leaves of absence in accordance with Article 7 of this Agreement.
Seniority During Absences. Employees will continue to accumulate seniority when absent due to disability. When laid off an employee will be retained on the recall list for a period of forty-eight (48) months, during which time seniority shall be accumulative for forty-eight (48) months. Seniority will also be accumulated during leaves of absence in accordance with Article VI of this Contract, and for other approved absences for other personal reasons not in excess of thirty (30) days.

(b) For full–time employees with one (1) years seniority and over – six (6) months accumulation of seniority for absence due to sickness, accident or non occupational disability. Under the provisions of this clause, it is understood that while seniority will continue to accumulate, all monetary benefits, including vacation pay, will cease after a maximum period of seventeen (17) weeks, except that the provisions of Article 10, Sections 8 (b) and (d) shall continue for a period equal to the employee’s seniority. (c) For full–time employees with forty (40) days, but less than one (1) years seniority – accumulation of seniority for absence due to sickness, accident or non-occupational disability for a period equal to one half (1/2) their seniority. Under the provisions of this clause, it is understood that while seniority will continue to accumulate, all monetary benefits, including vacation pay, will cease after a maximum period of seventeen (17) weeks, except that the provisions of Article 10, Sections 8 (b) and (d) shall continue for a period equal to the employee’s seniority. (d) Full–time employees claiming WCB – accumulation of seniority for a period equal to their seniority. Under the provisions of this clause, it is understood that while seniority will continue to accumulate, all monetary benefits, including vacation pay, will cease after a maximum period of eight (8) months except that the provisions of Article 10, Section 8 (b) and (d) shall continue for a period equal to the employee's seniority. Employees covered under the provisions of this clause shall, upon their return to work be reinstated into the position held prior to his or her absence or in the event that the job has been eliminated to one of equal rating, providing he or she is capable of performing former duties. In the case of sickness and accident, it shall be the duty of each employee so absent to notify the Company weekly of the reasons for absence and how long they expect their absence will last. Seniority During Absences. Only the first thirty (30) days of an approved leave of absence other than military or Union leave will count toward an employee’s service and seniority. Service and seniority will accrue during layoffs up to a maximum of six (6) months.
