SENIORITY - PROBATIONARY EMPLOYEES. 10.01 New Employees hired in the unit shall be considered as probationary Employees for the first ninety (90) calendar days, excluding holidays, holiday breaks and summer breaks of their employment.
10.01.01 For the purpose of interpreting the probationary period under this Agreement, ninety (90) calendar days in all departments affected by summer dismissal shall resume their accumulation at the beginning of the new school year. A probationary Employee has no union rights when disciplined or discharged for lack of ability. There shall be no seniority among Probationary Employees. Upon satisfactory completion of the probationary period, the Employee’s seniority will be computed from the first day of employment in an Unit position (this does not include time as a substitute).
10.02 The probationary time for an Employee begins on the date of hire in the unit.
10.03 Any Employee who, in the opinion of the Administration, does not satisfactorily complete his/her probationary period in the classification to which he/she has been promoted will be returned to the classification and salary from which he/she had been promoted and his/her seniority shall not be affected.
10.04 An Employee who is promoted during his/her probationary period shall be considered to have satisfactorily completed his/her probationary period in the classification from which he/she had been promoted.

12.02 Seniority shall be on a school district-wide basis within the job classification of employment in accordance within the bargaining unit.
12.03 The probationary time for an employee begins on the first day such probationary employee begins work at his/her position.
12.04 The Union shall represent probationary employees for the purpose of collective bargaining in respect to rates of pay, wages, hours of employment and other conditions of employment set forth in this agreement, except that the employer will have the right to discharge or take disciplinary action other than for union activities involving a probationary employee without a grievance filed or processed.
12.05 A substitute employee is an employee hired only to substitute for a regular employee. A vacancy shall not be filled on a substitute basis beyond a reasonable period of time to fill a vacant position.
SENIORITY - PROBATIONARY EMPLOYEES. 12.1 The district shall consider new employees hired into the unit as probationary employees for the first seventy (70) days worked. The employees' seniority shall begin tolling from their first day on the job as a bargaining unit member.
12.1.1 If the district rehires an employee, s/he shall retain experience credit on the salary schedule at the same step/level s/he was last employed by the District. Upon such return, however, the employee will not retain previously earned seniority for promotional or assignment purposes.
12.2 The Union shall represent probationary employees for the purpose of collective bargaining in respect to rates of pay, wages, hours of employment and other conditions of employment as set forth in this agreement. The discharge of a probationary employee shall not be subject to the grievance procedure.
12.3 Beginning July 1, 2007, if two (2) or more new hires begin work on the same date, the district shall distinguish their seniority order by a lottery drawing. This drawing shall be performed by the union president or his/her designee, in the presence of a Human Resources representative.
12.4 A status sheet with the name and department of a new employee assigned with date hired shall be sent to Local Four Treasurer.
SENIORITY - PROBATIONARY EMPLOYEES.
A. An employee's seniority within the bargaining unit shall be a composite of the following periods of time:
1. An employee’s present continuous period of employment in date of rank with their current contract period (either a one-hundred and eighty-nine (189) or a two hundred and fifty six (256)-day contract) is for bidding purposes only. In the case where there is more than one employee with the same date of rank, seniority will be determined by the most recent date and time stamp maintained by Human Resources
2. In the event an employee is moved due to injury, hardship, or other extenuating circumstances (agreed upon by the Chief of Police and the Union), the employee’s previous seniority will be reinstated according to time of service with the district.
3. layoff periods in job title which did not exceed twelve (12) months in duration:
4. all periods of leaves of absence which have been approved by the District.
B. An employee shall be considered probationary for the first twelve (12) months of employment in job title. During these probationary periods, any employee on probation may be terminated with such termination not subject to the grievance procedure. Employees may submit a written request to the Superintendent for the reasons for termination within five (5) days from the date the termination notice is served. The Superintendent or administrator shall provide written reason(s) for the decision to terminate within ten (10) working days of the request. The reasons shall not be publicly disclosed by the superintendent, administrator, local school board or governing authority. The reasons shall not provide a basis for contesting the decision under the School Personnel Act [22-10A-1 NMSA 1978]. The employee may be accompanied by an Association Representative.

When an employee finishes the probationary period, he/she shall be entered on the seniority list of the unit and shall rank for seniority from the original date of hire. B. The Union shall represent probationary employees only for the purpose of collective bargaining in respect to rates of pay, wages, and hours of employment. The employer shall have the right to discharge or discipline probationary employees for any reason at the sole discretion of the employer. Discipline or discharge of probationary employees shall not be subject to the grievance procedure.
C. Seniority shall be on an employee-wide basis, in accordance with the employee's last date of hire.
D. Employees with scheduled work assignments equaling 40 hours per week will be defined as full time.
E. Employees hired as part-time who work four (4) hours or less per day shall be credited with one-half (1/2) seniority credit.
SENIORITY - PROBATIONARY EMPLOYEES. A. New employees hired in the unit shall be considered as probationary employees for the first one-hundred and twenty (120) days worked of employment which excludes holidays, and days the College is closed. The one-hundred and twenty (120) days worked probationary period shall be accumulated within not more than two-hundred and forty (240) calendar days. Upon successful completion of the probationary period, the employee shall be entered on the seniority list and shall rank for seniority from the employee’s first day of work (“date of hire”). If two employees start work on the same day at the same time, the employee who accepted the employment offer first shall be the senior employee. There shall be no seniority among probationary employees.
B. The Union shall represent probationary employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment and other conditions of employment as set forth in Section 1.00 of this Agreement except discharge and discipline for other than Union activity.
C. Seniority shall be on a College-wide basis, in accordance with the employee's last date of hire for the purpose of computing all benefits. In case of layoff, the layoff procedure shall apply.
D. Probationary employees shall not be eligible for overtime unless all full time unit members in the Operational Organization have refused or are unavailable.
E. New employees will be hired at $1.00 below the applicable job rate until the probationary period is completed.

When an employee completes the probationary period, by accumulating ninety (90) calendar days of employment within not more than six (6) months, he/she shall be entered on the seniority list of the unit and shall rank for seniority from the date of assignment. Retention of probationary employees will be strictly within the discretion of the Employer. Probationary & new non-probationary employees hired after January 1, 2009 shall be paid at the wage rate set for the category as shown in Appendix- A.
B. The Union shall represent probationary employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment as set forth in Section One (1) of this Agreement, except discharged and disciplined employees for other than Union activity.
C. Seniority shall be on an Employer-wide basis, in accordance with the Employee's last date of hire.

Days on which a probationary employee is absent, will serve to extend the probationary period. When an employee satisfactorily finishes the probationary period, the employee shall be entered on the seniority list of the unit and shall rank for seniority from the employee’s date of hire. There shall be no seniority among probationary employees. Probationary employees will not receive any paid holidays, insurance (unless required by law, including the Patient Protection and Affordable Care Act), paid leave days or other benefits under the terms of this Agreement.
(b) The Union shall represent probationary employees for the purpose of collective bargaining in respect to rates of pay, wages, hours of employment and other conditions of employment as set forth in this Agreement, except discharged and disciplined employees for other than union activity.
(c) The Employer shall, upon employment, furnish the new employee with a copy of the Agreement, and any other pertinent information. The Union shall be furnished with the name, address, telephone number and job assignment of the new employee.
SENIORITY - PROBATIONARY EMPLOYEES. (a) New employees hired in the unit shall be considered as probationary employees for the first sixty (60) working shifts of their employment. When an employee finishes the probationary period, he shall be entered on the seniority list of the unit and shall rank for seniority from the day sixty (60) working shifts prior to the day he completes the probationary period.
