TEACHERS’ PERSONNEL FILES. 28.01 A teacher shall have access during normal business hours to her/his personnel file at the Catholic Education Centre upon prior written request to the Superintendent of Human Resource Services and in the presence of a Supervisory Officer or person designated by the Superintendent of Human Resource Services. The written request shall be received by Human Resource Services at least three working days prior to the proposed personnel file review. The teacher may request copies of any document contained in this file. The Board reserves the right to apply reasonable charges for copying from personnel files. 28.02 A teacher who questions the accuracy or completeness of information in his or her personnel file may provide to the Board, in writing, a rebuttal or explanatory letter that will be date-stamped and placed in the file upon request. 28.03 Where the Board exercises its discretion to amend information in a teacher’s personnel file upon receipt of and in response to the submission set out in Article 29.02, the Board will provide to the teacher a copy of the amended information. 28.04 Where a teacher gives written authorization to another person acting on behalf of the teacher, to access the teacher’s personnel file, the Board shall provide access.

TEACHERS’ PERSONNEL FILES. 1. There will be established and maintained one (1) permanent file on each teacher. The file will be maintained in the Office of the Superintendent. Building personnel files shall be maintained in the office of the building principal and shall include evaluation documentation. When a teacher is transferred from one building to another within the school district, the teacher’s building personnel file will be transferred to the new building. 2. Personnel files shall be open to inspection to the general public as required pursuant to state law. Teachers shall be sent written notification within twenty-four (24) hours of the name and address of any member of the general public inspecting and/or obtaining copies of any information contained in their personnel files, if known, and shall be furnished, at no expense, copies of the information made available to any member of the general public. 3. Teachers will be notified of the placement of any material in the file which relates in any manner to the effectiveness of his/her performance. Teachers shall receive a copy at the time it is placed in the file. Anonymous complaints or materials will not be placed in a teacher’s personnel file. 4. If and when a teacher and the Superintendent or his designee agrees that there is adequate evidence that certain material in said teacher’s file is irrelevant, inappropriate, or false, such material will be removed from the file or corrected. If the teacher and the Superintendent or his designee are unable to reach an agreement and the teacher still feels that the material contained in the file is irrelevant, inappropriate, or false, such teacher will have the right to attach a written statement to the disputed information or file a grievance concerning the dispute with action beginning at Step II. 5. A teacher will have the right to inspect his/her personnel file at any time as long as such request is during the normal working hours of the administrative office.

The file shall be maintained in the office of the Superintendent. B. Personnel files are privileged to the extent allowed by law -- open to inspection by the individual, his/her authorized representative or the Administration and Board. The individual shall have the right to inspect his/her personnel file at any time so long as such request is during the normal working hours of the administration office. A bargaining unit member shall be notified in writing by the administration, by the end of the next business day, of a request by any individual not listed above who desires access to the bargaining unit member’s file. The records custodian shall request the name of the requestor. The notice to the bargaining unit member shall include the name, if available. C. Teachers shall be notified of the placement of any materials in the file that relate to job performance, and shall be notified whenever any information is disclosed, except to persons in B. above, within three (3) working days. X. Xx and when a teacher and the Superintendent or his designee agree that there is adequate evidence that certain material in the teacher’s official file is irrelevant, inappropriate, or false, or if the validity of a complaint is sustained by the grievance procedure, such material shall be removed from the file or corrected. In any case, if a teacher feels that the file contains information that is inaccurate, irrelevant, outdated or incomplete, such teacher shall have the right to attach a written statement to the disputed information. E. Personnel files may include but not be restricted to some or all of the following: 1. Employment application 2. Copy of latest contract 3. Ohio Teaching Certificate 4. Official College Transcript 5. Incidents of work 6. T.B. test or x-ray results
TEACHERS’ PERSONNEL FILES. 5.2.1 No material referring to a teacher's conduct, service, or character shall be placed in the filestheir personnel file unless such teacher is knowledgeable of the material and is given a dated copy. 5.2.2 Upon request, teachers shall be given access to their individual filespersonnel file with 24 hours’ notice during regular business hours. Upon receipt of a written request, the teacher shall be furnished a reproduction of any material in their individual file at the expense of the teacher. No material will be removed prior to the teacher's inspection of his/her individual personnel file. Material will be removed from the files and destroyed by mutual consent of the teacher, the person responsible for the information and the Superintendent; or when a teacher's claim that it is inaccurate, untrue, or unproven is sustained, pursuant to the grievance procedure. Teachers shall have the right to attach an explanation or rebuttal to any material that they believe is unfavorable to them.
TEACHERS’ PERSONNEL FILES. No letter or report critical of the teacher’s professional performance shall be placed in a teacher’s personnel file without notice to the teacher. If the teacher so desires, he/she shall be given the opportunity to make written statement of defense to be attached to the critical statement.

TEACHERS’ PERSONNEL FILES. 14.1 Any evaluation report or other written statement of criticism may not be contained in the individual teacher's personnel or other file longer than thirty (30) days, unless such report is shown to the subject teacher and such individual has been given the opportunity to acknowledge the report either by reply or signature within the thirty (30) day period beginning with the date of the report. It is recognized that teachers have access to their personnel files under C.G.S. §10-151a, as amended. 14.2 No teacher shall be disciplined without just cause. For purposes of this contract, the lowest level of discipline which just cause applies is a written warning. Disputes regarding termination or non-renewal will be processed in accordance with applicable state statutes and not subject to the grievance and arbitration provisions set forth herein. 14.3 Any substantive, serious complaint made to the administration against a teacher or person for whom the teacher is administratively responsible, by any parent, student, other person or entity shall promptly be called to the attention of the teacher. In no case shall any anonymous complaint or other complaint of third parties not investigated by the administration be placed in the teacher's file.

TEACHERS’ PERSONNEL FILES. Any instructional employee shall be permitted to examine his/her district/building level personnel files absent specific waivers regarding pre-employment references. No other_person seeking access to a teacher’s file may see said- file without the explicit permission of the teacher. No material shall be placed in an employee’s personnel file unless that employee has been sent a copy of the material. An employee has the right to append an answer or statement to any material filed which shall be attached to the file copy. Upon request, a teacher shall be given a copy in writing of any material placed in his/her personnel file. No grievance document indicating participation in a grievance either as grievant, witness, or other participant will be entered in a teacher’s file. Complaints directed against a teacher shall promptly be called to the teacher’s attention, and the teacher shall be afforded an opportunity to reply to the same. No derogatory complaint, letter, or report shall be placed in the teacher’s file without the teacher’s knowledge and the teacher’s written acknowledgment that he or she has been afforded an opportunity to make a written statement of explanation.
