TWO CREW DUTY SYSTEM. 39.1 A two-crew duty system will operate providing for the appointment of two crews to each Vessel, one On Duty and the other Off Duty. 39.2 An Employee on Duty will receive a Duty Day for each day spent On Duty under the two-crew duty system. 39.3 Where the two-crew duty system is in place and Employees are changing out with one another, it is acknowledged that an Employee may be required to perform duties for all or part of the Swing-off day, i.e., the first Off Duty Day. To recognise this, the Employee will be paid a normal day’s pay, i.e., a Dead Day as full compensation for any work performed on the Swing-off day. Any work done after midday on the swing Off Duty day by an Employee who is signing off will be treated as a Duty Day. 39.4 The entitlement of clause 39.3 is in addition to compensation for the Swing-off day which has been paid out and is incorporated in the remuneration. 39.5 Where the two-crew duty system does not operate, or where an Employee has no relief, the Swing-off day will be treated as a Duty Day. 39.6 Where an Employee transits from one Vessel to another Vessel all time spent Off Duty will be treated as Duty Days as long as this does not involve a return to their residence. 39.7 Where in connection with a crew change an Employee spends more than two Off Duty days (which includes the Swing-off day) travelling from the Vessel, the Employee will receive a Dead Day for each additional full day spent travelling. 39.8 The Employees and/or the Union are not to make any future claims in respect to Swing off day. 39.9 From the date of approval of this Agreement, any day or part thereof spent travelling prior to the day on which the Employee joins a Vessel will be paid as a Dead Day. 39.10 Where in connection with a crew change an Employee is required at the direction of Tidewater, a client, or the government to undertake quarantining, the Employee will be paid a Quarantining Day at their Aggregate Salary rate as detailed in Clause 26. 39.11 A Quarantine Day is paid at the value two Dead Days at their Aggregate Salary rate as detailed in Clause 26 when such quarantine is in compliance with a government mandate or direction, in addition to an allowance of $110.00 per day while in quarantine for meals. TWO CREW DUTY SYSTEM. 24.3.1 A two-crew duty system will operate providing for the appointment of two crews to each vessel, one on duty and the other off duty or in transit. 24.3.2 Leave will be taken in swings of 5 weeks, with the flexibility of crew changes taking place up to one week either side of 5 weeks. 24.4 Leave in advance 24.4.1 An employee will not be required to take more than fourteen days of leave in advance unless it has been requested by the employee and agreed to by the employer 24.4.2 If an employee terminates or has their employment terminated subject to 24.4.1 the maximum repayment will be 14 days, unless the number of days in excess of 14 have been paid in advance at the request of the employee. In such case all leave in advance may be recovered.
TWO CREW DUTY SYSTEM. 26.1 A two-crew duty system will operate providing for the appointment of two crews to each Vessel, one on-duty and the other off-duty or in transit. 26.2 The “on-duty” period commences on the day the Employee joins the Vessel. The “off-duty” period commences on the day after the Employee leaves the Vessel. 26.3 The day of joining the vessel is treated as a Duty Day and the day of leaving the Vessel will be treated as a Dead Day. Any Employee still on-board past midday who is meant to depart the Vessel will be paid a Duty Day.
TWO CREW DUTY SYSTEM. 14.1. Two crew duty system will operate providing for the appointment of two crews to each Vessel, one on duty and the other off duty or in transit. 14.2. The leave accrual ratio of 1.153 days for each day of duty shall give effect to, amongst other things, annual leave of 35 days, public holidays, leave in lieu of a 35-hour week, personal/carer's leave, compassionate leave and time spent travelling in off duty time. 14.3. Any extended period off (i.e., outside of the normal swing) is to be taken at a mutually agreed time, having regard to the operational necessity of ensuring that only part of the permanent crew members in each department on the Vessel take such time off at any one time, to ensure the continued operational efficiency of the Vessel. 14.4. When proceeding on an extended period off, it is the responsibility of the Engineer Officer to ensure that they have sufficient entitlements due, to enable them to draw continuous pay up to the day of the regular crew change when they are due to re-join their Vessel. 14.5. The "on duty" period commences the day the Engineer Officer joins the Vessel. The "off duty" period commences on the day after the day the Engineer Officer leaves the Vessel. Calculations are done on the basis that the day of joining the ship is counted as a day of duty and the day of leaving the ship will be treated as a dead day. 14.6. Where in connection with a crew change an Employee spends more than one off duty day travelling to or from their Vessel, the Employee will be paid a dead day for each additional day or part thereof spent travelling to or from the Vessel. 14.7. Where an Engineer being relieved has, 14.7.1. In the previous 24 hours completed a substantial part of the 12-hour day and 14.7.2. The crew change is past midday may with confirmation, in accordance with the Company's procedures, and taking into consideration the total travel time to destination, allow for a break in the journey home. If the journey home is broken, the Engineer will qualify for a travel day. 14.8. If a Casual is terminated after each relief, then they are a 'new start' Casual when next employed and entitled to a dead day when travelling to join ship but unable to join on that day. However, if the employment is not terminated and leave is taken (not cashed-out) and the Casual still has leave remaining when they are called back to work again for the same Company, then it will NOT be a treated as a dead day. 14.9. The day of leaving the Vessel is treated as a Dead Day. 23.5 Notwithstanding the aforesaid provision in subclause 23.4, where in connection with a crew change an Employee spends more than one "off-duty" day (which does not include swing-off day) travelling to or from the Vessel, the Employee shall be paid a Dead Day for each day or part thereof spent travelling. 23.6 Any day/s spent travelling to the Vessel before joining the Vessel will be treated as a Dead Day. 23.7 Where the two-crew duty system operates and the crew members are changing out with one another, it is agreed that the payment of a Dead Day recognises that there may be a need for work to be performed on the Swing-off Day. 23.8 Where the two-crew duty system does not operate, or where a crew member has no relief, the Swing-off Day will be treated as a Duty Day and will accrue a day’s pay and a day’s leave. This subclause 23.8 does not apply to Cadets and Trainees when on board a Vessel in a supernumerary capacity.

  • Information Services Traffic 5.1 For purposes of this Section 5, Voice Information Services and Voice Information Services Traffic refer to switched voice traffic, delivered to information service providers who offer recorded voice announcement information or open vocal discussion programs to the general public. Voice Information Services Traffic does not include any form of Internet Traffic. Voice Information Services Traffic also does not include 555 traffic or similar traffic with AIN service interfaces, which traffic shall be subject to separate arrangements between the Parties. Voice Information services Traffic is not subject to Reciprocal Compensation charges under Section 7 of the Interconnection Attachment. 5.2 If a D&E Customer is served by resold Verizon Telecommunications Service or a Verizon Local Switching UNE, subject to any call blocking feature used by D&E, to the extent reasonably feasible, Verizon will route Voice Information Services Traffic originating from such Service or UNE to the Voice Information Service platform. For such Voice Information Services Traffic, unless D&E has entered into an arrangement with Verizon to xxxx and collect Voice Information Services provider charges from D&E’s Customers, D&E shall pay to Verizon without discount the Voice Information Services provider charges. D&E shall pay Verizon such charges in full regardless of whether or not it collects such charges from its own Customers. 5.3 D&E shall have the option to route Voice Information Services Traffic that originates on its own network to the appropriate Voice Information Services platform(s) connected to Verizon’s network. In the event D&E exercises such option, D&E will establish, at its own expense, a dedicated trunk group to the Verizon Voice Information Service serving switch. This trunk group will be utilized to allow D&E to route Voice Information Services Traffic originated on its network to Verizon. For such Voice Information Services Traffic, unless D&E has entered into an arrangement with Verizon to xxxx and collect Voice Information Services provider charges from D&E’s Customers, D&E shall pay to Verizon without discount the Voice Information Services provider charges. 5.4 D&E shall pay Verizon such charges in full regardless of whether or not it collects charges for such calls from its own Customers. 5.5 For variable rated Voice Information Services Traffic (e.g., NXX 550, 540, 976, 970, 940, as applicable) from D&E Customers served by resold Verizon Telecommunications Services or a Verizon Local Switching Network Element, D&E shall either (a) pay to Verizon without discount the Voice Information Services provider charges, or (b) enter into an arrangement with Verizon to xxxx and collect Voice Information Services provider charges from D&E’s Customers. 5.6 Either Party may request the other Party provide the requesting Party with non discriminatory access to the other party’s information services platform, where such platform exists. If either Party makes such a request, the Parties shall enter into a mutually acceptable written agreement for such access. 5.7 In the event D&E exercises such option, D&E will establish, at its own expense, a dedicated trunk group to the Verizon Information Service serving switch. This trunk group will be utilized to allow D&E to route information services traffic originated on its network to Verizon.

  • DRUG-FREE WORKPLACE REQUIREMENTS Contractor will comply with the requirements of the Drug-Free Workplace Act of 1990 and will provide a drug-free workplace by taking the following actions: a. Publish a statement notifying employees that unlawful manufacture, distribution, dispensation, possession or use of a controlled substance is prohibited and specifying actions to be taken against employees for violations. b. Establish a Drug-Free Awareness Program to inform employees about: 1) the dangers of drug abuse in the workplace; 2) the person's or organization's policy of maintaining a drug-free workplace; 3) any available counseling, rehabilitation and employee assistance programs; and, 4) penalties that may be imposed upon employees for drug abuse violations. c. Every employee who works on the proposed Agreement will: 1) receive a copy of the company's drug-free workplace policy statement; and, 2) agree to abide by the terms of the company's statement as a condition of employment on the Agreement. Failure to comply with these requirements may result in suspension of payments under the Agreement or termination of the Agreement or both and Contractor may be ineligible for award of any future State agreements if the department determines that any of the following has occurred: the Contractor has made false certification, or violated the certification by failing to carry out the requirements as noted above. (Gov. Code §8350 et seq.)

  • Hosted Services 3.1 The Provider hereby grants to the Customer a worldwide, non-exclusive licence to use the Hosted Services for the business purposes of the Customer in accordance with the Documentation during the Term. 3.2 The Provider shall create an Account for the Customer and shall provide to the Customer login details for that Account to enable the Customer to configure and administer the Hosted Services and enable registration of Customer End Users. 3.3 Except to the extent expressly permitted in this Agreement or required by law on a non- excludable basis, the licence granted by the Provider to the Customer under Clause 3.1 is subject to the following prohibitions: (a) the Customer must not sub-license its right to use the Hosted Services; (b) the Customer must not make any alteration to the Platform; and (c) the Customer must not conduct or request that any other person conduct any load testing or penetration testing on the Platform or Hosted Services without the prior written consent of the Provider. 3.5 The Customer shall use reasonable endeavours, including appropriate organisational and technical measures relating to Account access details, to ensure that no unauthorised person may gain access to the Hosted Services using an Account. 3.6 The parties acknowledge and agree that Schedule 2 (Availability SLA) shall govern the availability of the Hosted Services. 3.7 The Customer must ensure that all persons using the Hosted Services with the authority of the Customer or by means of an Account comply with the Terms Of Use. 3.8 The Customer must not use the Hosted Services in any way that causes, or may cause, damage to the Hosted Services or Platform or impairment of the availability or accessibility of the Hosted Services. 3.9 The Customer must not use the Hosted Services: (a) in any way that is unlawful, illegal, fraudulent or harmful; or (b) in connection with any unlawful, illegal, fraudulent or harmful purpose or activity. 3.10 For the avoidance of doubt, the Customer has no right to access the software code (including object code, intermediate code and source code) of the Platform, either during or after the Term. 3.11 The Provider may suspend the provision of the Hosted Services if any amount due to be paid by the Customer to AWS for the benefit of the Provider under this Agreement is overdue, and the Provider has given to the Customer at least 30 days' written notice, following the amount becoming overdue, of its intention to suspend the Hosted Services on this basis.

  • Hosting Services 13.1 If Supplier or its subcontractor, affiliate or any other person or entity providing products or services under the Contract Hosts Customer Data in connection with an Acquisition, the provisions of Appendix 1, attached hereto and incorporated herein, apply to such Acquisition. 13.2 If the Hosting of Customer Data by Supplier or its subcontractor, affiliate or any other person or entity providing products or services under the Contract contributes to or directly causes a Data Breach, Supplier shall be responsible for the obligations set forth in Appendix 1 related to breach reporting requirements and associated costs.
