Fixed Term Employee. (a) A fixed term employee is a person engaged for a specified period of time, or to perform a specified task or set of tasks.
(b) Unless stated otherwise, the provisions of this Agreement will apply to a fixed term employee on a pro rata basis.
(c) A fixed term employee is paid at the annual salary set out in Schedule A prescribed for the classification of the position.
(d) Unless otherwise stated, a fixed term employee can transfer unused entitlements to a new contract.
Fixed Term Employee. An employee engaged on a full-time or part-time basis for a specific term (see Fixed Term Agreements below).
Fixed Term Employee a) Employees may be engaged on a fixed-term contract for a period of at least 4 weeks with no guarantee of ongoing employment beyond that term to work on a replacement basis or for a specified period of time as full time or part time: • to replace one or more Employees who are on leave; • to undertake a specified task for which funding has been made available; • to undertake a specified task which has a limited period of operation; or • to replace an Employee whose employment has terminated after the commencement of the School Year. The period of the appointment must not exceed 12 months.
b) A Fixed Term Employee is entitled to the benefits of this Agreement on a pro-rata basis where the Employee is employed part time or where the Employee has been employed for a period of less than 12 months.
c) Before employing a Fixed Term Employee on a replacement basis, the Employer will inform the Fixed Term Employee of: • the reason for the fixed nature of the employment; • the date of commencement of the employment; • the benefits which are applicable under this Agreement; and • the rights of any Employee being replaced.
d) The termination of employment of a Fixed Term Employee will be by the expiry of the period of employment or in accordance with the appropriate notice of termination provisions in clause 29.
e) A Fixed Term Employee is not entitled to any of the following benefits under this Agreement: • notice of termination where the date of cessation of employment is stated at the time of appointment, or as per any agreed variation in writing to the fixed term or maximum term period in the contract. • redundancy provisions as stated in the NES or this Agreement.
Fixed Term Employee. A fixed-term employee is one whose employment is not intended to be permanent and with no expectation of employment beyond the period specified and in no event to exceed a period of one (1) year. No fixed-term position may be changed to a permanent position without a recruitment, but any fixed-term employee may apply for any permanent position for which a recruitment is being conducted. When such a recruitment is conducted, the announced qualifications for the permanent position shall not be expanded upon from the initial recruitment in order to tailor the position to the fixed-term employee. Fixed-term employment may be discontinued without cause, but at least five (5) working days of notice of discontinuance shall be given. Compensation for fixed-term employees shall be established in the same manner as other bargaining unit positions.
Fixed Term Employee a. A fixed-term employee shall mean an employee whose appointment falls into one of the following two types of a combination of a defined period of time and funding, as follows:
Type 1. A maximum of one year where 50% or more of the funding for the position is base funding;
Type 2. A maximum of two years where 51% or more of the funding for the position is non-base funding. For purposes of clarity see the Memorandum of Understanding “Transition to New Language Regarding Fixed Term Employees (Article 3.06)”
b. Where funding for a Type 2 fixed-term appointment is extended, the appointment of the fixed-term employee incumbent in that position may also be extended, but in no event shall that extension take the length of the appointment beyond two years.
c. Where funding for a Type 2 fixed-term appointment is extended beyond two years and the College changes the status of the position from fixed term to that of some other status (e.g. regular, seasonal) the College will follow the procedures outlined in Article 9.01, Job Postings. Alternatively, in order to maintain the incumbent in the position, the College must first obtain the written approval of the Union through Standing Committee. Such approval shall not be unreasonably denied.
d. Fixed-term employees are entitled to the same rights and provisions of the collective agreement as seasonal employees, excepting 3.05(c) and 3.05(e).
e. An employee on a fixed-term appointment shall receive those fringe benefits as outlined in Articles 26.01 or 26.02 (subject to Carrier Conditions), 26.03 and 26.04.
f. A fixed-term employee who has received two (2) consecutive (not running concurrently) appointments of six (6) months or more in duration and who receives a third appointment shall carry forward to any subsequent appointments, separated by six (6) months or less, sick days accrued during the third and subsequent appointments.
g. A fixed-term employee shall receive vacation pay on each pay cheque in accordance with Article 19.01b, except that a regular or seasonal employee on a fixed term appointment shall continue to accrue and take vacation in accordance with Article 19.01a.
Fixed Term Employee a) A fixed term employee is entitled to unpaid parental leave and the parental payment/paid parental leave in accordance with this clause, however, the period of unpaid parental leave granted shall not extend the term of the fixed term contract, nor does it guarantee renewal or ongoing employment.
b) Where an ongoing Employee is engaged on a fixed term contract for a specific role, the period of unpaid parental leave granted shall not extend the term of the fixed term contract role, unless otherwise agreed with the Employer.
c) The Employer should discuss with the Employee the impact of the unpaid parental leave period on the fixed term contract prior to the unpaid parental leave commencing.
Fixed Term Employee a. A fixed-term employee shall mean an employee whose appointment is for a defined period of time not to exceed eighteen (18) months, and is funded through non-base monies. An employee’s term may be extended beyond eighteen (18) months with the written approval of the Union Standing Committee.
b. Fixed-term employees are entitled to the same rights and provisions of the collective agreement as seasonal employees, excepting 3.05(c) and 3.05(e).
c. An employee on a fixed-term appointment shall receive those fringe benefits as outlined in Articles 26.01 or 26.02 (subject to Carrier Conditions), 26.03 and 26.04.
d. Effective August 1, 1993 a fixed-term employee who has received two (2) consecutive (not running concurrently) appointments of six (6) months or more in duration and who receives a third appointment shall carry forward to any subsequent appointments, separated by six (6) months or less, sick days accrued during the third and subsequent appointments. *
Fixed Term Employee. 8.5.1 A fixed term employee may be engaged to work on either a full-time or part-time basis:
(a) for the completion of a specified task(s) or project(s); or
