Voluntary Transfer or Reassignment. A unit member may submit a request for transfer or reassignment to the District at any time, whether or not a vacancy exists. A unit member may also submit a request for a transfer or reassignment subsequent to the posting of a vacancy notice pursuant to the posting procedure under item B (Vacancies) of this section. A transfer or reassignment request shall not be denied arbitrarily or capriciously. If a unit member’s request for a voluntary transfer or reassignment is denied, he/she shall be granted, upon request, a meeting with the administrator who denied the request to discuss the reasons for the denial. The discussion will include a professional growth plan if requested by the employee. This meeting may also, at the employee’s request, include a written list indicating the steps the employee may take to be considered for this or a similar position the next time one becomes available. Upon request, the unit member may also receive written reasons for the denial following the meeting.

Voluntary Transfer or Reassignment. A unit member may initiate a request for a transfer or reassignment at any time by submitting a request in writing to the Vice President for Academic Services or the Vice President for Student Services, as appropriate, and to the Chief Human Resources Officer. The District shall consider a unit member's request for transfer or reassignment, provided that the unit member is in good standing with the District and his/her last performance review was satisfactory. The District shall endeavor to grant a unit member’s request for transfer or reassignment if there are open existing positions at the primary work location, or in the department or division to which the unit member is requesting transfer. An open position is defined as an open full-time permanent or temporary faculty position, or sufficient work hours or units currently being taught by part-time faculty members to constitute a full-time load. If the reassignment is from a non-tenure track to a tenure-track position, the reassigned unit member will begin a tenure-track following the Modified Tenure Review Procedure outlined in Article 11.8 of this agreement. If a unit member's request for a transfer or reassignment is not granted, he or she shall be entitled to receive, if requested in writing, an explanation in writing of the reason(s) for not granting the requested transfer or reassignment.
Voluntary Transfer or Reassignment. Teachers desiring a transfer to another site, or a change in assignment to another grade level or subject area within their same site, shall be responsible for monitoring the job postings on the district’s website and applying for those positions that may interest them. The District shall post specific grade level and/or subject area positions internally, and teachers shall be afforded the opportunity to apply. Internal candidates shall receive preferential consideration to fill a posted vacancy before applicants from outside the district. As part of such preferential consideration, teachers who request an interview shall be given an interview by the appropriate administrator. In giving preferential consideration, the administrator will apply bona fide education needs and criteria and compare professional qualifications, including, but not limited to: certification, training, overall teaching experience and years of teaching experience in the affected subject and/or grade level. After consideration of all factors the administration shall recommend the candidate who he/she judges to be best suited to positively impact the academic success of the students and the mission of the District. Internal candidates who do not subsequently receive the position for which they interviewed, may request in writing, and then shall receive in writing the reasons they were not selected for the position. Voluntary Transfer or Reassignment. 12-2.1 Unit members who desire a transfer shall file an application with the Human Resources Department by May 15 for the following year’s placement and such application will remain active and on file for twelve (12) months or as designated by the employee.
