ACCIDENT REVIEW BOARD. An accident review board will review all bus related accidents once per month. The accident review board will consist of the following: a) driver involved, b) an ESPM representative, c) Transportation Director or Assistant Director, d) Law Enforcement Officer, and e) District Safety Officer. The Accident Review Board may recommend that drivers involved in an accident which could have been avoided by the driver will attend a mandatory four-hour driver improvement in-service without pay. Mandatory post-accident drug testing shall be implemented for bus drivers.
ACCIDENT REVIEW BOARD. All accidents involving board vehicles, machinery or equipment shall be reported immediately and shall be reviewed by an accident review board. A reportable accident is any accident involving a Board vehicle, equipment or machinery which results in property damage and/or personal injury regardless of who is injured or what property is damaged, to what extent or where it occurs, regardless of who is responsible. The accident review board shall be composed of six (6) members as follows: three (3) management representatives selected annually by the Superintendent or designee from the various school operations, one (1) representative from the 568 Local and two (2) representatives from the 205 Local. Each bargaining unit representative shall be elected annually by the respective bargaining unit membership from those members who have completed at least one (1) year of accident-free and citation-free driving. The board shall meet as necessary if there are accidents to review. Following a thorough review of the accident report prepared by the driver or operator of the Board vehicle, machinery or equipment and other such evidence as the accident review board deems appropriate, the accident review board shall render a determination regarding the ability to avoid the accident on the part of the driver or operator. The accident review board's determination of the ability to avoid the accident shall be based upon whether any reasonable act on the part of the driver or operator could have been performed that might have avoided the accident. The accident review board shall also make recommendations for such preventive measures which could have avoided the accident. The accident review board's findings and recommendations shall be reduced to writing with copies forwarded to the employee, the employee's supervisor, the employee's personnel file and the Superintendent or designee. The findings and recommendations of the accident review board shall have no bearing on any disciplinary proceeding under Article 28.
ACCIDENT REVIEW BOARD. The process of the Accident Review Board shall continue and amendments in the process shall be implemented as agreed between the parties and indicated in General Order 26.5, issued by the Chief of Police on 3/1/98 and attached herein as Appendix G. This process shall be reviewed on a continual basis and changes in the process may be made, subject to approval by the Chief of Police, provided that the parties agree to the proposed changes.

ACCIDENT REVIEW BOARD. The Accident Review Board shall contain an equal number of Union and non-bargaining unit employees. The Union side shall consist of five (5) voting members; three (3) from transportation and two (2) from Facility Operations. Unit members from the Automotive Garage shall be placed with the Transportation Department for this Article. These members shall serve on a rotating two (2) year term. Positions shall be filled from a sign up list, and prospective candidates shall be chosen at random. Members will be paid for all time while serving on this committee as long as members of the Board are not replaced by substitutes. In the event a Board member must be replaced with a substitute, the Board will reconvene at a later date.
ACCIDENT REVIEW BOARD. (a) There shall be an Accident Review Board to review vehicular accidents involving police vehicles. The Accident Review Board shall be composed of two (2) officers appointed by the Lodge and two (2) officers appointed by the Chief. The Chief shall appoint a commander to be the chairman, who shall vote only in case of a tie. Board members who are off-duty at the time shall be compensated at the overtime rate of pay during their attendance at Accident Review Board hearings. The respective members of the Accident Review Board shall be appointed effective January 1 of each year and shall serve for one (1) year. Officers who are involved in vehicular accidents while operating department-owned vehicles may be interviewed about the facts of those accidents by employees or agents of the insurance company insuring such vehicles. Such interviews shall be conducted at a reasonable time and place. Nothing in the interviews, and no statements prepared as a result of those interviews, shall be used by the department in any manner in seeking discipline against an officer, nor as evidence in any manner in any accident review board hearing, grievance board hearing or arbitration. The Accident Review Board shall review accidents involving police vehicles to determine whether or not the officer involved was negligent. Tie votes shall be resolved by a decision of the chairman or in his absence the designated Commander. The Accident Review Board shall be empowered to hold whatever hearings and interviews of witnesses it deems necessary to fulfill its purpose. The Accident Review Board shall conduct its hearings monthly, giving at least five (5) calendar days notice to officers of such hearings. Accidents involving police vehicles which occur less than fourteen (14) calendar days prior to the third Wednesday of a month shall not be heard until the succeeding month's hearing. The Accident Review Board shall report its findings along with reasons in support thereof to the Chief on the date that a decision is reduced to writing. Discipline imposed as a result of the accident review board shall be imposed within fourteen (14) calendar days of the date that the decision of the accident review board is reported to the chief, which time may be extended by mutual written agreement. ACCIDENT REVIEW BOARD. In an effort to avoid or reduce personal and/or financial consequences of accidental injuries or damages sustained by its employees and the general public, the City of Highland Park (City) has created a system of Accident Review Boards (Boards). These Boards are charged with the responsibility of identifying, investigating and evaluating employee work-related injuries, vehicle accidents and property damage accidents and to recommend appropriate remedial action to prevent similar accidents/injuries in the future. These Boards are not disciplinary bodies but make recommendations to the applicable department director based upon the guidelines set out in this policy. These Boards shall recommend job training to department directors for employees or work groups in order to xxxxxx a safe and accident-free work environment for all employees. The Accident Review Board for the Police Department shall be established with the following membership. The Police Chief shall be the chair of the Board and the membership of the Board shall not exceed seven members. • Police Chief (1) • Deputy Police Chief (1) • Police Commander (1) • Police Sergeant (1) • Police Bargaining Unit Employee Representative (1) The Accident Review Boards shall adhere to the regulations set forth in the City policy. There shall be three (3) classes of personnel for review if there is an accident: • Full-Time Field Personnel – defined as an employee whose primary job description involves operating a motor vehicle or equipment in the field 50% or more of their time. • Part-Time Field Personnel- defined as an employee whose primary job description involves operating a motor vehicle or equipment in the field less than 50% of their time. • Non-Field Personnel – defined as an employee whose primary job description does not involve operating a motor vehicle, machinery or work outside an office environment. The review periods for personnel shall be as follows: • Full and Part-time field personnel for a one (1) year period. • Non-Field personnel for a two (2) year period.
ACCIDENT REVIEW BOARD. A committee shall be established to review all accidents involving bargaining unit employees and work related injuries. The board shall consist of two (2) supervisors and (2) drivers who have at least three (3) consecutive years of non-preventable accident driving experience and who will be selected by the Union. All accidents shall be reviewed as soon as the board can be convened or as scheduled. The frequency of the committee meetings shall be established at its first regular meeting. The board shall not make any recommendations regarding discipline; however, discipline will not be administered until preventability or non-preventability of the accident is determined. In the case of a tie vote by the board regarding the preventability or non-preventability of the incident, the contract manager shall have the ability to cast a tie breaking vote. The Union retains the right to grieve the decision of the Accident Review Board or the vote cast by the contract manager for a period of twenty (20) calendar days after notification to the Union. The duties of the Accident Review Board shall include: Analyzing evidence, including all police reports and the drivers' and safety officers' reports, and conducting employee interviews to determine root causes of accidents. Determining the preventability or non-preventability of the accident. Recommending additional training or other appropriate interventions that may help employees avoid future accidents. Identifying deficiencies in the safety management system. The Terminal Manager shall schedule the driver involved in the accident to appear before the committee. Upon request, a Union representative may be present.
