COMPENSATORY TIME IN LIEU OF OVERTIME. A. Compensatory time earned by the employee is accrued for an equal amount of time spent in overtime work. B. FLSA (nonexempt) employees will be allowed to earn and use compensatory time rather than paid overtime provided that compensatory time must be at the request of the employee and cannot be mandatory. C. If the employee desires to work compensatory time instead of overtime, then the employee must indicate the desire/request to work compensatory time in the remarks section of the employee’s request in the Agency’s automated time and attendance system before the Agency approves the overtime work assignment. D. Once the Agency approves the overtime, the supervisor/designee must approve the compensatory time before the employee works the additional hours. E. Employees must use such compensatory time before using any credit hours or annual leave (except use or lose annual leave). The compensatory time must be used by the end of the 26th pay period following the pay period in which the compensatory time was earned. If the employee does not use the compensatory time by its expiration date, the Agency shall pay the employee the remaining time at the overtime rate of pay applicable at the time the employee worked the compensatory time.

COMPENSATORY TIME IN LIEU OF OVERTIME. Compensatory time credit may be accumulated, in lieu of overtime pay, in a compensatory time bank of up to forty (40) hours maximum. The current practice for the use of compensatory time and vacation time will be maintained, consistent with the following agreement of the parties:
COMPENSATORY TIME IN LIEU OF OVERTIME. A. Employees may receive compensatory in lieu of overtime, at time and one half (1.5). B. Compensatory time shall be subject to the following guidelines: 1. Compensatory time can be taken at any time that is mutually convenient with the Employer and requesting employee. 2. No compensatory time shall be granted or taken when the payment of overtime pay for a replacement is necessary. 3. Compensatory may be accumulated from one contract year to the next, so long as the total hours in an employee’s compensatory bank do not exceed the maximum accumulations outlined in Section 10.3.B.4. 4. Compensatory time shall be not be accumulated to more than sixty (60) hours for an individual employee. When sixty (60) hours is reached, any overtime worked by said employee shall be paid as part of the normal payroll process. 5. No more than forty (40) overtime hours shall be converted to Compensatory time in a single contract year. 6. If an employee chooses to accept pay for accumulated compensatory time, the employee need only notify the Finance Department through the Director of Public Works, and the employee shall be paid for said hours. Employees may only request pay for accumulated compensatory time between April 1 and June 30 of any calendar year. Pay for compensatory time shall be at the hourly rate in effect on the date the employee requests payment. 7. Upon resignation, dismissal, or retirement, all accumulated compensatory time shall be paid to the employee. In the case of a deceased employee, his/her accumulated compensatory time shall be paid to the spouse or estate.
COMPENSATORY TIME IN LIEU OF OVERTIME. Employee’s compensation for extra time will be given on a basis of one and one-half hours for each hour worked. Such compensatory time shall be used within twelve months of the time earned. Compensatory time will be administered at the local level by the Immediate Supervisor or administrator.
COMPENSATORY TIME IN LIEU OF OVERTIME. In lieu of receiving pay at the one and one-half rate for overtime worked, an employee may opt to receive compensatory time off at the rate of one and one-half hours off for each hour worked. On each occasion when an employee is contacted and offered overtime work, the employee shall advise the supervisor making the contact of the employee's desire to receive either compensatory time off and/or pay for the overtime work being offered. The employer will attempt to honor the employee's preference, however the final decision as to the type of compensation rests with management, but the decision shall be based upon fiscal considerations of accumulation limits. The employee will be informed about the type of compensation he or she will receive for overtime prior to the work being done. In no case shall an employee's accumulated compensatory time balance exceed two hundred and forty (240) hours.
COMPENSATORY TIME IN LIEU OF OVERTIME. Employees may voluntarily request compensatory time in lieu of overtime compensation. One hour of compensatory time off is granted for each hour of overtime work. If accrued compensatory time off is not used by an employee within 26 pay periods or if the employee transfers to another agency or separates from Federal service before the expiration of the 26 pay period time limit, the employee must be paid for the earned compensatory time off at the overtime rate in effect when earned.

COMPENSATORY TIME IN LIEU OF OVERTIME. 4.1 Any work time accumulated within the current workweek, prior to the last day of the workweek, that could result in ove1time may be required, at the Employer's discretion, to be taken as equivalent time off on an hour-for-hour basis within the same workweek in which it was worked. When this required flex-time off occurs over a weekend an employee was otherwise scheduled to work, then the weekend shall not count against the employee as a weekend off for weekend rotation purposes. 4.2 In lieu of paying an eligible employee at the time and a half rate for ove1time worked outside the cmTent workweek, the employee may, consistent with individual compensatory time agreements, elect to receive compensatory time off, at the rate of one and a half (1½) hours off for each hour of ove1time worked. An updated compensatory time accrual balance shall appear on the paycheck/advise summary when the employee would have otherwise been paid for the oveitime worked. 4.3 Employees shall be permitted to use compensatory time off at a time mutually agreeable to the employee and their supervisor. Employee requests to use compensatory time shall not be umeasonably denied. 4.4 Within thirty (30) days of the execution of this Agreement eF within 30 days of new employees' date of hire or within ten (10) days of the one (1) year employment xxxx, the Department shall notify employees of the right to execute an individual compensatory time agreement, which shall identify if the employee is willing to accept compensatory time or paid overtime. Employees shall be given one week to execute and return the compensatory time agreements to the Employer. A copy of the compensatory time agreement is attached as Appendix A of this Agreement. Employees shall not be coerced into electing to receive compensatory time in lieu of receiving paid ove1time. If an employee fails to execute a compensatory time agreement within the time provided herein, the employee's most recent agreement shall remain in effect.   • Overtime/Compensatory Time A. Employees working assigned, pre-approved time in excess of forty (40) hours per week shall be given either overtime pay or compensatory time at the rate of one and one-half times the employee’s regular rate of pay. The name of the supervisor authorized to approve overtime assignments shall be posted in each building. The employee may elect to take either overtime pay or compensatory time off. Holidays, sick leave, personal days, or vacation days shall be included as regular time for purposes of computing overtime. In the event overtime is required, the Assistant Superintendent or his/her designee shall solicit volunteers to fill the overtime positions. In the event no volunteers are available or the volunteers available are unqualified in the opinion of the Assistant Superintendent or designee, overtime may be assigned. Overtime assignments will be made on a rotational basis at each work site to employees who normally do the work assigned. Reasonable advance notice will be given to employees assigned overtime. An employee shall not be called in for snow removal duty sooner than 8 hours following the conclusion of his/her regular shift or any other work performed for the District. B. Only forty-five (45) hours of compensatory time can be earned in a contract year. Use of compensatory time must be approved by the employee’s immediate supervisor. Compensatory time earned must be used during the contract year in which it is earned or cashed in for pay at the rate in effect for the employee at the time the employee receives such payment. Employees who have accumulated more than forty (40) hours of compensatory time at the time of execution of this Agreement shall retain all such accumulated time, provided, however, that such employees shall not be allowed to use more than forty (40) hours in any contract year. All compensatory time must be submitted on a timesheet. C. All overtime worked must be submitted on a timesheet to the building principal in accordance with business office procedures for processing payroll. Xx employee called in to work on his/her day off will be paid for a minimum of two (2) hours at the appropriate rate. E. The decision to assign overtime will not be based upon an employee’s preference for either compensatory time or overtime pay. F. In the event an employee’s regular permanent assignment requires the performance of duties in more than one job classification, the overtime rate to be used to calculate compensation for the employee for the overtime work shall be the rate of the classification which caused the employee to work such overtime hours.

  • Compensatory Time Use An employee must use compensatory time prior to using vacation leave, unless this would result in the loss of their vacation leave or the employee is using vacation leave for domestic violence leave. Compensatory time must be used and scheduled in the same manner as vacation leave, as in Article 11, Vacation Leave. Employees may use compensatory time for leave as required by the Domestic Violence Leave Act, RCW 49.76. The Employer may schedule an employee to use their compensatory time with seven (7) calendar days’ notice.

  • Time Off in Lieu of Overtime Employees who work overtime will not be required to take time off in regular hours to make up for overtime worked. Time off in lieu may be taken on a mutually agreed upon basis between the employee and the Hospital, such time off will be the equivalent of the premium rate the employee has earned for working overtime. The Hospital shall revert to payment of premium rate if time off is not taken within sixty (60) calendar days."

  • Overtime and Compensatory Time Overtime work shall be compensated as follows: A. Hours in an active pay status in excess of forty (40) hours in any calendar week shall be compensated at the rate of one and one-half (1 1/2) times the total rate of pay, as defined by Section 43.01, for each hour of such time. Total rate of pay includes the base rate plus longevity, all applicable supplements, and shift differential where applicable. B. An employee may elect to take compensatory time off in lieu of cash overtime payment for hours in an active pay status more than forty (40) hours in any calendar week. Such compensatory time shall be granted on a time and one-half (1 1/2) basis. C. The maximum accrual of compensatory time shall be two hundred forty (240) hours and compensatory time must be taken within one (1) year of its being earned. D. When the maximum hours of compensatory time accrual is rendered, payment for overtime work shall be made in cash. Compensatory time not taken within one (1) year shall be paid in cash to a maximum of eighty (80) hours in any pay period. E. Compensatory time is not available for use until it appears on the employee’s earnings statement and on the date the funds are made available. F. Upon termination of employment, an employee shall be paid for unused compensatory time at a rate which is the higher of: 1. The final total rate received by the employee, or 2. The average total rate received by the employee during the last three (3) years of employment. For the purposes of this Article, active pay status is defined as the conditions under which an employee is eligible to receive pay, and includes, but is not limited to, vacation leave and personal leave. Sick leave and any leave used in lieu of sick leave shall not be considered as active pay status for purposes of this Article. Compensatory time requests must be submitted in writing twenty-four (24) hours in advance of the anticipated time off, unless the need for time off is of an emergency nature.

  • Compensatory Time Off Utilization of compensatory time off shall be by mutual agreement between the department head and the employee. The smallest increment of compensatory time which may be taken off is six (6) minutes.

  • Compensatory Time A Bargaining Unit member may choose to take compensatory time in lieu of overtime compensation if such choice is indicated during the tour of duty in which the overtime is worked. Compensatory time shall be credited to the Bargaining Unit member and accumulated at the rate of one and one-half (1 ½) hours for each overtime hour worked. Each Bargaining Unit member’s compensatory time bank shall be limited in accumulation to a maximum number of two hundred forty (240) hours. Once a Bargaining Unit member has reached the maximum hours of compensatory time as compensation for overtime hours worked, all additional overtime will be paid. The Bargaining Unit member may choose to carry over any balance into the following year. Any balance of compensatory time carried over into the following year shall count towards the two hundred forty (240) hour cap in that year. Compensatory time off must be taken at a time agreeable to the Department and the Bargaining Unit member. Approval for compensatory time off shall not be unreasonably withheld. Compensatory time off should be requested as far in advance as possible but no later than forty eight (48) hours in advance. When Bargaining Unit members request compensatory time off at least 45 calendar days in advance, the employer will, within five (5) working days of the request being made, notify the member whether or not his/her request has been approved. Approval for compensatory time shall not be unreasonably withheld. As soon as the employer notifies the member that his/her request has been approved, and if the employer determines that the shift will be filled, the employer will post the overtime assignment to cover the member’s request. If there are no volunteers to cover this need for overtime, and if the employer determines that the shift will be filled, a mandate to cover the shift will occur no less than seven (7) calendar days in advance of the beginning of the shift that needs to be covered. The employee being mandated will have the lowest number of overtime hours worked and will be notified by a supervisor. In the event the employee being mandated is on an approved leave and cannot be provided seven

  • Compensatory Time Cash Out All compensatory time must be used by June 30th of each year. If compensatory time balances are not scheduled to be used by the employee by April of each year, the supervisor will contact the employee to review their schedule. The employee’s compensatory time balance will be cashed out every June 30th or when the employee: 1. Leaves state service for any reason; 2. Transfers to a position in their institution with different funding sources; or 3. Transfers to another state agency or institution.
