COST ITEMS. All cost items shall be submitted to the Timberlane Regional School District Meeting in accordance with RSA 273-A:3IIb. The Board shall make a good faith effort to secure the funds necessary to implement said Agreements. If such funds are not forthcoming, the Board shall consult with the Association, with respect only to the matters affected thereby, in order to determine whether any portion of the provision previously agreed to by the parties, may be implemented. If agreement is not reached by the budget submission date, it is recognized that the Board, in the course of meeting its statutory obligations and responsibilities, must submit to the Timberlane Budget Committee such proposals of an economic nature as appear suitable at the time and under prevailing circumstances.

COST ITEMS. 8.2.1 Wages paid for labor in the direct employ of the Construction Manager in the performance of the Work. Labor costs shall be itemized to indicate trade, hourly rate, man hours, and total cost. 8.2.2 Salaries of the Construction Manager's employees when stationed at the field office, in whatever capacity employed, employees engaged on the road expediting the production or transportation of material and equipment, and employees from the principal or branch office performing the functions listed below directly attributable to the change. The Owner may require that the Construction Manager provide sufficient documentation of actual expenses claimed under this Subsection 8.2.2. 8.2.3 Cost of all employee benefits and taxes, including but not limited to, workers' compensation, unemployment compensation, social security, health, welfare, retirement, and other fringe benefits as required by law, labor agreements, or paid under the Construction Manager's standard personnel policy, insofar as such costs are paid to employees of the Construction Manager who are included in the Cost of the Work pursuant to subsections .1 and .2 immediately above. 8.2.4 Reasonable transportation, travel, hotel and moving expenses of the Construction Manager's personnel incurred in connection with the Work. 8.2.5 Cost of all materials, supplies and equipment incorporated in the Work, including costs of inspection and testing if not provided by the Owner, transportation, storage, and handling. Material costs shall be itemized to include unit cost, quantity, and total cost for each item. 8.2.6 Payments made by the Construction Manager to Subcontractors for work performed under this Agreement. The direct expenses and overhead and profit percentages for work performed by Subcontractors is subject to the same limitations and requirements specified herein for the Construction Manager. COST ITEMS. The cost items contained in this Agreement shall not become effective unless appropriations necessary to full fund such cost items have been enacted by the General Court in accordance with Massachusetts General Law, Chapter 150E, Section 7 and allocated by the Governor to the University of Massachusetts, in which case the cost items shall be effective on the effective date provided in this Agreement.

COST ITEMS. 7.2.1 Wages paid for labor in the direct employ of XXxX in the performance of the Work under any applicable collective bargaining agreement, or under a salary or wage schedule agreed upon by the Owner and XXxX, and including reasonable and customary benefits, if any, as may be payable with respect thereto. Such costs shall be at rates not higher than the standard pay in the locality of the Work except with prior consent of the Owner, and shall include the items set forth below in this Article. Construction Manager shall ensure that the value of each Trade Contractor’s subcontract includes the costs associated with providing Trade Contractor payment and performance bonds. 8.2.4 Cost of the premiums for all insurance or bonds including Trade Contractor bonds which the Construction Manager is required to procure by this Contract, or other insurance or bonds subsequently deemed necessary by the Construction Manager, and agreed upon by the Town. The stipulated rates for insurance and bond costs are as follows: 8.2.5 Sales, use, gross receipt, or similar taxes related to the Work imposed by any governmental authority and for which the Construction Manager is liable. 8.2.6 Deposits lost for causes other than the Construction Manager's own negligence. 8.2.7 Cost of removal and disposal of all debris including clean-up and trash removal, not including Construction Manager’s office trailers. 8.2.8 Cost incurred due to an emergency affecting the safety of persons and/or property. 8.2.9 Subject to prior written approval by Town, legal costs reasonably and properly resulting from prosecution of the Work for the Town; provided, however, that they are not the result of the Construction Manager's own negligence or malfeasance. Legal costs incurred in connection with disputes solely between the Construction Manager and the Town or incurred in connection with disputes solely between the Construction Manager and Trade Contractors are the responsibility of the Construction Manager and shall not be included in the Cost of the Work. 8.2.10 Cost of temporary electric power, lighting, water, sanitary facilities, and heat required for the performance of ...
