Declared Emergencies. (i) If a situation arises requiring a major operational response, or an emergency is declared under section 44 of the Rural Fires Act 1997 (NSW), under other relevant legislation or by the Premier, employees who volunteer to assist are granted special leave with no upper limit; (ii) Emergency services leave granted for declared emergencies does not count towards the 8 day upper limit specified above in this clause; (iii) WaterNSW emergencies will take precedence over any other emergencies. (iv) Rest periods for declared emergencies will be as follows: (A) if a volunteer employee remains on emergency duty for several days, the employee will be granted special leave to allow reasonable time for recovery before returning to work. If a volunteer employee assists in an emergency at a time where it would be unreasonable to expect the employee to report for work at the normal time, the employee will be granted up to one day special leave for rest; and (B) rest periods are in addition to the maximum 8 days emergency services volunteers leave provided for in this clause. (v) A notice to WaterNSW is required. Prior to attending training or an emergency that would require the employee to be absent from work, the employee or their nominee, will notify XxxxxXXX as follows: (A) prior to leaving the workplace if the employee is on duty when called to attend the emergency; (B) ordinarily within one hour of the employee’s usual starting time or as soon as reasonably practicable, of the employee’s intention to attend an emergency and the estimated duration of the absence if and/or when known; and (C) at least 48 hours prior to the commencement of the employee’s usual working time or sooner where practicable, if required to attend an emergency services training course. (vi) Approval and payment for leave will be subject to: (A) notice being given to WaterNSW as per this clause; (B) written confirmation of attendance from the relevant emergency service group; and (C) WaterNSW’s operational requirements.

Declared Emergencies. B.1 Unit members, as public employees, are disaster service workers subject to such disaster service activities as may be assigned to them by their superior or by law. B.2 As disaster service workers, unit members who are on campus during such a time as local or state emergency has been declared may be asked to do jobs other than their usual duties for periods of time exceeding their normal working hours.
Declared Emergencies. In the case of a declared emergency, pursuant to R.C. 3345.26, all College employees are considered essential employees of the College and must report to work, unless notified otherwise by an authorized College official. Mitigating circumstances will be considered on a case-by-case basis. Essential employees who work will be paid at time and one-half for hours worked during a declared emergency; however, bargaining unit members will be compensated under Section 2 of this Article 9 for emergencies declared pursuant to R.C. 3345.26 for weather-related reasons if the declared emergency involves a College Closure, as defined below, lasting less than three (3) working days.

(iii) Agreed leave for a further one day for rest purposes may be granted prior to the resumption of duty.

Declared Emergencies. 1. During declared emergencies, the Towing Agency shall dedicate and provide the use of at least four (4) tow trucks and four (4) operators to the service of the City. For the duration of such emergency, the Towing Agency shall not assign the dedicated vehicles to perform other private towing services unless specifically released by the Chief of Police or his designee. In the event of a dedicated vehicle becoming disabled or inoperable, the Towing Agency shall make every reasonable effort to return the vehicle to operation rapidly or obtain a replacement vehicle during the duration of the declared emergency. 2. Other than the four (4) tow trucks and four (4) operators dedicated to the service of the City as set forth in Section 2.01.D.1 above, during a declared emergency, at the discretion of the Chief of Police, all of the Towing Agency‟s remaining vehicles shall be subject to the provisions of Section 2.01.C above. 3. The parties mutually agree that the availability and dedication of such vehicles is deemed necessary to the health and welfare of the citizens of the City of Rochester. Therefore, in the event that the Towing Agency does not provide and dedicate four (4) operating tow trucks during a declared emergency, one or more of the following penalties shall apply, in the sole discretion of the Chief of Police or his designee: a. Replacement towing services may be obtained from other towing agencies and any charges in excess of those agreed to herein will be deducted from any sums due to the defaulting Towing Agency. b. The defaulting Towing Agency may be suspended from receiving non-emergency towing calls for a period of up to thirty (30) days. c. Declaration of default in accordance with Section 6.01, “Termination for Default”.

Declared Emergencies. The City of Scranton and Local 2305 agree that when the Mayor and the City Controller or Governor of the Commonwealth of Pennsylvania pertaining to a snow emergency declares an emergency, the City may subcontract snow removal, provided that all City snow removal equipment that is operable, is in use and being operated by Local 2305 members. Any other bona fide emergency that is declared through no fault of the Union or City may be subcontracted, provided the same formula is used above. Once the emergency is over, said work will be returned to bargaining unit members. The City may also subcontract when insufficient personnel are available to operate equipment.
