Establishment of Seniority. Except as otherwise provided in this article, seniority shall be established and accrue from the date on which an employee commences employment.
Establishment of Seniority. 5.3.1 Seniority, for purpose of transfer, where multiple employees have the same seniority date, shall be determined in the following manner:
5.3.1.1 By November 1 each year the Parties will meet to establish the “Yearly Random Alphabet” which shall be the 26 letters of the alphabet, drawn at random, alternating MDEA then MDUSD. The District shall publish the Yearly Random Alphabet to all bargaining unit members by November 2 each year.
5.3.1.2 For employees first rendering paid probationary service on the same day, seniority shall be determined by last name using the Yearly Random Alphabet. For last names beginning with the same letter, alphabetical order according to the regular Latin alphabet, beginning at the second letter, will be used.
5.3.1.3 Employees whose first probationary service is retroactively determined (e.g., pursuant to §44918 Ed.
Establishment of Seniority. A. Each bargaining unit seniority list shall contain the names of all employees in the bargaining unit as already established on the existing plant-wide list.
B. The names of new employees will be added to such seniority list when they complete their probationary periods.
C. Each seniority classification list shall contain the names of employees as already established. In the case of a new employee, their seniority classification will be determined by their work assignment on which they are working when they finish their probationary period, and should their work assignment consist of performing work under more than one
(1) seniority classification, they will be assigned the seniority classification under which they perform the greatest amount of work.
D. An employee may have seniority in only two seniority classifications at the same time.
E. An employee will change their seniority classification by (1) job bidding, (2) voluntary transfer to fill a vacancy created by job bidding, (3) a transfer as an incapacitated employee as herein provided in Section 18, or (4) as provided in Section 13-B-(3) of this Article.
F. An employee being reduced from their seniority classification or recalled to the bargaining unit who is assigned to a vacant work assignment will automatically acquire seniority rights in such secondary seniority rights in such secondary seniority classification.
Establishment of Seniority. (i) The seniority of an Employee shall be established from the date when such Employee last commenced service with the Company within the jurisdiction of this Bargaining Unit, subject to the exceptions and conditions of this Article.
(ii) Employees who have entered or who hereafter enter the service of the Company from any utility acquired by the Company shall, in addition, be credited with their length of seniority in the same acquired utility as calculated in accordance with the provisions of this Article.
(iii) An Employee entering the jurisdiction of this Bargaining Unit shall not establish seniority until employed in a position for one hundred and eighty (180) calendar days after which seniority shall be retroactive to the date the Employee last entered the jurisdiction of this Bargaining Unit.
(iv) When an Employee has accumulated total absences in excess of ten (10) working days as a result of sickness, accident, or other approved leaves, the Company may extend the one hundred and eighty (180) calendar day period by the total number of working days lost by reason of such absences. Other extensions of the one hundred and eighty (180) day period may be agreed upon between the Company and the Union.
Establishment of Seniority. Employees returning from an approved Leave of Absence shall be restored to full seniority.
Establishment of Seniority. The seniority of each employee within the bargaining unit defined in Article 2 of this Agreement shall be established as follows:
Establishment of Seniority a) Seniority shall be established upon the completion of the probationary period and shall count from the date of employment.
b) In the event a permanent employee contemplated by a) above has previously been employed by the Division in a term position(s), for seniority determination purposes only, that employee’s seniority shall count from the date of employment in any consecutive term position(s) and that the consecutive term positions terminated within thirty (30) calendar days of commencing permanent employment. For employees employed on a ten (10) month basis, because of the nature of their positions due to the closing of schools during July and August, this period shall not be considered a break in consecutive service.
c) In the event a permanent or term employee was previously a casual employee (see Article 2.01 a)), seniority shall be recognized for that casual employment provided the casual employment was for a minimum of twenty (20) consecutive working days in the same position and is consecutive of commencement in a permanent position or in a term position qualifying for seniority recognition in accordance with b) above.

For employees employed on a ten (10) month basis, because of the nature of their positions due to the closing of schools during July and August, this period shall not be considered a break in consecutive service.
c) In the event a permanent or term employee was previously a casual employee (see Article 2.01 a)), seniority shall be recognized for that casual employment provided the casual employment was for a minimum of twenty (20) consecutive working days in the same position and is consecutive of commencement in a permanent position or in a term position qualifying for seniority recognition in accordance with b) above. Seniority shall be maintained and accumulated during:
1) absence due to personal illness or injury up to the maximum days accumulated under the provisions of the collective agreement;
2) absence due to a compensable accident under Workers' Compensation;
3) authorized leave of absence up to sixty (60) calendar days;
4) the statutory period of absence for maternity/parental leave as provided for in The Employment Standards Code;
5) authorized leave of absence for Division approved apprenticeship training.
Establishment of Seniority. (a) Seniority List 1:
(i) Seniority retroactive to the initial date of employment shall be established on Seniority List 1 for new employees following three (3) calendar months of continuous service in a regular posted position. Such period of time may be extended by mutual consent of both parties, in writing, but such extension should not exceed one (1) month except in unusual circumstances.
(ii) For employees who transfer to regular employment from Seniority List 2, a seniority date on List 1 will be established as the date started in the regular posted position or as the date started in a temporary posted position if there is no break in service and the position’s category is the same (clerical, custodial, maintenance or classroom).
(iii) Shift credits on List 2 do not transfer over to List 1, except as stated in (i) and (ii) above.
(b) Seniority List 2: This list has been established for the purpose of applying for posted positions and available shift assignment and includes all temporary and casual employees who have completed ninety (90) shifts within the past three (3) years. Shift is defined as any day on which an employee has worked. The calculation for value on Seniority List 2 will be:
(i) Casual and temporary employees will receive one (1) shift credit for each shift worked. When they have accumulated ninety (90) shifts within a three (3) year period of time, they will be placed on Seniority List 2.
(ii) When determining the most senior person on Seniority List 2 for posting and filling, the total number of shift credits as of the last payroll will be the deciding factor.
(iii) When determining the most senior person on Seniority List 2 for casual call-in, the total number of shift credits as of the previous posted seniority list will be the deciding factor.
Establishment of Seniority. (a) Drivers' seniority will be established at the time of employment or as of the hour and day an employee transfers to the Drivers' Section. Drivers' seniority will be established at the time of first earning wages as a driver.
(b) When more than one driver is commencing on the same day, seniority commences on the first day of training and shall be determined by a draw for all participants in the training class, (i.e. two (2) or more persons). This relative seniority shall be fixed and not subject to appeal. The draw must take place with a Union Representative present (i.e. Chief Shop Xxxxxxx, Union Representative).
(c) If anyone hires on subsequent to the previous training class, they will be given a seniority date effective as of the day they commence training.
